Contracts

As with any business transaction, be sure to read all agreements, guarantees, and instructions before signing. Do not be pressured into signing an agreement before you are ready and you understand all terms and conditions. Make sure all oral promises are put in writing. Be wary of vaguely worded provisions, exclusions or limitations which could pose a problem later. Never sign a contract with sections left blank.

Credit Cards - Consumer Liability Re: Lost/Stolen

Under Federal law, if your credit card (or your automatic banking card) is used without your authorization and before you report it missing, you can be held liable for the actual amount or up to $50 per card. If you report the loss before the card is used, the card issuer cannot hold you responsible for any unauthorized charges. You are not responsible for any charges made after you notify the card issuer of the loss or theft of the card.

Be sure you know how to notify your credit card issuers in case you find your cards missing and be sure to follow your issuer's directions for reporting unauthorized charges. If you are considering using a credit card protection service, which for a fee promises to contact all you credit card companies for you in the case of loss or theft, be sure to read the contract carefully to check the compañía's obligations and any liability on your part should the compañía fail to notify card issuers.

Credit Cards - Offers by Third Parties

When evaluating a credit card solicitation, determine if it is from a bank which actually issues credit cards or if it is from a compañía claiming to guarantee that it can get you a credit card, regardless of your credit history. If the offer is not from a bank which issues credit cards, but rather from a "credit card processing or procurement firm", you need to carefully evaluate what is involved in the offer.

Many such third party credit card offers involve a fee just to get a credit card application. Once you receive the application, you may learn that you will need to deposit money in an out-of-state bank before getting your credit card. This money will serve as a credit limit or collateral for your account. A collateralized account can, in fact, be a way to prove responsibility in paying credit card bills, but you may be able to get such a card without paying a fee to a third party. Other companies may send a credit card which can be used only to make purchases from the compañía's own merchandise catalog, rather than the expected Visa or MasterCard.

Credit Cards - Use When Purchasing by Mail or Tele

If you use your bank issued credit cards when ordering merchandise by mail or telephone and find the products to be defective or to have been misrepresented by the seller, and if the seller itself will not issue a credit, you have the right to withhold payment for the merchandise until the dispute is resolved. According to federal law, payment can be withheld only if the purchase exceeded $50 and occurred in your home state or within 100 miles of your billing address.

(State laws vary as to the remedies for consumers when the merchandise is under $50 and if a telemarketing transaction is considered to be in your home state, where you received the call, or outside your state, where the call was initiated.)
