DENVER – Owner of the defunct company, Dalbey Education Institute, Russ Dalbey, and the Colorado Attorney General and Federal Trade Commission settled a multi-million dollar lawsuit today. The settlement order bans Dalbey and his wife from telemarketing, marketing or selling business opportunities, and from producing or distributing infomercials.
For many years, Russ Dalbey sold his “Winning in the Cash Flow Business” program mostly via telemarketing and colorful infomercials featuring celebrity endorsers that promised quick, big money earnings with little effort. The Better Business Bureau of Denver/Boulder handled tens of thousands of inquiries and hundreds of complaints from the public over the years. The BBB assisted the Colorado Attorney General’s office in its investigations of Russ Dalbey and his companies.
According to Colorado Attorney General John Suthers, the Dalbeys convinced nearly one million consumers to pay thousands of dollars to participate in their wealth-building scheme. The company relied heavily on participant testimonials in its advertising, which the BBB and the authorities found to be highly misleading.
“Russ Dalbey and his companies were the subject of much BBB activity for a long time so we are pleased to see justice served,” said Su Hawk, BBB president and CEO. “We are proud to be a resource for the Colorado Attorney General and FTC.”
According to the office of the Colorado Attorney General, today’s settlement order also bans the Dalbeys from making deceptive claims about the efficacy, benefits, price, or availability of products, programs, or services, and prohibits them from using deceptive endorsements or failing to disclose restrictions regarding any products, programs or services.
