Complaint: Berman's moved us from Kirtland to Springboro, Ohio on Nov 16. They packed our belongings on Nov 13 and 14, delivering on the 16th.On Nov 14, they moved items to the truck at the end of a 150 ft, curved driveway, and left them unattended to come into the house for a pizza they ordered.Later that day, we discovered a laptop computer we had intended to take with us was missing. When it didn't show up on the 16, along w a couple bankers boxes of financial records, we realized they had either stolen or lost the items, very possibly by leaving them unprotected while they ate.Despite the fact we purchased full replacement insurance through them, they denied the claim, with one or more of the movers charging that the laptop had gone missing before they arrived. That is not correct, and contrary to the police report we filed and statements provided to the insurance company. They also took much longer than the 30 days after our claim was filed to respond (over 60--Ohio requires 30 days after the claim).To the best of my knowledge, they did not deny leaving the van open and our property unattended while they ate pizza indoors, out of sight of the van.They have basically been unhelpful throughout, and given one or more of their movers provided an inaccurate statement to the insurance company is most disturbing.

Desired Settlement: Our preference is to have the insurance claim allowed.At the least, we should be refunded the cost of the insurance. The adjuster stated by phone that we had to prove beyond all reasonable doubt Berman's culpability to allow the claim.That's an impossible standard short of video evidence or their confessing to negligence. As no one told us at the time we purchased the insurance we'd have to prove "beyond a reasonable doubt," the insurance was sold under false pretenses.

Dear Ms. ******:

On November 23, 2012, Mr. ********** advised this office of a missing laptop computer. On December 4, 2012, we turned over his claim to our insurance company for professional settlement. Our insurance company did a thorough investigation, interviewing Mr. ********* and personally interviewing all movers that were involved with Mr. *********’s claim. The copy of the Certified letter to Mr. ********** denyingthe claim and indicating the Ohio Department of Insurance's address for follow up is included.

Additionally, I was contacted by Mr. *** ***** of the Public Utilities Commission of Ohio in February, 2013 indicating Mr. ********** had filed a claim, case ID: ************. As you may know, movers are regulated by the PUCO in Ohio. All information was forwarded to Mr. ***** and again, Mr. **********‘s claim was reviewed and denied.

I am sorry for Mr. **********’s loss, but believe strongly, that after thorough reviews by both parties indicated above, Berman Moving & Storage has no liability.
