Advertising Specialty Companie

When you receive an offer by phone or letter entitling you to
a valuable gift in exchange for the purchase of advertising
specialty items or simply for C.O.D. payment to cover shipping
and handling, insurance or taxes on a package, the BBB urges
extreme caution. Better Business Bureaus and the U.S. Postal
Inspection Service report that offers of this type frequently
contain serious misrepresentations regarding the true value of
the gifts and often understate the amount you will have to
spend. Some compnies offer an 800 telephone number to call for
information regarding prizes and in some cases by staying on
the line or by pressing other numbers or letters consumers are
billed for these calls. You may also wish to check with your
local U.S. Postal Service for information.

Effective December 31, 1995 the new Telemarketing Sales Rule
(TSR) states: It is illegal for a telemarketer to call you if
you have asked not to be called. Calling times are restricted
to the hours between 8am and 9pm. Telemarketers must tell you
it's a sales call, the name of the seller, and what they are
selling before they make their pitch. If it's a prize
promotion, they must tell you that no purchase or payment is
necessary to enter to win. It's illegal for telemarketers to
misrepresent any information; any facts about their goods or
services; earnings potential, probability, risk, or liquidity
of an investment; or the nature of a prize in a
prize-promotion scheme. Before you pay, telemarketers must
tell you the total cost of the goods and any restrictions on
getting or using them; or that a sale is final or
non-refundable. In a prize promotion, they must tell you the
odds of winning, that no purchase or payment is necessary to
win, and any restrictions or conditions of receiving the
prize. It's illegal for a telemarketer to withdraw money from
your checking account without your express, verifiable
permission. Telemarketers cannot lie to get you to pay, no
matter what method of payment you use. It's illegal to help
deceptive telemarketers if you know-or consciously avoid
knowing-that they are breaking the law.

Tennessee Code Annotated, Section 47-18-1526 was ammended to
add that telephone solicitors cannot make calls to persons
with unlisted telephone numbers, nor can the telephone
solicitors use telephone equipment that blocks the caller ID
function.
