We signed a contract March 28,2022 on an Epcon spec home at *** ****** **** Crossing in Lewis Center #109-********. The outside patio was not even completed yet, still isn't, we had no input on anything in or out. They required $10,000 to hold it with 7 days to cancel and get money back. We cancelled in writing on April 4 withing the 7 day cancellation period due to unacceptable financing. Notification given directly to J** ******* sales rep. We had planned to us the HECUM program and had a preapproval letter updated by HECUM every 3 months however we were not notified of any changes to their program or interest rates at any time until after the contract was signed. We had 3 zoom FHA/HECUM counseling sessions to explain current procedures and terms. After the 1st one we notified *** there may be a problem. Wed. they went thru rates which were higher than banks and required $50,000 additional upfront for fixed rate and were 2-3 percent higher than variable rates. It was just not acceptable to us with those rates. So we sent another text to *** advising him there was a financing problem and we were probably going to cancel. We cancelled our meeting with HECUM to sign papers on Friday. We were tied up with a medical problem in family Friday and Saturday. Final decision made Sunday and **** notified. We took signed notification to *** within the 7 day period allowed by Epcon to get deposit back if financing not obtained. We tried calling Epcon numerous times to get $10,000 returned but they never returned call. Finally reached sales manager ***********no last name. He stated they had done nothing wrong and would not return money. Understandable if we were building from scratch but this was a speck and not finished outside at all on patio unk when it would be. Keeping $10,000 of our money over a spec home for 7 days is just not acceptable we want our money back! If you need copy of contract we can send to you upon request.
