Complaint
Complainant attempted to purchase home from ECH.
I attempted to purchase home for ECH. ECH required me to pay earnest money in the amount of 6000.00. to ECH directly. When I could not attain financing, the earnest money was kept by ECH. They stated that since I had moved into the home (separate lease agreement and rental payments with deposits were signed) they were going to keep all of my earnest money. The contract was initially signed June 16th of 2011. I completed my move from the property on February 5th of 2012. During my cleaning of the home on that date, I was told that I would not receive my deposit or earnest money (1600.00 rental deposit and 6000.00 earnest money). On January 26, 2015, this contract was found and reviewed and I was told to file a complaint with the BBB.

Desired Settlement
I am seeking the refund of my earnest money (6000.00) and security deposit (1600.00.

Business Response
The ********* entered into a contract on June 16, 2011 for the purchase of an Executive Construction home. The contract offered by the ********* and accepted by Executive Construction was not contingent on financing. In fact, the finance section was marked-out completely by the ********* and initialed. The ********* paid $6,000 as earnest money. The ********* were given 6 months to attempt to close on the property but failed to do so. The ********* defaulted on the contract for failing to close within the contract timeframe. Therefore, the earnest money was forfeited as provided for under the terms of the contract. Paragraph 22 of the contract stated that "if the Purchaser shall default under this Contract the Seller shall have the option of suing for damages or rescinding this Contract for Sale. In the event the Contract of Sale is rescinded, the deposit money shall be retained by the Seller." Executive Construction followed the terms of the contract as the ********* defaulted.

As to the security deposit, to accommodate the ********** Executive Construction allowed the ********* early occupancy. No security deposit was paid. The ******** paid a monthly rent. When the ********* vacated the property, Executive Construction spent its own funds to get the house in condition to be placed back on the market and could no longer offer the house as new construction since the ********* occupied the house for 6 months. No security deposit was returned to the ******** since they never paid a security deposit.
