Complaint: Mocavo placed information taken from public records on the internet. The information has my name, family members names/ages. Will not remove. Mocavo has been asked many times to remove information(names, ages, etc. of self/family)taken from public records and posted on the internet. For protection (identity theft) and privacy, I want ALL information in Mocavo files in my name removed permanently. They continue to refuse by continuing to say the information is "public record". This is causing harm and stress. If a person has ever been involved in identity theft, you know the danger never ends. The response from Mocavo has been cruel, irresponsible and with a total lack of understanding. If a person has asked their information be removed from Mocavo files permanently, this request should be respected. It should be done with the FIRST request. Perhaps, Mocavo has an agenda for placing people's information on the internet. Was told if I was a member, I would have more control over my information. Never have been a member, never wished to be a member and have never used Mocavo products/services. This seems to be bad business practices. Have discovered that many people have had same experience with Mocavo. How could the BBB allow them to be a member? Does Mocavo have a BBB rating?

Desired Settlement: Would like ALL information about me removed from the internet that Mocavo posted. Would like Mocavo to remove ALL information about me from their files permanently.

Complaint: I never authorized this company to charge me. They had a trial. I did the trial and that was all. I had no idea I was being charged still. November did a free trial. They charged me and kept charging me. I had no clue at all that I even had this, or was being charged. I even have an email in March to my mother asking if she wanted to try this. I have NO email from them about being charged or joining this. When I asked them for that, they said they don't have anything! I never allowed them to charge me and want my money back! Never even when on the site!!!!

Desired Settlement: I want my $90 back. That is 1 year worth, taking $18 off that they refunded me today. I don't think that is right! I want it all back!

Complaint: Contacted their office on three separate occasions, allowing adequate time processing the request but they have not removed my record, they haven't. On the initial contact I had included their completed form to request removal of my information from their data base. Their only response thus far to my request was that the ***** of ********** allows this information as public information and asked that I complete the form that I had already submitted to their office on the initial contact. The ***** of ********** stupidly allows this information to be public, yes but they also require that the information be accessed only by an account which would require individuals to create an account to access this information. If I can find my information by doing a ****** search this information is clearly in violation of the terms of the authorized and prohibited use.

Desired Settlement: I want them to remove my record from their database as initially and continually requested. My initial contact was with them on April 6th, today is now April 22nd I have already allotted plenty of them for their office to comply with my request as it has exceeded 12 business days which is irresponsible and unacceptable for any type of business.

Complaint: Mocavo posts birth records containing personal information. Company has not removed my data, despite submitting their required form & documentation. Mocavo posts/reposts ********** compilation birth records from 1905 to 1995. Information made publicly available includes sensitive personal information. I've unsuccessfully requested the removal of my own record four times twice using their online form, and once by email and follow-up email in which I included a completed form (provided by Mocavo) and documentation verifying my "relationship" to the listing. (I never signed up for Mocavo services or otherwise authorized any posting or participation in their services.) As for the information posted on their site, Mocavo cites the source as the ********** ********** of ****** ****** (formerly ***** of ****** ********* and/or their birth record compilation from years 1905 to 1995. They advise users to contact the **** to request removal of the information. Such information constitutes **** Mocavo was clearly informed that the information was being displayed without *** ********'s consent. Mocavo responded on Wed, Feb 18, 2015 at 2:48 PM that "All personal information removal requests must fill out the attached form." And that "This information is used to verify your relationship to the data and will not be shared with any third-party or published in any way." The form calls for the requestor to provide Last Name, First Name, Middle Initial, phone, alt. phone, email, web address of private information, portion of page to remove, reason for removal (all of which were provided in a response email sent Wed, Feb 18, 2015 at 3:11 PM mentioned below) and an additional proof of identification. *** ******** did not agree to provide additional *** data to Mocavo and replied such less than an hour later, as mentioned above. *** ******** made clear that he would take action against Mocavo within 24 hours, specifically contacting the BBB and the ******** ******* and his own lawyer, as he viewed the action of Mocavo to be criminal and saw no need to cooperate in providing additional information for the removal of his own information from their site. I was charged $3 on January 2nd and as of today I have a $9 charge pending. I requested a free trial, to check it out, and I asked them to cancel it before the trial was over they did not. I am very suspicious of this company and beginning to believe it is a scam.

It is affecting my professional career, income, and life that they are putting a yearbook photo from several years ago from a college I transferred out of and DID NOT graduate from. This company needs some sort of option for people to remove information they do not want public. Right now, there is no way to remove anything from the website especially an entire yearbook if you do not want it posted for the entire world to see. There should be some sort of law or consequences for posting private information online like that especially for professionals like myself. For that reason, I am filing a complaint with the Better Business Bureau. If anything, they can remove my information and receive a bad BBB score so that people know what kind of company they are. They are not a professional company if consumers do not have the option to remove their personal information or photos. Thank you.

Complaint: Every 2 or 3 months I go on-line and check to make sure that no one is using my deceased husband's personal information. On 11-3-2014 I put his name in the Google.com search engine and saw that Mocavo had some type of information on him. When I opened it to check it, I discovered that they had put his social security number on there for all the world to see. His social security number is NOT public information. I immediately contacted the via email and requested that it be removed with 24 hours or I would be contacting an attorney. When I checked the sight 11-4-2014 I checked it and the information was still there. I got their contact information on-line and I called them at 9:38am on 11-4-2014. I spoke with a person who told me her name was ******** I told her who I was and that I wanted my deceased husband's information removed from their site immediately. She told me that I would have to submit the request via email. I informed her that I had already done the twice and I wanted it removed right then. She told me she could not do that. I the proceeded to tell her that I wanted to speak with a supervisor that could take care of it and explain to me where they got my deceased husband's social security number from and was told she could not transfer the call. I again asked her to transfer the call and she refused and disconnected the call. At that time I contacted my local district attorney's office to see what I needed to do. They in turn directed me to the Attorney General's office here in Tulsa who directed me to the FBI, the BBB and the FTC. I have filed a complaint with the FBI and am in the process of making a report to the FTC as well.

Complaint: I was billed for Mocavo's services BEFORE the seven-day free trial was up and now must wait 3-5 days before the money is put back on my credit card. I signed up on Mocavo's website for a free, seven-day trial period, at around 2:10 a.m.,EDT, on July 20, 2014, AFTER which`period I agreed to pay $4 for a 30-day period of its "gold" level, UNLESS I decided to cancel before the seven-day trial was up, which, under Colorado law, would have been at MIDNIGHT, on July 27, 2014. On July 27, 2014, at 2:40 a.m., EDT, I received a cryptic email from Mocavo that did not state one word that I had now been charged the $4 subscription fee for the next 30 days, but, rather thanking me for "enrolling in Mocavo Gold" and providing some coupons. But, on July 27, 2014, at 2:14 a.m., EDT - some 22 hours before the end of my trial period - Mocavo automatically processed a credit card transaction for $4, which was unauthorized under its own terms, its advertising, and unlawful under Colorado and federal law. I was not, however, able to discover this charge until after 8:00 a.m., EDT, on July 27, 2014, as my credit card issuer was upgrading its system. Subsequent to my growing perception of this unauthorized and illegal transaction, I sent an email to *******@mocavo.com to cancel my subscription to Mocavo's services, on July 27, 2014, at 3:25 a.m., EDT, and advised the company that my cancellation was effective at 12:00 a.m., on July 27, 2014 and "before incurring a $4 charge." The only means of cancelling is by having to send an email, rather than simply doing so on its website. On July 27, 2014, at 1:27 a.m., MDT (3:27 EDT), Mocavo sent me an automatic response to my cancellation, indicating that it would respond within 24 hours, unless my email to it was on a weekend day. In such case, it would get back to me on Monday. On July 27, 2014, at 3:48 a.m., EDT, I sent an email explicitly stating "WEEKEND OR NO, DO NOT CHARGE MY ACCOUNT FOR THE POST-TRIAL AUTO RENEWAL, BECAUSE..."OOPS...WE DIDN'T SEE THIS 'TIL MONDAY"!" On July 27, 2014, at 8:05 a.m., EDT, I discovered that a $4 charge had been made against my credit card, without my express or implied consent. On July 27, at 8:14 a.m., EDT, I sent another email to *******@mocavo.com, indicating my displeasure that the charge against my credit card had been made, before the trial period was over and contrary to Colorado law, C.R.C.P. 6, which stipulates how days are counted, which is the same anywhere in the United States. On July 28, 2014, at 11:09 a.m., MDT, *****, Mocavo's customer support representative, sent me an email, apologizing for it lack of support during the weekend, but that it charges its customers anyway. To correct its automatic unauthorized and illegal charges made because it does not thin it matters if the charge is unauthorized or illegal, it issues a refund, which is hardly the point, for Mocavo stole my money from me, because I, apparently, just need to understand and accept that I must adhere to its business model and policies in order to conduct business as a customer of it. But, not only am I without my $4, and am without it since 2:14 a.m., July 27, 2014, but I must wait 3-5 additional days for my credit card issuer to process a refund of an unauthorized and illegal charge. On July 28, 2014, at 1:55 p.m., EDT, I sent ***** a rather terse email demanding a recognition of its stumble-footedness; a written apology from ***** ****, Mocavo's founder and CEO; and an unspecified, but substantial, act of good will, leaving it for them to develop and implement what that should look like, assuming that the staff at Mocavo still had some imagination to maintain its value as a corporate brand. On July 28, at 12:24 p.m., MDT, ***** sent me an email, demonstrating that his company was devoid of ANY imagination, stating: "I escalated your request to our executive team and after reviewing it they do not believe any further action is required and consider the matter to be closed. Thank you trying Mocavo and have a great day." The matter is certainly not closed, rescinding as I have, its Terms of Service, and here we are.

Desired Settlement: I want Mocavo to cease and desist from certain of its business practices, to include miscalculating the time of its seven-day free trial offer; not having the means to field cancellations when the seventh day falls on a Saturday or Sunday; and charging a customer for its lack of being able to field such cancellations; and having the ONLY means of canceling an account by sending an email, rather than being able to perform that task directly on its website. I am prepared to pursue this matter in federal court, if necessary, and, should it come to that, I will seek a class, where and if appropriate. I have filed a complaint with the Federal Trade Commission and will, if this effort here fails to provide satisfaction, I will pursue the matter with the State of Colorado and its 20th Judicial District, Office of the District Attorney. Finally, I still seek an act of good will on the part of Mocavo, which, by now, can likely only be resolved by a financial remuneration for my exceedingly unnecessary and now protracted difficulties as a wronged consumer. I won't offer what that should be, but, perhaps Mocavo will not so easily dismiss the Better Business Bureau and make a reasonable, if token, offer, demonstrating its good will.

Left disingenuously unaddressed by Mocavo Chief Operating Officer **** ********* unavailing response is what lies at the heart of the matter: charging my credit card before it was lawfully permissible to do so and without my express authorization to do so before my free SEVEN-day trial (NOT an 168-hour trial period) was up; being deprived of my money for NO lawful reason; having to labor under the company's purposely indirect customer service model, because it solely suits the company's interest in doing so; and then having to wait some 48 hours before MY money was returned to me. While I recognize the last point, in itself, was beyond the company's direct control, it should not have become an issue at all, had the company not prematurely and unlawfully charged my credit card before it was legally permissible to do so. As a matter of Colorado law - as is the case in most of the United States - in calculating a seven-day period, the "Rule of Seven" applies, unless the time period is expressly specified in hours. And, under the "Rule of Seven", one excludes the day of the event that triggers the time period and continues each successive DAY, until the END of the seventh day. Unless the time period is stated in hours, a day ends at midnight, and not a second before. Accordingly, there can be no resolution of this matter until each of the sticking points - beginning with the triggering event - is fully addressed and done so in absolute good faith, rather than elided and swept away in corporate bromides. Such a lack of imagination in this matter by the entire Mocavo culture is mind-boggling, if not reprehensible. This is absolutely no different from a scenario were I to reach into Mr. ********* pocket and remove ANY sum of money, without his permission to do so; returning it ONLY upon being caught; making him wait to get it back; and then acting as if nothing untoward had happened - all hoping to be made "right" by merely returning the money and seeking to have the entire episode justified by the magic of simply saying it were so. Were I to conduct my affairs in such a fashion, I could be subject to being criminally prosecuted under the laws of the State of Colorado for theft, and likely would be. How the company's action in this matter is ANY different escapes me. Now, I am not seeking a criminal prosecution, here, but merely point out what would occur were I to act with such reckless indifference, abandon, and negligence. I could not double-speak my way out of the situation. To further compound the matter, the company claims that this is okie-dokie because it cannot - or rather, will not - sustain customer service staffing over the weekend and somehow seeks to makes it all the better by an adjustment when it can get around to it and at its sole convenience. Finally, in the ultimate of hubris, it hides behind an untenable Terms of Service that seeks to make its disingenuosness acceptable policy and the law, in a manner of speaking, if a customer is somehow "dissatisfied" about its unlawful practices, stating, with an apparent straight face that a customer's SOLE remedy is to simply stop using its service and that its liability is entirely limited to a refund of monies so removed. It then states, matter of factly, that the company has no further duty of care and that the case is closed. Mocavo, through its COO, **** ******* continues to sidestep the chief issue in this case - the unauthorized and unlawful taking of a premature payment, as if that somehow does not matter, because, golly gee, the money has been refunded - and then deciding for himself that there exists no other matter to be discussed and that the case is closed, simply because the money has been refunded. Such avoidance of the material facts of this case can only mean that my money was, in fact, intentionally withdrawn and done so in a premature fashion, contrary to law - both under Colorado and federal codes - for which Mocavo simply hopes, that by saying nothing beyond my money has been refunded and "we...consider this matter to be closed", will obscure the naked facts of the matter, for which it would now be, understandably, difficult for it to raise a defense. Except, I have already generously allowed for a way out of Mocavo's predicament, which will not be later available were this matter to be taken up in another forum. But, if it persists in playing games, here, then I will have no other choice.

Complaint: This company has published extremely personal information about me on the public Internet without my permission or consent. The information published by Mocavo causes me difficulty in finding employment and in my social life, in addition, it puts me at risk of identity theft and other fraudulent activities. I filled out the form that Mocavo provides to request removal of the offending page. I was put in touch with a customer service representative. After some time, the page was removed. But then, an identical page appeared, differing from the first only by the addition of a question mark at the end of its path. When I complained about this, the support representative claimed he could not reproduce. This is a lie. This page is accessible from numerous devices, by my friends and family, everyone has reproduced this issue and the page is readily accessible from either Google or just by typing the path into the browser.

Desired Settlement: I want this page removed and all personal information about me removed from the site.

What's more, this information isn't even accurate or current; it stems from years ago and is actually legally incorrect. Yet, it is now (erroneously) forever associated with me because ****** uploaded the information to its site without requesting my permission, notifying me, or asking me whether it was legitimate. ****** also deliberately makes it difficult to remove one's information. I searched the entire website and read its lengthy privacy policy and was not able to find one mention of a data-removal process for aggrieved persons. Most of us are familiar with the irritating companies that sell our personal data without our permission. Well, here's another one, just with a slightly different business model. ******, you need to remove my information immediately. And to anyone researching this company: be warned!

Complaint: Privacy violations; refusal to comply with request Mocavo is publishing my private information; age, mother's maiden name, etc. online. I did not authorize this and they will only take it down if I provide them with additional personal identification, which I do not trust them to use in a legal manner, particularly after they are violating my privacy in this blatant manner. This data can be used to discriminate against me with employment, and is can aid criminals in opening false accounts in my name. This practice should be completely illegal.

Desired Settlement: Remove my personal data without any further questions. I will seek an attorney if this is not complied with. BBB, you have got to protect people from unsavory business practices such as this.

Simply via a google search of my name Mocavo offers detailed personal information that can be used for fraudulent purposes and identity theft, which has recently happened to me. I have emailed the company to immediately remove this information and to divulge how they came by it.

Desired Settlement: I am requesting that Macova remove ALL of my personal information from their website/search engines and divulge the sources of the information.

In order for me to remove my information, they require me to send them proof of identity. So, they are asking for me to supply them with more personal information. Again, they are posting my DOB and mothers maiden name along with my full name and place of birth, all items that are used by credit companies to establish identity. I have already been the victim of identity fraud, likely due to sites like these. I request that they remove the information without requiring me to give them yet more of my sensitive information which they can then enter into their database and if I provide them with this information they can then claim I authorize them to use it as they see fit (see their privacy policy). They did not require me to furbish them with proof of identity to post my information, so they should not require it of me when I request them to remove it. Making onerous and possibly illegal demands to carry out a simple request does not "resolve" the complaint. As I stated earlier, I have requested the removal of my personal information which is now made freely on the internet by Mocavo without any authorization from myself. They claim they need yet more personal information from me to remove it to "prevent abuse". What abuse are they preventing? The only abuse so far being discussed is their use of my personal information for their profit without any authorization from me. Requesting more personal information is at best, offensive, at worst a larger scam. I am stating emphatically that the only abuse I am seeing by this business is that they are posting my sensitive personal information for free viewing without any authorization from myself despite repeated requests for its removal. Again, I have also stated that I have been the victim of identity fraud for credit cards, which could easily have been due to the copious information that this company provides anyone that can google my last name for free. Why will they not simply remove my information without demanding yet more of my personal information for their databases?

I believe it is entirely inappropriate to have personal information listed so simply online where identity thieves and other perverts of society can obtain it easily. I have no other personal information listed for this reason and now this site is putting it out there for the taking, if someone decides to pay for the service then fine but to have my information for free for the world is against my civil right to have more than anything I post listed online. I just want the information removed entirely and I will not pester the company any further.
