Complaint: Summit Collision owner agreed to fix my 2009 Toyota Camry a year ago. They fixed the cosmetic body and decieptfully covered up the structural damage. They collected over $9,000 from my insurance and my $500.00 deductible. I took it back to the owner twice and he told me they fixed it but the aftermarket parts didn't fit but there wasn't anything I could do about it. I have it at a new shop recently to look at all damaged structural parts that they did NOT fix but recieved payment. My car has not been safe to drive for my daughter and I and they accepted the money without fixing my car. The value of my Toyota is diminished. I believe this to be deliberate neglect and insurance fraud. I do not recommend going to Summit. This should be criminal. If I hadn't been in a second minor accident I would have never known and could have been seriousely injured.

Desired Settlement: I should get my deductible back to pay new autobody shop for the repair.I should be compensated for them breaching the contract to fix my car. They should be held accountable for insurance fraud. Consumers should be aware of this illegal and unethical practice.

Business Response: Summit Collision Center has done whatever we can to resolve the issue with this customer. Summit Collision Center has a 100% customer satisfaction guarantee, and we did whatever it took to rectify this situation. We offered to buy the customers vehicle at fair market value, they declined that offer. We have paid for the customer to have their vehicle repaired for this issue ,while the vehicle is being repaired for another accident at another local repair shop here in Helena as well as paying for the customers rental car starting 9/4/12 while their vehicle is being repaired. We stand behind our work, when this instance occurred we were a brand new shop and since, have put new policies and procedures in place to insure better quality repairs . Summit Collision Center maintains a 100% customer satisfaction guarantee although, we do realize we can not completely satisfy each customer 100%. We deeply regret that we were unable to 100% satisfy this customer so we did our best to do whatever it took to make this customer happy. With reguards to whoever it may concern Summit Collision Center has done whatever it took to resolve this issue, thank you for your concern, and if there are any further questions or concerns please contact ***** ******, President at ###-###-####.

Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID 9172764, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

***** ****** accepted this car back twice after the repair was not done and personally reassured me it was fixed after he lookied at it. The structure of the car was severely compromised, metal parts that should not be bent back were with his charge for new parts and this is a case of fraud. Parts were broke and glued back together and I paid for a new hood that isn't even on the car.

I have asked for him to contact me and he refused. I have NEVER heard from ***** except through other people's messages. He knew of the problem from Great Northwest Insurance on September 5th. The date is now the 18th. He refuses to put rental car in his name and asked Enterprise to call me stating he would "pay me back". He offered a much lower value for the car based on KBB and Toyota dealership quotes from mileage and date my car was wrecked.

As of today, he has not paid the Capital Collision to do repairs, he has not spoken to or addressed me, and he has not paid for my rental car that is currently being held on my card.

He accepted $9800.00 from insurance and myself for work that was never done. My car is determined unsafe by the adjuster and a month and a half later, I still can't get it fixed. This is not 100% customer service and I cannot imagine a consumer that would think it is.

He owes me for the repair and rental car upfront and owes me my deductible back. He did cosmetic fix to intentionally steal from me.  Being a new shop is no excuse for putting a family in danger and stealing insurance money so they cannot get it repaired properly and losing the entire value of the car.

I hope others that have had repairs done here will check to be sure they are safe. Unacceptable for any business.

Summit Collision Center has paid for the rental car and has made arrangement's with the local repair shop to repair the vehicle. We have been advised to not speak to Mrs. **** personally about this issue. Summit Collision Center is and will continue to do what ever we can to rectify this. We are a family based business and have families and kids of our own, we understand the complaint and concerns that Mrs **** has. Summit Collision Center is in contact with the insurance company and the repair facility as well as the insurance commissioner. We stand by our work and we are sorry we could not justify this issue with Mrs.  ****.
