HeatCool gave a quote of $200 per window air conditioning unit for cleaning and servicing. When returning the units, the bill was presented at $310 per unit. Needing the units to be reinstalled, I had no choice but to sign the invoice as presented.

After they reinstalled the units, I discovered one of the units was not cleaned since we had to clean the filter. A second unit which I would have replaced for $300, was spewing black liquid after being reinstalled.

On a subsequent date, when *** ****** was at the ************* location to complete a repair on a separate unit (on which they had installed an incorrect part multiple times beginning prior to them taking the units for servicing), I explained the situation to him and he responded 'do what you need to do.' I took this as an agreement on his part. He subsequently has billed me for an additional $640.

I thought of accepting Mr. ******'s offer just to be done with it. However, after consideration, I do not think it is acceptable. This is even more true for a business with an A+ rating from the BBB. Mr. ******'s approach has been belligerent and threatening. There is no question that one of the window A/C units was returned not cleaned. I have a witness, who is neither an employee nor a client, and is the person that cleaned the unit after it was returned by HeatCool not cleaned. Mr. ******'s 'witnesses' can only be employees who have an obvious self-interest in siding with Mr. ******.
If Mr. ****** had made this offer initially, which would have been reasonable - i.e. offer to not charge me for the unit he did not clean, I would have accepted.
Unfortunately, he chose a different approach.
I stand by the fact that when I requested their help, it was not a request to clean the units, it was a request to improve the A/C for the business. This is demonstrated by the fact that I installed an additional unit, for which I had asked him for a quote which he never provided. Mr. ******'s firm is responsible for saying that the functioning of the existing A/C units would be improved by cleaning the units, including the unit that he must admit should have been replaced instead of cleaned for $320. This unit was returned spewing black liquid, and functioning worse than prior to the cleaning/servicing.
I should not have had to spend so much time and request the help of the BBB in order to get Mr. ****** to make or accept a reasonable resolution. Therefore, if Mr. ****** wishes to expedite a closure, he must make a more fair offer, taking into consideration:
One unit was not cleaned
Another unit should have been replaced
He has made me spend an inordinate amount of time to resolve this issue
His approach has been belligerent, threatening legal action against me, even though he is clearly in the wrong with regards to the unit that was not cleaned. And he continues his threats in his rebuttal.

I stand by my statements in my letter to BBB of September 3, 2013. I am ready to prove these statements with witnesses. To expedite a closure, I am willing to accept $320.00. Payment must be received in my office not later than October 29, 2013. There after the offer will be withdrawn and proceedings to collect $640.00 plus court costs plus attorney fees will be sought.
