Failure to provide proper maintenance resulting in the burn out of the blower motor of a 2 1/2 yr old a/c system
On July X XXXX our 2 1/2 yr old a/c system stopped working. We contacted another company to repair and discovered that the service cleaning contract we had with Comfort Doctor had not been properly serviced. The inside unit had never been cleaned since its install and the resulting clogged system resulted in burning out the $600.00 blower motor plus install fees and a proper cleaning. When I called Comfort doctor to see why for one why we had not been called to complete our twice annual cleaning I was told by **** there is no contracts we dont do that. (She has been employed for a year there according to owner. After continual back and forth they offered to refund half the contract for failed services. Considering I now have to submit a warranty claim and pay additional fees to cover something that should have never occurred on a 2 yr old a/c all because their service guy did not clean.

Desired Settlement
I am contacting the card company to have a full refund issued of my cleaning contract. Additional repairs because of this lack of service will be dealt though the court system for a full reimbursement. I have already spoken to ******* and and sent an email to my lawyer concerning this matter to take the appropriate steps. Our other service provider (17yrs or more in industry) said what a waste... They should have done their job right in the first place~

Business' Initial Response
Mr. ****** called our office back in July of 2012 to schedule a service call, as he had done several times before. He seemed to be satisfied with our service and our technicians. We scheduled an appointment with him on 7/26/2012 and provided the same services as we had done in the past. Mr. ****** was even satisfied enough to refer our company to a type of online yellow pages that targets a certain demographic in the charlotte area (I will not disclose the name of this advertising group in this response) It is similar to Angies list.

We encourage our customers to call and schedule their service appointments in the fall and spring just before they begin using their systems. We have not heard from Mr. ****** in almost a year when we called to advise us of his system failure and he felt that we were responsible for the damage. We tried to explain to Mr. ****** that we had always fulfilled all the aspects of the service agreements that he had purchased. Mr. ******* service agreement only covers a minor evap coil cleaning. He has a cased evap coil which is considered an inaccessible coil and would require a major evap coil cleaning which we charge an additional $159.00 for. When we were at Mr. ******* home in July of 2012 the technician did not think that the visible condition of the evap coil warranted a major cleaning. The Comfort Doctor feels more than certain that if Mr. ****** would have called us sooner for the 2nd part of his service agreement we would have noticed the condition of the evap coil and advised him that he needed a major cleaning and because of his service agreement he would have received a 15% off discount for that cleaning. Mr. ****** does have multiple pets in the home which could have caused an obstruction in the unit within a years time period between cleaning. We did offered Mr. ****** a refund on the unused portion of his service agreement but he was not satisfied with that offer.

We are truly sorry that Mr. ****** feels that we did not provided adequate service to his system now and we always try to provide 100% satisfaction to all our customers.

This is beyond ridiculous in his statements for one thing. Further more the amount of build up in our system was due to non-cleaning since installation by the service company and IT IS part of the service agreement. They also called us before every 6 mo to let us know when we were due just like every other company who services an a/c system who want money! The woman on the phone even told us we don't do service plans and I have bee here for over a year several times... and I said I have the plan in front of me and then had it out with the so called owner. He is beyond shady. My contractor who serviced my system a 17yr veteran in commercial and residential with full accreditation and licensensure a mile long said this was due to his inproper servicing plain and simple. In addition if he was such a top notch service tech that came this last time he would have noticed immediately that there was a missing sensor for water overflow not on our machine. He also acted like a total fool and was talking all kinds of wild stuff the whole time he was here and I told my partner I don't want him back here again... turns out it was the owner after all. Out contractor pegged it immediately. The only person who was good was the service man before. We never had a wonderful relation with comfort care we had it with the service man they let go because they could t afford to keep him on and they would not tell us where he went to or we would have followed. The fool that came to our house apparently from notes I have read was actually the owner and he presented himself as just a new hire, My bill has been received back from m install and it was recently paid. Additionally he wrote credit card on the statement and we assumed it was a credit card we gave him all along but it was a check. We will be getting that money back and more. Email has already been sent to our lawyer. I will make sure he is not doing business in this town. We paid for a service spelled out in our contract and it was not done. He has had multiple complaints on him before and he is clearly a ball faced liar. Especially for him to say we left compliments on social media sites NEVER! I filed complaints on everyone of them and have informed consumer affairs as well as an email sent to the city and state attorneys office for his business practices. Our neighbors are also on the watch if he shows up to call the police because we distrust him that much! BBB can do what they wish..... but we are suing him.

we are sorry he feels that we are responsible for the issues he had with his system. Our technicians are very competent and at the time when he was scheduled for a service, a minor evap coil cleaning was conducted and if in fact a major cleaning needed to be completed the technician would have informed him and given him the option to have the cleaning completed for an additional $159.00 charge because it is not included in the service agreement. In his professional opinion there was no need for a major cleaning and an additional charge at that time.

After a year's time frame had lapse, there are a number of different things that could have attributed to his system accumulating dirt and dust quickly and having pets is definitely one. Mr. ****** was suppose to contact us for his next service in which he did not.

We agree that we had a good rapport and business relationship with Mr. ****** and are saddened by the chain of events. We are willing to refund the $199.00 that Mr. ****** paid for the Service Agreement, but we will not take blame and ownership for his system failing
