Complaint: my husband and myself ordered rainhandler gutters after seeing the advertisement in handyman magazine. these gutters came with a 25 year warranty. after they were installed, the first winter we had many icicles forming that we were told would not happen. my husband tried calling and when he finally got through we were told that the distributor was no longer in business. they offered to sen replacement pieces and we could put them up ourselves. my husband was then diagnosed with pulmonary fibrosis and was put on oxygen. he would be unable to put them up himself which meant we had to hire someone to do it. after paying twice as much for these as conventional gutters, we didn't hire anyone. from that time on he was in and out of the hospital which i can document the number of times. he passed away march 30,2013. this was a terrible winter and i have pictures of the ice and the damage these gutters have caused. i feel that they should have told us they would not hold up in very cold frigid weather. i called the main company again, and again was told they would send replacement pieces and that i could hang them myself since it is "very easy". all i want is to get either a refund or at least they pay for me to get regular conventional gutters. i do not want these gutters on my house ever again. they have done enough damage. i have a $1000.00 deductible, so my insurance is of no help. i don't know where else to turn. i need some help to have this company understand that i feel as if it was false advertising for us. any help i can get is appreciated. annmarie dambrosio
Desired Settlement: i would be happy if i can get regular conventional gutters. if that is not possible i would like a refund so that i can get them myself. if the gutters held up in new england winters,i would love them. but all they have done is cause me misery. i have been trying to find the paperwork for the gutters. my husband had them when he tried to handle this problem in the beginning. so much has happened to him and i cannot find where he has them. this main co says that we did not order them from them.
Business Response: The complainant is not our customer. She purchased the Rainhandlers from a third party. We guarantee and Warrant our product to the original purchaser. Our 25 year Warranty is against manufacturing defects. In 23 years we have had one claim for a manufacturing defect. Our guarantee is a one year money back satisfaction guarantee to the origianal purchaser. To our knowledge, this is the most generous guarantee in this market. We believe the customer has had the Rainhandler System for 5 years or more, way beyond what we would have guaranteed, had she purchased them from us. Because winter damage is so rare, our Warranty also covers furnishing replacement Rainhandler sections for any winter damage. Her complaint is about winter damage and as she notes, we have offered to furnish free of charge replacement sections for any that were damaged. Thousands of gutters were also damaged this winter and we know of no free replacement offers. We hope she accepts our offer. We have over 100 satisfied users in her city.
BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
