Complaint: Kyees Construction was hired to do a a project in my home for refinishing wooden kitchen floor and entry wall floor, Remove and reinstall a stone back splash, hang two interior doors, and to paint the kitchen. This was to be a 2 day project. The project was "completed" in 3 weeks. The first time the floors were sanded were with a belt sander and resulted in several nicks and grooves in my floors which were still stained and poly applied. When I complained, another worker was sent over to my home and he said Yes, this looked like crap and needed to be resanded and redone. I asked for plastic barriers and both times none were used to help contain the dust. The kitchen vent was also not covered and several inches of saw dust remained in the vents and thru out the entire house. My refrigerator/freezer doors were dented and damaged when they moved them into the granite counter top . One of my doors were damaged and they did have to purchase another one and restain them. I have two areas of chipped granite from damage during the back splash installation. There is an area under my microwave that was missed with the back splash. Also the floors still are not satisfactory, they have swirled areas and are not finished even with the second sanding and refinishing.
Desired Settlement: Replacement of my refrigerator since it was damaged. Floor is not satisfactory but I do not want them to refinish them for the third time. I would like another floor professional company to come and look at them for their opinion.
Business Response: The project did take significantly longer than expected, but the customer was compensated with a 40% discount on the project price which was a very generous settlement. The "damage" to the refrigerator is questionable as to whether it existed before our project. Our proposal did not include moving the refrigerator. When the customer asked us to move it, we tried to accommodate the customer's request which actually added costs which were not in the original quote. Our bid also did not include sealing off areas of the house with plastic sheeting. If the customer had requested it, we could have added it to the bid. We had offered to complete the minor remaining issues on a punch out and the customer refused to allow us to do so. Even though we question our responsibility for the damaged refrigerator panel, we offered to help the customer find a replacement panel, but she again refused. The only thing that apparently will satisfy this customer is a new refrigerator which is a ridiculous request. We offered to let a judge decide the question of damage, but the customer also refused that offer. Instead she continues to complain in public forums after accepting a generous settlement.
In response to the letter from **** Kyees, he is not factually correct. When he bid the project to strip and refinish wood floors, the refrigerator was in the kitchen and any company who is refinishing flooring would move appliances in order to fully complete the sanding and staining of the floors. As for the plastic seal off of the areas in order to reduce the sawdust from sanding, I did request for this to be done. The issue that is not being address is the time element of a quoted job of 2 days, instead taking 3 full weeks. Floor that were not completed properly the first time, resulting in additional sanding, staining, and mess to my house because of it not being done right the first time. The most significant issues are that the floors are still not finished properly, there are swirl marks from the sander and the stain was sloppy and not what I would ever think any company would say is a satisfactory job. The issue of my refrigerator being dented in two places is yet another thing. I did contact the company and the problem is that they do not make skins for a double doored refrigerator/freezer. It is not because I was not willing to do this, it is because it cannot be done. I think the fact that I wrote a check for $1100 instead of the original bill of $1793 is because the owner repeatedly stated, we can take this to a judge but he will never rule in favor of you!. I felt very intimidated by his unwillingness to work with me and admit that this project was below standard and to try to do the right thing. I even offered to have another flooring company come and inspect the flooring and also to use a scale to depreciate the refrigerator but he said that he wanted $1200 so that is the only reason that I ended up writing a check to him so that he would leave my home. I am very saddened to think that businesses do not "Care" about the customer. It is my right not to recommend this company and I will continue to say that I would never recommend them.
BBB's Final Determination: After reviewing the position of all parties, BBB determined that the business made a reasonable effort to address the complaint. However the consumer remains dissatisfied.
