Complaint: When the owner of Shaker Landscaping, Joe Gyurgyik, called me to let me know that my $965 check for lawn mowing services was not made out for the correct amount, I asked him to return my check. He told me that he would not return the check but would, instead, shred it. I then found a new company to mow my lawn and have signed up for services with them. Later, I discovered that Mr. Gyurgyik chose to cash my check. No services have been rendered by him and not any portion of my $965 payment has been returned, despite his promise to do so. (Mr. Gyurgyik told me that he knew he was doing the wrong thing when he cashed my check but did so anyways in light of his financial troubles.)
Desired Settlement: I'd like Mr. Gyurgyik to return my $965.Mr. Gyurgyik's new email address is: firstname.lastname@example.org
******* ******, upon her request, was given an estimate(with option A or option B)
for mowing her property at **** ** ***********<st1:place w:st="on">. She checked A and sent in a partial
payment by check for $964.91 on a balance of $1072.12, along with a signed and dated
proposal (copy enclosed). Shaker Landscaping hired additional help and bought extra
equipment to service her property. ****** then notified us that she had found a com-
pany that would do the work for a cheaper price and demanded that we return her
check. We informed her that we do not offer refunds once a customer has signed a
proposal and sent us a check.
If clients could just change their mind and cancel whenever they feel like it or whenever
they get a cheaper price, it would throw our business into complete chaos and most
likely bankrupt our company in a short time. We have been in business for 40 years,
have an A+ rating with the Cleveland BBB and have learned from experience in our
early years to watch out for customers who are "fishing" for the lowest price and have
established pricing refund guidelines that address these issues and apply to all prospec-
tive clients(brochure copy enclosed).
We do not offer refunds—-only credits to the client's account. This credit can be used
towards any service that we offer during the calendar year. This information was pre-
sented to *** ******* who declined the credit. A refund(copy enclosed) of $100 was
sent to ****** and her account was credited for the balance of $864.91. No work was
done at her property but the estimate/proposal cost our company salary time, gas & in-
surance expense, office expense(writing up proposal and placing her on the mowing
schedule) and extra cost in hiring additional labor and buying additional equipment(which sits idle at this time).
BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
