Complaint: We contracted McVan Development in Aug 2013 with **** ******* to complete a new driveway with clean out, and also build a new deck. The project was riddled with quality problems, which include: 1. Driveway apron was installed incorectly. **** was not supposed to remove it, however, he did. We then asked that it be re-installed at the same slant it was when it was removed. This did not happen, risking garage flooding. 2. Removing a cement slab damaged the bottom of the garage siding causing a hole and requiring a wood board to be attached to the bottom of the garage to cover the hole. 3. **** agreed to build a new emergency exit from the basement, which ended up being a wood box above the basement steps with a lock on it, which has leaked water into our basement with almost every rain since 4. A clean out was installed under our driveway (as it was torn out) so that we could have plumbers clean out our pipes outside of the house to the sewer. As ****'s men were pouring the concrete running the machines over it, they ran over the clean out opening in the ground bumping it. My husband questioned them about it - and asked that they confirm the pipes were not disturned. They said they were fine and they finished pouring the cement. ****'s men had covered the clean out opening with cement causing us to get **** out here to remove the cement around the opening, so it could be opened, and then they repaired the cement around it (but not well). That was Oct 5. The clean out cover had been stripped in the meantime. Within a couple weeks we had a plumber out to clean out the pipes and learned they were broken and needed to be fixed. The plumber informed us the pipes were jarred and not connected under ground. After many, many phone calls **** finally came to check it out with his plumber, who confirmed indeed the pipes had been jarred after the plumber installed them. For 11 months we have chased **** to have it come with his plumber to fix it. Has has even made plans to fix it, the plumber was waiting for him, but then canceled with an elaborate story that his driver with the tools was picked up by the cops and the truck impounded. We have continued to call and wait for **** to fix the plumbing issue (with his plumber), but continues to give us the run around. This has been going on for a year now.
Desired Settlement: 1. Replace the clean out pipes that are jarred. 2. Re-concrete the driveway so it all matches after repairing the clean out pipes under the driveway, fix the apron in front of the garage, and correct the slants so water does not pool right at the bottom of our back deck steps... as water never used to pool in our back yard. 3. Fix the water leak into the basement. 4. Put in a proper emergency exit from the basement stairs. 5. replace the garage side damaged when the concrete slab was removed.
