Complaint Category: Failure to honor a contract or agreement

Complaint: I was approved a FHA loan on 1/4/2013 but one week before closing they *suspended* my loan on 1/15/2013, which is breach of contract.
breach of contract after approving it. The reason given was the residence was too far from my work, 70 miles.

NTFN closed this home purchase as a second home on 1/18/2013. Her loan was conditionally approved 1/4/2013; after initial approval the underwriter needed more clarification on the 70 mile commute one way from work to home and the fact that she was keeping her keeping her current home. The loan was suspended on 1/14 and once clarification was received, the loan was changed from FHA primary residence, to Conventional financing for a second home and reapproved on 1/16/2013. A loan approval by a mortgage company is not a legal contract therefore no breach of contract can apply. NTFN closed Ms. ******'s loan in 18 days from receipt which is exceptional in todays mortgage environment.

Nowhere was it ever stated that it was a conditional approval. It was approved. The loan was intended to be for my primary residence. I am staying at the other house part of the time preparing it to be sold.

Complaint Resolution: Company agreed to informal dispute settlement hearing (IDS) in accordance with their BBB agreement, but the consumer declined.
