Complaint: Franklin is billing me for hours not worked. They are billing me to correct mistakes that they made during the installation process to vent a kettle. Franklin Heating and Refrigeration did miscellaneous HVAC work at my brewery. Despite being asked for an estimate three times, none was ever provided. I was told it would be emailed to me. They used unskilled labor to install a barometric vent on my kettle. He installed it on the steam vent instead of the gas vent. This could have caused carbon monoxide poisoning had I not caught the error and had them correct it. This work should have been completed in a couple of days (16hrs) instead it took 5 trips and almost a month to complete. I was billed for 35 hours. When I asked for a breakdown of the bill it showed that two employees were working on days when only one employee showed up. I have several witnesses to how many people were on the job site from Franklin. A state of Ohio inspector pointed out items that were missed by their installer. Franklin's poor workmanship delayed me from starting production in my brewery.

Desired Settlement: At no time did I agree to pay Franklin Heating and Refrigeration any money for anything. They started the project without providing an estimate and took the opportunity to over bill for the work performed. I paid the company a very fair $1285 for the work. I would like them to stop sending additional bills and consider the account paid in full.

Business Response: "Mr. (****) hired a unqualified contractor to perform work. Running behind on time, contracts Franklin Heating & Refrigeration, Inc., to correct the first contractor's work and bring up to state code. He stated from the beginning that his funds were limited, which is why I gave him a reduced rate. Mr.(****)still owes Franklin Heating $636.00 for the HVAC work and $239.00 for start up of beer boiler. Mr. (****) has came right out and called me, my wife and my employees a lair, stating we were not on the job when we stated we were. Mr. (****) was only seen once by Franklin Heating workers on the job site. He at no time asked Franklin Heating to get off job site or stop work. He actually gave us a key to let ourselves in and out of the job site. In closing, Mr.(****)has received a fair job for a fair price."

Consumer Response: (The consumer indicated he/she DID NOT accept the response from the business.) I notice they do not refute anything that I have claimed. They just provided irrelevant information.

BBB's Final Determination: Business agreed to mediate the complaint but the consumer declined.
