Improper installation of roof A/C unit.
On 4/4/10 Simmons A/C installed commercial grade A/C unit on roof of porch to service worship building. Over the years a portion of the porch roof has fallen due to water leaking through A/C. After consulting with a professional engineer, that Simmons A/C insurance company hired, it was determined the leaking was caused by incorrect installation of the unit.

Desired Settlement
First Baptist had requested Simmons A/C to pay to have the unit re-installed by a competent company. Simmons turned the matter over to their insurance company. The insurance company determined FBC has a valid claim but does not pay for poor workmanship. Therefore, FBC consulted legal advice and they determined although there are grounds for legal action, the statute of limitations has expired. So, FBC is forced to pay several thousand dollars to have another company re-install the unit correctly.

Business Response
Simmons A/C replaced a 25 ton gas rooftop package unit with a 25 ton gas American Standard rooftop package unit. We didn't replace any of the ductwork that penitrated the wall it was already in place. When we installed the new unit the church already had a water problem, so we are not sure that the water problem is just from the unit. We didn't hear from the church until June of this year about the leak. That has been nearly 6 years ago. They mentioned that the sheetrock had been replaced 3 times already. We can't understand why you would replace the sheetrock before you found where the water was coming from. The engineer met with Mr. * and the a/c company that the church wanted to use to replace the unit but we were not contacted to attend the meeting with the engineer. We were unable to show the engineer what work we had done and what work was done by another a/c company.Our insurance company did pay the church to have the sheet rock replaced this time. We have installed many rooftop units and have never had a water problem.

(The consumer indicated he/she DID NOT accept the response from the business.)
It states in the reply that "the church already had water problems." That is not true since we did not have any leak problems until Simmons installed the new unit. Simmons did not properly construct the "curb" that the unit sits on to keep water out of the ceiling. In regards to not be invited to the meeting with the engineer. This meeting was setup by their insurance company so I don't know why the were not invited. In conclusion, Fist Baptist considers this matter closed and recommends avoiding Simmons A/C to install roof units.
