Complaint: A balance is due on my mother's account and Garden Plaza is 150 days past due in paying. My mother was a resident of Garden Plaza since 2009. She passed away on 11 September 2013. There is a balance due ($1,653.28) to her account. I have spoken with their business manager on a myriad of occasions regarding the final settlement of my mothers estate, starting in December 2013 when it was only 90 days past due. They have willfully and purposefully delayed paying her account. Most recently, ****** (the business manager returned one of my calls and left a voice message, stating that this refund was sent out on the 17th of January (check number ****), but then stated: "If you did not receive it and would like to have a stop payment on it and have it re-issued, let me know." I reported to her that I did not receive a check and she reported that it would be re-sent. Have not received anything to date.

Desired Settlement: I am asking for and seeking Treble Damages

Business Response: Initial Business Response /* (1000, 5, 2014/02/11) */ The family member and newly hired General Manager, Cheryl Davis, connected by telephone on Monday, February 10th upon receiving notification of the concern. Corporate Accounting was contacted immediately to investigate the current standing of this refund. A check was issued to the family member and mailed from Garden Plaza of Aurora on Tuesday, February 11th for twice the amount owed to them in hopes that it may serve to alleviate any stress and inconvenience that this has caused him and his family. It is certainly not standard business practice for our company and we are truly apologetic for such an experience with us. Final Consumer Response /* (2000, 7, 2014/02/14) */ (The consumer indicated he/she ACCEPTED the response from the business.) Cheryl Davis was very helpful and resolved this issue quickly.
