Dealer should provide information on the Motor Vehicle Warranty Rights Act which covers most new vehicles purchased, leased or registered in Georgia. The Act covers defects reported within the 1st year or 12,000 miles.
Generally, vehicle is presumed a lemon if within the earlier of the next 24 months or 24, 000 miles from the time of the first repair attempt, the same substantial defect was not repaired within three attempts or was out-of-service 30 days for cumulative problems such as suspension, transmission, electrical, etc. (at least 15 days of which occurred during earlier of 1st year or 12,000 miles.
If defect is safety-related involving brakes or steering, only one unsuccessful attempt is required (or two attempts for other safety-related defects such as stalling).
Notify mgr. by certified mail for final repair opportunity. If repair unsuccessful, notify mgr. of request for refund or vehicle replacement (arbitraton may be necessary).
Get a detailed work order each time the vehicle is brought in for repairs including the repair date, odometer reading and general description of problem or what was done to fix it. (dealer is required to indicate any repairs, examination or diagnosis on the work order). Work order should be legible, consistently describes problem with each visit. Get a copy of the work order even if the dealer said problem is normal or could not be duplicated.
