Complaint: We contracted with Treemendous Design to do a landscaping project for our home. In discussing the trees that we wanted for our yard, I was very specific as to what we were looking for. I sent him a picture of what I expected, and ***** sent it to his supplier to ensure that the trees they had matched what we were expecting. Upon delivery, I told ***** that the trees were not what we had talked about. He installed them anyways, and after a few days of looking at very sickly looking trees, emailed him to let him know we were still not happy with the trees. I offered to swap them out for different trees in order to try and resolve the issue. After MONTHS of trying to get Treemendous Design to rectify the issue,their "equitable" resolution was that I pay full price for new trees, and they would transplant the sickly half-dead trees to a new spot in our yard. As this didn't seem equitable at all, and I no longer wanted to do business with them, I requested a full refund of the trees. *****, the owner, agreed, but only sent a partial refund. Additionally, when we met regarding the trees that should have never been planted, we had him look at a few other plants that, despite very good care, were not making it. We do have a warranty on all of the items that he planted. He has never gotten back to us regarding another tree and several bushes that have completely died. There are several of the same type of bushes and trees in the same planting bed, so they are equally cared for, and the others are doing fine. We have been put off and de-prioritized by this company for nearly 5 months. Either we are ignored, or we are told that we are not a priority and that they have other business to attend to. On top of our service and warranty issues, I would also like to say that this company did not install the plants in the proper place, despite having a professional landscaping drawing.
Desired Settlement: We would like a FULL refund of the cost of the 3 sullivan trees, not the partial refund that was sent. Additionally, we would like the warranty honored on the Upright Hornbeam tree as well as the 3 dense yews, 1 lilac bush, 1 cutleaf buckthorn, and the 1 gold false cypress. However, since this business has been so unwilling over the last several months to accomodate, a full refund of these plants would be preferable as well.
Business Response: My company did install plant material for this client. During the bidding process, ******** and I discussed the specific variety of False Cypress that she wanted planted. I told her, over the past 17 years of business, I was not familiar with nor had we installed the "Sullivan" variety of False Cypress. She did email me a picture of the Sullivan which I passed along to our nursery for verification. These trees had to be special ordered per the client's request. I was on site when the plant material was delivered and we did discuss the trees. She questioned the height and mentioned they looked thin and not exactly like the ones she had at a previous residence. I reiterated to her that I was not very familiar with that variety, but plant material varies in fullness, color, etc within the same variety. She and I continued looking at the placement of the rest of the plant material and nothing else was brought to my attention about the trees. On August 5, 2013, I met with ****, ********'s husband, to work out a resolution that would be agreeable for both parties. We met for quite a while and discussed several options. Since the trees were special ordered, I explained that I could not return them, but I was willing to plant them in another place in the lawn. I told him we would supply the labor to move the trees and to plant new trees, if they would pay for the new trees. **** and I looked at the other plant material and we discussed the Upright Hornbeam trees...specifically one had some browning on it. We discussed transplant shock and I told him I would check with the nursery. I thought I had emailed **** back and apparently did not, which was completely my fault. The nursery confirmed that the browning was more than likely due to transplant shock. NO other plant material was stressed nor discussed that they looked stress during this meeting. This complaint letter, dated 9-24-2013, is the first time I have heard about the yews, gold false cypress, buckthorn, and lilac looking stressed. At the end of our meeting **** thanked me for coming by and thanked me for the options and he would get back with me on what he wanted to do. He and I emailed back and forth discussing tree options. I sent him pictures of the trees I suggested that would provide him the screen he wanted. I tried to work with them on a solution that would satisfy both parties. After my meeting with **** and exchanging emails, I realized it did not matter what I did, I would not be able to please this client. I agreed to refund them the money and we would remove the trees. I did not want to leave this situation like this, as I make sure my clients are pleased with our work, but I decided it best to part ways. I thought they were refunded the total installed amount of the trees. When the client emailed me stating they only received a partial refund, I researched it and discovered that only the cost of the trees were refunded and not the labor portion of the installation. I let them know that I would drop off a check for the balance and apologized for the oversight. Since this complaint was filed and I emailed the client, I received an email back with pictures of the plant material that is stressed. I will look at this plant material when I drop off a check for the balance. I have and am trying to please this client with an agreeable solution. This bothers me very much as we pride ourselves in providing excellent service to all our clients. This is one of only a couple complaints we have ever had in the past 17 years of business.
BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
