Zeus was contracted to perform bathroom remodel. They were paid in full. The work not completed & substandard such that it will not pass ************** elderly parent (80+ yrs. old) contracted Zeus to perform a guest bathroom remodel at her home in late 2012. The house is located at 5745 Misted Breeze, Plano, TX XXXXX. Total cost for the job was approximately $5000, $4000 for work by Zeus + $1000 materials.
In late 2013 it was discovered that water was backing up into the back wall due to Zeus improperly installing the new tub. Their tub install was causing water pooling, damage to grout & back wall, & mold issues. A building inspector stated that the improper installation would not pass ********** & that a new home buyer would require the deficiency to be corrected before purchasing the home.
After several calls in early 2014, Zeus finally came out to repair their tub/tile installation. Initially Zeus excused the problems as being caused by foundation until it was obvious that there are no foundation issues with this house or with the bathroom. Zeus patched the tile work & adjusted the tub flashing. However, there problems remain with the tub back-splash, specifically large cracks/separation between the tile & tub having resurfaced. We have offered to buy a new steel or iron tub & replace the plastic tub that Zeus has strubbled with installing.
Additionally, we have discovered the bathroom wall texture bubbling & peeling from the wall. The contract with Zeus clearly states that they remove the wallpaper before texturing. Zeus instead shortcutted the job & textured over the existing wallpaper rather than removing it. The wallpaper now needs to be removed & the walls properly retextured.
Over the past few weeks, Zeus has 3 times scheduled specific times that they would come to the house to review the problems. I took off from work to meet them at the house at the agreed times. Every time they have failed to show up. They will not return our calls.
Unless resolved thru BBB or *****'s List, I have no choice but to resolve this thru legal means & thru filing a fraud complaint against Zeus thru the Texas Attorney General's office on behalf of my mom.
We request that Zeus reinstall a new tub, steel or iron, to replace the plastic tub that they have been unable to properly install. We will pay for the cost of new tub.
We also request that Zeus remove the wallpaper from the walls & retexture the walls as was agreed to in the contract.
Other option is for us to hire another contractor to correct the deficiencies in the work performed by Zeus & for Zeus to reimburse that contractor.
I. The contract for 5745 Misted Breeze has an initial date of 26 Nov 2012 and closing date of 04 Dec 2012. The job total was $3,975. The customer supplied the tub and faucet.
II. ZEUS, as stated on contract, warranties installation for one 1 full year. Mr. ***** did not contact us ZEUS 'til summer of 2014. That said, the warranty expired by the time ZEUS was informed.
III. Given the fact that ZEUS is a family owned and orientated, it understands and values family values. Because of these same principles ZEUS still went out, twice once in late summer and again in late autumn., to resolve the matter, and did not take into account that the warranty had expired nor charged Mrs. ***** or her son a single cent. The second time around, ZUES secured the tub provided by the homeowner by screwing it into place. That said, we cannot fathom how a tub screwed into place shifted other than excessive force or shifting. As well, never once were we informed of the texture problem during these visits.
IV. As to the air bubble on the wall, many factors can give rise to it: excessive moisture can cause it to bubble. If someone takes a steam showers over 30 minutes, twice a day over an extended period of time, can contribute to it. Now, had the job been poorly executed, bubbling would have occurred shortly after application and not two years after.
V. As for the petition by Mr. ***** for the installation of a new cast iron tub, ZEUS Floors will do at a discounted rate cost price granted:
a. Expired warranty.
b. ZEUS has previously assisted Mr. ***** twice.
(The consumer indicated he/she DID NOT accept the response from the business.)
Zeus was hired to remove wallpaper & retexture the walls, as clearly stated & agreed to in the contract. Zeus did not remove the wallpaper & the wallpaper has therefore continued to separate from the sheetrock under the texture.
Tub was not installed properly & water leaks back into the wall. House will not pass ********** due to the poor workmanship by Zeus Floors.
Inspectors will certify the work by Zeus was not performed per the contract & that elderly parent was scammed by Zeus. Unfortunately she trusted Zeus to properly perform the work & did not monitor the job. This is not a 1 yr. warranty claim but a fraud claim against Zeus for failure to perform work that they were paid to perform.
We have contacted the State Attorney General to request criminal fraud charges against Zeus & have contacted our attorney to sue for damages, legal costs, & remedies against Zeus. The facts of this complaint & the law support our claim. We will pursue this thru legal means & consumer protection agencies until resolved.
