Complaint Category: Sales presentation used dishonest sales practices

Complaint: Predatory fixed pricing policies results in unreasonable cost for minor repair.
On 3/21/2012, Comfort Systems replaced the start/run capacitors on the two condensing units behind my home. This is the first service done since we moved into this home. Comfort Systems previously services unit at old house.

During this service, concerns were seen with the start/run capacitor. The technician told my xxxxx it would be $146 to replace both capacitors. She authorized the service. Following this she was changed $246 and when challenged was told that he did in fact say $246 previously as this was their "book pricing."

The technician discovered the degraded capacitor during a routine service call, as stated above, which would require him to disconnect the capacitor to adequately perform this test. The replacement component costs $20. So the total material costs would be on the order of $40. Since the machine was already opened for the routine service and the capacitor disconnected, replacement would require minimum time, estimated approximately 20 minutes per machine.

As such, the labor charge applied is estimated to be $300, which is an unreasonable charge.

When attempting to call Comfort Systems on this issue, they stated there were many factors that feed into this fixed cost, including the time spent on the service and what others in the area charge. They could not explain how these charges mattered here, as the mobilization and troubleshooting was performed under a different service (the routine maintenance activity). Also, what other service providers charge is immaterial and if they do compare their prices smells of price fixing.

Further, the technician did not ask if the units were still underwarranty in order to file a claim. These units were still under warranty. Further, he would not provide the defective part so that we could file a claim. When challenged on this point, Comfort Systems responded that Goodman is difficult to deal with, that they would never respond to an individual consumer and that they dispose of capacitors due to concerns of residual charge.

These points are irrelevant because it does not matter if they find it difficult to deal with Goodman, they themselves did not take the opportunity and deprived us the opportunity of submitting a claim. Further, to adequately test the capacitor (which was the basis for the claim that it was degraded and needed replaced) they needed to fully discharge it.

Business' Initial Response
This customer is assuming what we pay for our parts. We have a flat rate price book that is the same for any customer that we go to. The only change in pricing is when a customer has a maintenance contract and they receive a discount. Our costs of doing business include many factors from office overhead, to training employees and also charges of filing warranty claims. The repair that we made was signed and authorized before we completed the work stated. Also it is our standard company policy not to give customers parts such as capacitors, as for they are dangerous on many different levels. In fairness to all of our customers we do not negotiate or adjust our pricing. We are willing to refund xxxxx any money on a pro rated level for the service he is due in the fall and would be happy to refer him to another dealer that works on Goodman equipment

Complaint Resolution: Company addressed the complaint issues. The consumer failed to acknowledge acceptance to BBB.
