I purchased this vehicle from Easy Auto and this company is the lender. They call me using fake numbers and cell phone numbers all times during the day.
I have fallen behind on my payments and am trying to get caught up and this company calls 3-4 times a day to my home and on my cell phone. They call using fake numbers and cell phone numbers and will not say where they are calling from. The just leave a message to call ***** or ******* at this number. Also, even though I have explained to them several times why I am late on payments, I have also asked them to send me a complete statement showing how much of my payment goes to principal and how much goes to interest. I was told that if I am late they take more of my payment and apply it to interest, which leaves my principal still high and extends the payments. As far as I have been informed on any type of loan, if there are additional fees charged, those are separate from the initial payment, but this company refuses to provide me that information and will not adhere to the contract that I originally signed. My payments were to be on the 15th and last day, they now are every other week and my contract should have ended in August 2013, but because of their payment practices of applying additional interest rather than saying the interest is in addition to your regular payment, they just extend the contract without telling you. I even told them before to come get the car because it is a piece of junk. I have had to put more than $4,000.00 in this vehicle since I purchased it and have to still put in a new transmission. I feel this vehicle was not in selling condition when I purchased it and have told them this. I even asked if they could refinance it, they said they do not refinance any vehicles, but I could do so with any company. I told them that no one will touch it because it is not worth close to even what I paid initially for it. I owe approximately $3,800 from what I can tell which is according to my records more than the initial repayment amount.
I would like an audit done on the account for the payments that have been made in regards to the initial payment of $500.00 due monthly. I feel that I have already paid this vehicle off and this company has just extended this contract on their own.
We appreciate the opportunity to respond to the above referenced matter. Customer satisfaction is very important to us. After receiving the complaint on September 13, 2013, we tried to call *** ******* two or three times a day since then to resolve this matter. We have left messages asking him to call us back, and he has not returned any of our calls.
*** ******* did finance a vehicle with us on July 6, 2010. The last time we were able to have a conversation with Mr. Gillian was August 12, 2013. He indicated he was having a mechanical problem with the vehicle, but he could not speak to us at that time. We told him we had programs available to help with repairs, and that we were open until 8:00pm. He said he would call us back later. He didn't call us back that afternoon and he hasn't returned any of our numerous phone messages since that time.
We have gone back and reviewed the account and the payment history. We did not find any errors. We do not have a record of where *** ******* had requested a copy of his account history, but after seeing the complaint, we mailed him an account history that day. Also, to clarify something *** ******* stated, we do not charge any late fees. On our Finance Agreements, we use simple interest as specified in the contract. If a customer is late on a payment, interest will accrue on the unpaid amount, and it will take longer to reduce the principle balance. Further, when a customer requests contract modifications, we explain verbally and also have them sign an acknowledgment that finance charges continue to accrue, and that modifications do extend the term of the original contract. *** ******* has signed all the modifications and acknowledgments with respect to his contract.
There are other statements in *** *******'s complaint that we don't think are accurate, but the main message we want to convey in this response is that we would be happy to discuss this account with *** ******* and answer any question he may have about it.
