American Federal Savings Bank was founded in 1922 in Helena, Montana as a Montana chartered building and loan association. In 1975, the Bank adopted a federal thrift charter. The Bank still maintains its headquarters and two other branches in Helena, with additional branches in Bozeman, Butte and Townsend, Montana. The Bank’s market area is concentrated in south central Montana, to which it offers commercial, residential and consumer loans. The Bank’s principal business is accepting deposits and, together with funds generated from operations and borrowings, investing in various types of loans and securities.

Complaint: My complaint is regarding this bank's procedures when processing deposits versus electronic payments. Today, October 22, 2012, I had 3 electronic payments drawn my account 1st thing this morning. A few hours later my deposit was posted before noon. They still saw fit to charge me 3 overdraft fees in the amount of $27.00 each for the electronic transactions causing a temporary overdraft of my account. They have control over posting process not me. I might that I mailed my deposit on Thursday, October 18th, knowing full well that they actually received it in their mailbox on Saturday, October 20th. Any deposits received over the weekend should be deposited first thing Monday morning prior to any other transactions. To my knowledge most Banks have a cutoff for Same Business Day of 3 p.m. (some banks as late as 6 p.m.) hence the electronic transactions should be covered by the deposits made the Same Business Day. Not the case with American Federal Savings Bank, though they recorded my deposit as received the Same Business Day, they still charged me for 3 EOD NSF Fees.They also enter the transactions in descending, therefore creating more NSF fees. Chase Bank is a prime example of this illegal activity as there is a Class Action Lawsuit currently taking place for this same practice. I have a notion to start my own Class Action Suit against American Federal Savings Bank for the same illegal practices.

Desired Settlement: I want $81.00 deposited back to my account and a refund of any other NSF Fees caused by the same process.

Business Response:

American Federal has worked with **** **** ****** numerous times about her overdrawn account and refunding fees.  Ms. ****** initiated 3 electronic payments which paid through her account on the morning of October 22, 2012, the normal time electronic payments are posted.  The order in which electronic payments are posted is in the order in which they are received, as disclosed to Ms. ******.  Later in the day she made a check deposit at 1400 Prospect Ave., after the electronic payments have posted.  Fees are automatically charged to accounts at roughly 2:00p.m. for insufficient funds.  

At the time these electronic payments were presented for payment Ms. ******'s checking account did not have sufficient funds to cover these payments.  As mentioned above, American Federal has worked with Ms. ****** on numerous occasions on this same issue, even refunding many NSF fees.  It is the customers responsibility to make sure there is sufficient funds in the account prior to authorizing electonic payments or writing checks. 

If Ms. ****** needs additional assistance with reconciling her account or account activity printouts, please have her contact*** ******** ** ************.
