NATURE OF BUSINESS Senior Citizens Remodeling, Inc. also known as S.C.R.I. operates from its main office in Cicero, Illinois and a regional office in Indianapolis, Indiana. Telemarketing representatives of the firm contact senior citizens in Illinois, Wisconsin, Indiana and Kentucky offering home improvement work which will be paid for through a reverse mortgage on the home. Senior Citizens Remodeling, Inc. will determine what type of loan may be of benefit to a prospective customer and then refer the person to an appropriate lender. Some of the loans may be conventional. However, some consumers may only qualify for a "reverse mortgage" or "equity conversion mortgage." If a reverse mortgage is chosen the home improvement work performed by Senior Citizens Remodeling will be paid for by possibly reducing the equity in the home. To the extent the proceeds of a reverse mortgage are used to make home improvements, it may help retain the value of the home. Federal law provides some protection to homeowners using these reverse mortgages, which do not require a down payment or monthly payment, however the principle amount borrowed, plus interest will compound and accrue, and will accumulate for the life of the loan which will be payable when the home is sold.

Since our file opened on the company October 18, 1996 no complaints have been registered with the Bureau.
On January 28, 1998, Richard A. Devine the State's Attorney of Cook County filed a verified complaint for injunctive and other relief against Senior Citizen Remodeling, Inc. an Illinois Corporation for violations of the Consumer Fraud and Deceptive Business Practices Act. Venue for this actions lies in Cook County, Illinois, because this cause of action arises from Defendant's business activities in Cook County, Illinois. Defendant Senior Citizens Remodeling does not possess a City of Chicago Home Repair License or an Illinois Plumber's License pursuant to the Illinois Plumbing Profession Act.
Defendant Senior Citizens Remodeling, Inc. does not possess an Illinois Roofing License pursuant to the Illinois Roofing Professions Act.
On one or more occasions, agents and/or representatives of Defendant Senior Citizens Remodeling, Inc. have represented to such elderly homeowners that their repair services are either "no cost," "free" or "paid for by the government".
In actuality, the home repair work being offered by Defendant is not at "no cost," "free" or "paid for by the government," but rather, is to be paid for by consumers obtaining "reverse mortgage" payable from the equity in their homes.
On one or more occasions, consumers are not told of the true method of payment for the repair services until they allowed an employee, agent, and/or representative of the Senior Citizens Remodeling, Inc. to visit their home as a follow-up to the initial telephone solicitation.
The home repair contracts between the Defendant and the consumer are entered into at the respective consumer's residence.
Contrary to Illinois law, Defendant's home repair contracts do not include the required "Notice of Cancellation' statement in bold face type.
Similarly, Defendant's home repair contracts do not include the detachable "Notice of Cancellation" form which a consumer is required to return when exercising this right to cancel the transaction.
Preliminarily and permanently enjoining Defendant and its employees, agents, or representatives from committing any further violations of the Illinois Consumer Fraud Act .
Requiring Defendant to provide restitution to all members of the public damaged by the Defendant's violations of the Consumer Fraud Act.
Assessing a $50,000.00 civil penalty including court costs and attorney fees, against Defendant Senior Citizen's Remodeling, Inc. for its violations of the Illinois Consumer Fraud Act, 815 ILCS 505/1 er seq.
On April 1, 1999, an AGREED ORDER was entered against Senior Citizen's Remodeling, THIS CAUSE coming upon the Court upon the Plantiff's Petition for a Rule to Show Cause for Indirect Contempt of Court, counsel for the Plantiff being present, the Court having jurisdiction of the subject matter and parties; and being fully advised in the premises;
IT IS HERBY ORDERED: The Defendant Senior Citizens Remodeling, Inc, is in Indirect Contempt of Court for its failure to abide by the terms of this Court's February 18, 1998 order.
Defendant Senior Citizens Remodeling Inc, shall cease conducting all home repair/remodeling jobs in Cook County currently under contract or in progress as of March 17, 1999. Said cessation of work shall remain in effect until Defendant provides the Cook County State's Attorney's Office a copy of all required municipal license and/or permits required for each home repair/remodeling job. Defendant Senior Citizens Remodeling, Inc. is prohibited from entering any new home repair/remodeling contract with Illinois residents until such time as Defendant obtains contract forms containing a Notice of Cancellation provision that is in strict compliance with the requirements of the Consumer Fraud and Deceptive Practices Act also includes an easily detechable Notice of Cancellation as required.
Defendant Senior Citizens Remodeling, Inc. shall provide a list of all home repair/remodeling contacts currently in effect between the defendant and Cook County residents to the Cook County State's Attorney's Office by April 2, 1999, This list shall include a copy of each contract.
A fine fo $50,000 is entered against Defendant Senior Citizens Remodeling, Inc. for its Indirect Contempt of Court. The People of the State of Illinois will refrain from the collection of this fine so long as the defendant strictly abides by all provisions of this order. In the event the Plaintiff establishes any violations of this order, said fine shall be immediately due and payable through the Cook County State's Attorney's Office. The issue as to whether the Defendant Senior Citizen's Remodeling, Inc. through its officers, shall maintain sufficient assets to satisfy full payment of said fine will be left open pending a motion to be brought by the Plantiff.
Defendant Senior Citizen's Remodeling shall pay the Cook County State's Attorney's Office $1000.00 as attorney fees relating to the prepartion and filing of the People's Petition for Rule to Show Cause. Payment shall be made by April 2, 1999 by either cashier's check or money order payable to the Cook County State's Attorney's Office.
Nothing in this order shall be construed as releasing the Defendant Senior Citizen Remodeling, Inc. from any contractual obligation relating to any business operations, nor shall this order be construed in any manner as providing defendant any defense for any failure on its part to commence or complete all contracted for work, or as a bar to any other action, civil or criminal against the Defendant company, or any of its officers or employees.
This matter is continued for status to September 15, 1999 at 10:00 a.m. at which time the Court will determine whether the fine will be abated.
