This organization’s website indicates that "NOPEC is a non-profit, pro-consumer lobbying force dedicated to bringing lower utility costs to families and businesses in northeast Ohio." According to additional information provided by the organization, NOPEC was formed in response to deregulation of public utility service. They explain that, “People are automatically enrolled because a majority of people within that community voted in favor of a program to do so. If an individual at any point desires to leave our program they can, of course, choose to do so."
NOPEC sends out mailings to inform participants of their right to opt out. Opt-out notices are sent to every eligible natural gas consumer every two years. Under Ohio law, electricity customers may receive an opt-out notice every three years. According to NOPEC's most recent mailing to consumers, "If you leave the NOPEC program after the opt-out period and rescission period you could be subject to a $25 cancellation fee..."
NOPEC is an example of a governmental aggregate, where a buying group is formed in conjunction with the local government. Citizens of the city, township, or county vote for formation of the aggregate. There are two types of governmental aggregates: opt-in aggregation and opt-out aggregation. NOPEC is an opt-out aggregation, where participants are notified that they will be enrolled into the program unless they opt out by a certain date.
