According to information provided the Bureau, on January 8, 2002, Richard A. Devine, State's Attorney of Cook County filed a complaint for injunctive and other relief against Mr. Siding & Windows and Paul Dryndrozyk, individually and as agent of Mr. Siding & Windows for violations of the Illinois Home Repair and Remodeling Act and the Illinois Consumer Fraud and Deceptive Business Practices Act.
PRAYER FOR RELIEF
WHEREFORE, the People of the State of Illinois pray this Court to enter an order against Defendants that:
A. Finds Defendants engaged in deceptive practices in the course of trade or commerce in Cook County, Illinois in violation of Sections 2, 2B, 2Q, and 2Z of the Consumer Fraud Act;
B. Permanently enjoins Defendants from engaging in acts and practices which violate the Consumer Fraud Act;
C. Permanently enjoins Defendants from engaging in the business of home repair and remodeling in Illinois.
D. Declares any contract provision that required consumers to pay 25% of the contract price as liquidated damages upon exercise of their statutory right to cancel within three business days to be null and void;
E. Requires Defendants to pay restitution to all members of the public damaged by their violations of the Consumer Fraud Act;
F. Requires Defendants to pay a civil penalty in the amount of $50,000 for each violation of the Consumer Fraud Act and an additional penalty of $50,000 for each violation found to have been committed with intent to defraud;
G. Requires Defendants to pay all costs for the prosecution and investigation of this action, as provided for under Section 10 of the Consumer Fraud Act;
H. Provide such other and further relief the Court deems necessary and just.
