Additional Complaint Information

BBB has received complaints stating Physzique charges for services which were reportedly free or reduced. These free or reduced services were either won or bought using 'Groupon', entering workplace or bridal fairs, or winning a raffle at en event. 

Consumers claim that they were told they had to sign a waiver agreement/service contract in order to use the free or reduced services. Consumers further reported that they were told signing this waiver agreement/service contract was used solely as a waiver while using the gym, and that consumers were not signing a service contract. 

While responding to consumer complaints from the BBB, Physzique claims that the complainants had agreed to a full membership and are held to the service contract terms and conditions, therefore no refund or cancelation of contract was allowed.

BBB determined that the contract does not sufficiently reflect the free or reduced services, nor does BBB deem the process to be clear to consumers. 

The BBB has requested changes and/or an explanation from the business. Physzique has failed to reply to three (3) notices sent to the business from the BBB. 

Consumers are urged to thoroughly read all contracts, waivers, documentation and collateral before signing or using any type of service.

 Washington Attorney General's Health Club Tips

  1. Within three (3) days after signing a contract, you can cancel your membership for any reason.
  2. Cancelations must be in writing, and after receiving your written cancelation notice, the club has 30 days to refund your money. At any time during your membership, if your contract runs for more than a year, you can cancel by giving 30 days written notice.
  3. If your contract is later than one year, and you move more than 25 miles from the health club, you can cancel if no affiliated club within 25 miles of your new residence offers the same services at no additional charge.
  4. If the health club closes permanently, and the owner does not have a comparable facility within 10 miles of the club, you can cancel and receive a pro-rated refund of your initiation fee.
  5. If equipment or services which were promised in the contract are not completed by the date specified in the contract are not completed by the date of the contract, you are entitled to a full refund of your membership fee.
