Read Complaint Details
Complaint: Contracted paid in full 10/2/2013. Product surround does not fit their measurements. Will not fix unless we pay $294.53 more up front. We contracted on 10/2 to have new Heat & Glo insert installed on 11/7. Insisted we pay everything up front. We paid. They sent company out to measure the required product for our opening. When unit installed the surround does not cover the opening. On 11/9 we were to;d we would have to have a custom surround that would cost about $300 and take 3 weeks to deliver. Told on 1/3 that the surround had just been delivered and that they told us it would take 6 weeks. Today(1/7) we were called and told they would not deliver or install untill we paid up front another $294.53. Since they have had $3200+ for more than 90 days of ours we are balking on paying anymore until they complete the work. We have been told that state law requires them to do this. We find the excuses ridiculous and believe holding back $294.53 until the work is completed in a satisfactory manner is very reasonable.
Desired Settlement: We went into your store after seeing an ad on TV. We know little to nothing about fireplaces, you said you were the experts. You sent somebody out to measure what was required. You took those measurements and told us what was required. We relied on you as the experts that know the requirements of this fireplace insert. We paid you up front as you requested for the entire product. You had our money since 10/2/2013. You delivered a product that leaves a gap of about 1.75 inches on the top of the surround. It looks like an unfinished unit and heat leaks out of the gap. We accepted your word that you would deliver a custom surround to cover the opening. Now you tell us that you will not do so until we pay more money up front because you cannot trust us to pay after you deliver because of Colorado State Law. Well, we do not trust you to finish the work based upon the work we have seen so far. We have no intent of not paying for everything that we receive but do not intend to pay for the final $294.53 until the work is completed in a satisfactory manner. We believe this to be fair and good business on our part. We are not asking for a credit for all of this time that has been wasted but agree to pay when the work is complete
Business Response: Initial Business Response /* (1000, 5, 2014/01/09) */ Mr *******'s has been able to enjoy his full functional new fireplace since it was installed on 11/7/13. Unfortunately the decorative surround was not large enough to completely cover his existing opening. I talked to Mr ******* today. He is correct with his statements. Our company policy is we take full payment prior to delivery of any product. My employee was incorrect in stating it was a state law. I told Mr ******* he could put a check in the mail after the work was completed. The installers are calling him today to set up a date for the installation of his larger custom surround. My manager could have handled this differently.
