Complaint: Deceptive employment practices; company does not adhere to contract as executed. Adjunct employment contract terminated without cause; payment still due on contract for 2011 09 term.
Desired Settlement: Payment in full of remaining contract.
Business Response: We are in receipt of the complaint (****). We appreciate the opportunity to respond to the complaint and we apologize unreservedly for our delay in response. In order to bring swift resolution to the complaint, our response is included below. (****) was employed with Harrison College from April 11, 2011 to December 16, 2011. During that period, in addition to his primary duty as Registrar, he provided classroom instruction under an Adjunct Employment Agreement. The terms and conditions of employment under that adjunct agreement clearly indicate that employment is "at-will", meaning employment could be terminated by either party at any time during the term, with or without cause. In addition, the agreement clearly states in paragraph 3(b): Upon termination of this Agreement, payments under this paragraph shall cease; provided, however, that the Employee shall be entitled to payments for periods or partial periods that occurred prior to the date of termination and for which the Employee has not yet been paid. According to our records, Mr. (****) was paid in full for periods or partial periods prior to the date of termination. We anticipate that this information is helpful in providing resolution to this case. If additional information is necessary, please feel free to contact me at 317-(****).
