Complaint: Choice Recovery LLC has mistakenly reported me to credit bureaus. I want Choice Recovery LLC to remove their negative reportings from my credit files. First, I never heard of this company. Secondly, I don't have a contract with Choice Recovery LLC, and third this is not my debt. This is a violation under the FCRA (Fair Credit Reporting Act) this is inaccurate information being reported on my credit file, and I demand this is removed from all credit bureaus immediately. If not I will be forced to reach out to the FTC (Federal Trade Commission.) I hope we can resolve this amicably. Sincerely,

Desired Settlement: I want Choice Recovery LLC, to remove their negative remarks from my credit files. Please correspond with me via email only please.

Business Response:

The consumer's debt is with ********** ********** of Clay County.  We are the third party debt collection agency for this company.

We are attempting to validate the consumer's debt with this company and will respond via US mail within 30 days.

Consumer Response: I don't owe Choice Recovery anything on the behalf of anyone. In their response they stated that they're a "third party" that being said I don't owe them anything. Collection agencies purchases debts for pennies on the dollar. In addition, I do not have a contract with Choice Recorvery. According to the FRCA everything is done by "consent" meaning a signature from me. I might could appreciate and accept their "validation" if Choice Recovery had a contract signed by me. Therefore, Choice Recovery is fraudulently trying to collect money from me that a debt isn't mine.  To name a few, these are things that collection agenciess don't want the consumer to know. However, I am up on  these collections agencies, and very aware (familiar) with the FCRA and FTC. The only desired acceptable resolution for me is for Choice Recovery to remove the negative remark from all three bueraus. Again, you can't validate something you don't have.

Consumer Response: You stated in your previous response "Choice Recovery didn't purchase your debt"  I  just so happen to agree with you becuase it's not my debt. Please correct me if I'm wrong, but it sounds like Choice Recovery is failing to remove this debt from my credit file. If that is the case I will proceed to the next level in having it removed.

Business Response:

We have validated the debt with our client, ********** ********** of Clay County.  Notice of this validation and medical release has been sent to the consumer's last known address.

Choice Recovery did not purchase your debt.  We work as a third party collection agency for this medical provider.

We do not find any of the consumers additional claims to be valid.  If the consumer has additional questions on credit and collections we encourage them to contact a licensed credit/financial adviser or a legal professional.

Complaint: I called choice recovery in an effort to resolve 2 accounts I noticed on my credit. I spoke to Dana whom was very rude. Choice Recover claims I owe 3 accounts in their office. I am disputing the full balance of what ever oral surgeon bill they claim I owed. I also am not sure if they have the correct balance on the 2 ER bills they have in their office. I would like them to provide me validation of debt containing my signature on the original contract with the original creditors. I attempted to contact ************ ** Consultants and not only was there a BBB alert saying the company is no longer in business, I also called several numbers that were disconnected. I want their contact information if they are a valid company. I have asked this company to cease and desist all collection efforts except for providing me the proper validation I am requesting.

Desired Settlement: Provide Validation of debt not defined in the FDCPA, so I want validation with my signature proving I signed something stating that if it wasn't paid it would be placed on my credit by a third party agency as well as proving the amount owed.

Business Response: We apologize the consumer was unhappy with her experience with Choice Recovery.  We will review the call to make sure the consultant is addressed regarding the consumer's claim she was rude.

The request for validation has been sent to our client.  Once we hear back, we will respond via US Mail with the results.

Consumer Response:

Thank you for responding so fast. If you are unable to provide the proper validation I requested, I suggest you return the account to the client and remove it from my credit. After sending such validation please cease and desist all collection activity and do not contact me. If I do not receive proper validation within 30 days and it is not removed from credit at that point I would be seeking legal action against your company.

Again please ensure validation consists of my signature authorizing the fact that if the debt was not paid that, it would be placed on my credit. I want the original contract between me and your clients regarding all debts you have in your office, not a bill.

I would also like a contact number to reach someone at ************ ** consultants since the BBB is claiming they are not longer in business.

Regards, ***** ******

Additional Notes

Complaint: This collection is appearing on my credit report with all three bureaus from Choice Recovery Inc, referencing an account with ********* ********* ********** for $477. I never received any bills or communication from the original facility (********* ********* **********) or the collection agency, the account just showed up on my credit reports. I have no knowledge of this account. First, the account should not be with a collection agency without first billing me for any amount due. Second, the collection agency should not be reporting anything to the credit bureaus without first communicating with me to validate the debt. If I do indeed owe this debt, I have no problem paying the debt, but I require sufficient documentation to indicate what was originally billed along with all insurance and patient payments proving that I in fact do awe this debt, and even then, I require this item be removed from all three credit bureaus since I was never provided the opportunity to settle the debt before it was a collection in the first place.

Desired Settlement: I want this debt completely removed from all three credit bureaus. If the collection agency can provide sufficient documentation to prove that the debt is indeed valid, I will gladly pay it, but will still demand the debt be removed from my credit reports since I was never billed for this debt and it should have never gone to collections in the first place.

Business Response:

Notices were sent to the consumer by Choice Recovery (formerly known as FFCC-Columbus) on 11/5/12 and 12/3/12 with no response.  We spoke to a man who verified he was the consumer on 12/17/12.

The original creditor sent statements to the consumer at the address he provided at his time of service.  We have verified all information on the account as accurate and valid.

We have sent notification of the verification to the consumer's home address.  This includes a medical release which the consumer can return to us for an itemized statement of charges.

Consumer Response:
I reviewed the response made by the business in reference to complaint ID ********* and find the resolution is satisfactory to me. After reviewing their response and communicating directly with the business, we were able to come to a satisfactory agreement.

Additional Notes

Complaint: This account was sent to collections despite my making regular monthly payments. The balance owed was $607.19 A payment had been mailed before I received the collection notice. The payment had been sent to the billing office of the doctor's office and was posted to my bank account for $200. Later I received saying that only 39.83 had been received and that I now owed $567.37. My attempt to rectify this mistake was unsatisfactory as they refused to listen and only attempted to collect the balance they claimed was due. As this account NEVER should have been sent to collections, I have informed them that I will not pay a dime if it is reported to the collection bureaus.

Desired Settlement: I want a statement showing the actual balance of $407,.19 together with a statement from Choice that thy will NOT be reporting the account to any credit bureau.

Business Response: Our client, ********** ***********, has updated the balance due to reflect the consumer's most recent payment.  The balance due is $407.19.  We have sent the consumer a notice to reflect the balance via US mail to the address on file.

On this account, any unpaid portion remaining after January 15, 2016 is eligible to report to the credit bureaus.  If the balance is paid before this date, no amount or record will be sent to the credit bureaus.  Should the consumer need other payment arrangements, please call our office to discuss.

Additional Notes

Complaint: I would like to express my concerns for your company reporting fraudulent information on my credit profile. Since that time, I have been denied over 10 times for different credit applications (I have kept record). Furthermore, it seems as if your company does not take much thought for consumers but only practice unethical tactics in an attempt to make consumers pay accounts that are not theirs. How can you report an account to which you are not sure whether the account is mine? The FCRA states that a company must report accurate information to the credit bureau. It is clear that you are not sure because you are asking for information that you should already have when reporting this fraud account. They are currently reporting five accounts and some are duplicate ion nature. The creditor appears to be ************ *** This Company has failed to send the information as requested because they do not have it. I have never made a debt with this company and it is illegal what they are doing. They are reporting a false debt on my credit profile and ruining my credit worthiness. The FCRA states that they must be sure that the information they are reporting is accurate and true. At this point, I am demanding this company cease and desist from reporting this fraud account on my credit profile and delete fraud account. I will not reach out to resolve this again. I plan to contact a consumer attorney to hold this company accountable for their violations on my credit report. I have kept careful record. Govern yourselves accordingly.

Desired Settlement: delete fraudulent accounts

Business Response: Please tell us the account numbers on your credit report, dollar amount, original credit or any combination of these so we can identify the account(s) you are disputing.  We have no accounts that match the current address you provided.

Once we can identify which accounts relate to your complaint, we will address the issue.

Complaint: I have a chronic heart condition that I've been living with since I was 19. Sometimes I have to go to a doctor unexpectedly and bills that I cannot pay immediately can occur. The amount that was owed at the time was $54. I could not pay and it was sent to collections. Choice recovery has reported this every month since June 2012. I payed the balance in August of 2015 because I am at a point where I can resolve some of my issues that I had while being insolvent. I've requested that the petty amount of $54 that is at zero balance, be completely removed from my credit report. Choice recovery declined stating it is powerless to do so because the original debt was valid. However, this is a lie, collecting agencies can remove or stop reporting any account they want. They're punishing me for having a medical condition and I find that it's pathetic. Why would a company hold a small paid medical debt against a person who is chronically ill? It makes no sense. Your company is pathetic and will file a complaint against the doctor for using your services.

Desired Settlement: Completely remove the collections.

Consumer Response: Choice recovery advertises that their company works with people who have had a hard time from becoming insolvent. It is apparent that .Choice recovery does not care about the people they collect from, only if they pay or not. I wish this company would not use false advertising and market themselves for what they are. If you''re agency cannot forgive and stop reporting a debt that was originally caused because of a chronic illness and was only $54 and is now paid, then caustic to the people you try and collect from not helpful.

Complaint: I previous visited this location and saw a Dentist to have a tooth fixed. Paid the bill no problem. Developed tooth problems again I sought the service of same dentist. I waited to see this dentist. As I went back I was informed that dentist no longer worked at that location, that is when I left since I was told that no one there could handle my issue. I was not seen by my dentist and therefore do not feel I owe. When choice recovery called I explained this to them they claimed to understand since I requested a copy of the papers I was suppose to have signed for this second service and the company had nothing to give me except a bill, nothing I signed because I insisted on seeing my dentist I felt my dentist should provide free service to correct the issue. Also called l******* *****try with same argument and request received no documentation of service that I signed for or agreed to.

Desired Settlement: I want an apology and all signs of this removed from my credit reports immediately and a letter to each bureau explaining this was there mistake for my creditors. I want this fixed.

Business Response:

Our client, ******** *********, has withdrawn this account from collections.  We have requested the removal of the account with the credit bureaus.

While we feel that this was a misunderstanding between the consumer and our client, we apologize it was not resolved when she was in the office.

Complaint: I was trying to get a delinquent accont deleted from my credit report in return for pay,ent of that account. The company stated that it was illegal to delete the account according to the Fair Credit Reporting Act.. I have been advised that , that statement in itself, is actually a violation of the Fair Credit Reporting Act.

Desired Settlement: I want the delinquent account deleted from my Credit report.

Business Response: Choice Recovery does not delete accounts from the credit bureaus for payment.  We will update the balance as payment is made.

As to the claim of using "illegal" on the call, we have reviewed the recorded phone conversation and nothing was said to the effect of deletions are "illegal."
Should the consumer have interest in resolving her balance with North Florida OBGYN Associates, we encourage her to contact us for payment arrangements.

Consumer Response:

I was specifically told that deleting the account was against the FCRA.

Complaint: Choice Recovery is reporting a $30.00 collection on my credit reports. I was billed a total of $338 by *** ********** in 2009 as the result of a medical issue. For some reason, my insurance company paid all but $30.00. When I received a bill from the doctor's office (before it went to collections), I called the doctor's office to get an explanation for why they were billing me and then I contacted my insurance company who assured me they would pay the $30.00 to *** **********'s office. I contacted the insurance company a couple of weeks later and was told that they had taken care of that balance. When the doctor's office stopped contacting me at that time, I knew it was because they had received the $30.00. Once I saw this collection on my credit report, I tried to reach my old insurer again to verify that they sent the $30.00.

Desired Settlement: I was assured that the $30.00 was paid so I want this deleted from all credit reporting agencies. Thank You.

Business Response: We are attempting to validate the correct balance with our client.

All information was provided to Attorney ******* *********  Please ask Ms. ****** to confirm they are no long represented by this attorney so we can communicate directly with her.

Complaint: First, they separate every bill into different collections so even though it's from the same company on the same date they put 2 collections on my account. Second, when I requested they send me verification of the debt. They sent my information to my parents house because they pulled up the wrong address. I have been married for 11 years and not lived my parents for 15 so I did NOT want my parents to get my medical billing information. It was luck that it wasn't someone not related to me, however when I called them up their response was "Oh, so did you get it from them?" EXCUSE ME?!? They have also not calculated billings correctly and the total amount due is incorrect.

Desired Settlement: Well, since you violated my privacy but mailing medical billing information to someone not authorized by me to view it I would like you to remove the collections from my credit report.

Business Response: We are not showing any duplicate accounts in our system.  All mail was sent to the address Ms. ***** provided to the client until her address was updated by the US Postal Service.  To the best of our knowledge, Choice Recovery is transferring accurate information to the credit bureaus.  We are unable to meet her request.Should Mrs. ***** be able to provide us information that she provided an updated address to us, we will be happy to discuss further.

Consumer Response: it was not a matter of them having my current address because I had received a bill from them, which is why I had contacted them.  It was a matter that they printed off my MEDICAL billing information but mailed it to the wrong address, my parents house.  My parents also have an account with your client and you had never mailed my information to my parents house before.  This was your error and when confronted about it you didn't get the consequences of what you had done.  This has nothing to do with the post office updating my address.  You mailed the information NOT to the address that is listed on my account that I had verified, but to a completely separate account's address.  You pulled up the wrong account address and mailed my medical billing information to them simply verifying that the last name was the same.  You mailed my medical billing account information, which includes my 2 children and husband, to an address that belongs to a completely different account!

Complaint: I recently applied for a home loan and I received a call from the lender saying I owed a debt that was on my Equifax credit report in the amount of $700.00 I contacted the agency and was advised that I needed to pay a different amount of $1025.00 in order for them to report a 0.00 balance to my credit. I asked why they had not reported on my credit in almost 2 years and she proceeded to tell me " we have not tried contacting you in long time." Also the amount they were reporting on my credit was less than the amount she was telling me I had to pay. I asked her why this was and she said they had no way of knowing what was on my credit report. I contacted Equifax and they told me I owed the balance reported on my credit and then it should show a 0.00 balance, she said they have full control over what they report on my credit and the information about her not knowing why the amounts were different was incorrect. I am very bothered by this. I have filed a dispute with the credit agency as well.

Desired Settlement: I want to know why they are reporting 700.00$ on my credit report almost 2 YEARS AGO and why they are asking for $1025.00 to pay off the balance! Its unfair that they over charge and don't even bother to contact or update credit accounts and consumers are still required to pay the amounts!

Business Response: WE are attempting to validate the balance with our client and will respond to the consumer via US Mail.

Consumer Response:

This doesn't say anything as to why the reported incorrectly  (amounts) to my credit report and as to why they have done NOTHING for almost 2 years, and also as to why I was told they have no control over what my credit report tells me... THEY are the ones reporting the information!

Business Response: We have sent the validation of account with the financial liability form stating Ms. ********* is  responsible for the collection fee.  We are unable to give Ms. ********* an explanation of what is on her credit report, only what is due to our client.  We do not pull consumer credit reports.

Complaint: This debt collector has a debt reported on my credit report across all bureaus of it being from ***** ********* *********** *** $551.00. I have no records of this debt. I have spoke with them many times and they are unable to provide me with any documentation or information about this debt. They simply state they do not know what it was for - services rendered - or any other information. I contacted the original creditor and asked them to give this information to me to validate this debt. They said they checked their current and archived systems and I was never a patient there - they looked by name, address, previous addresses, debt amount and could not locate me. They have a nationwide database they say, and I was not at any of their locations. Choice will not remove this from my credit report even after telling them this. I even gave them the person's information at the original creditor's office. The credit bureaus have disputed this many times from my report, but state if the collection agency says it is valid, they consider it a resolved matter and there is nothing more they can do - but they agree the agency needs to provide this information to me to prove it's a valid debt. They cannot expect me to blindly pay for a service or product never rendered. I believe this is a mix up with someone else, or a SCAM. I have been unable to amicably resolve with anyone so this unfortunately is my next step. My credit scores have been affected by this for far too long, I am trying to buy a house with my future husband and this is causing unnecessary stress and financial issues.

Desired Settlement: Remove this erroneous debt from all (3) credit bureaus - from all of my reports.

Business Response: Ms. ****** is correct in stating that we cannot give her protected health information as we don't have this information.  We have offered to send her a medical release so we can obtain these records for her but she stated she will not sign the release. We will attempt to validate the debt again with our client and send the results US Mail.  Her is being reported to the credit bureaus as disputed.

Complaint: I was notified of a bill that was sent to collections to Choice Recovery, however I had no previous notice from the doctors office that there was a bill that even needed to be paid. I was notified by Choice Recovery I stated that I did not know about the bills. I stated that I would be willing to pay the bills off however I wanted to obtain further information from when/Where the bill actually came from and why I was not notified of the bill prior to it going to collections. I was then contacted 2 weeks after that by ****, stating the same thing about the bill being sent to choice recovery. At the time I was still attempting to get a hold of the doctors office. I recently went ahead and paid choice recovery in full. However I still feel that it was not OK for this to be added onto my credit due to me not knowing about the bill. I asked for a notice of removal letter in which I know of people including my now lender who has obtained a letter of removal from their credit from choice recovery within the last year, however Choice recovery is refusing to give this letter of removal to me. This is now prohibiting me from purchasing my home. Once I requested a removal letter **** stated that they do not give out notice of removals however when I asked to speak with a supervisor he stated that he did not have a supervisor, and he then asked me to hold on and he would find someone else for me to speak with however he then hung up the phone on me. I called back and was transferred to *** however seconds into our conversation my cell phone went dead and we were disconnected. I called back less than 5 minutes later and now Nobody is taking my calls and Im being sent to a answering machine. All I want is a notice of removal letter.

Desired Settlement: I would like a notice of removal letter, and not a paid in full letter from Choice recovery.

Business Response: Please inform us which account(s) you did not receive notification before collections and we will inquire with our client(s).

Complaint: I recently paid two accounts in full . When I made the payment I asked the CSR for a letter stating accounts were paid in full . The CSR advised he would email me the letter but I have yet to receive the letter . I called today the CSR (same CSR)advised he could not email me the letter due to the "Collection Law" . The CSR said he could fax the letter to me . I advised the CSR no fax number available . I asked the CSR isn't this against HIPAA privacy rule? He than advised I could send in a self address envelope . The CSR transferred me to the "Compliance CSR " who advised she would put the letter in the mail tomorrow . I also asked the CSR to remove this item from my credit report . I pretty sure I will not receive the letter . I paid the accounts in full but this agency is not keeping their word .

Desired Settlement: I would a letter saying both accounts paid in full and the two accounts removed from my credit report . I would like for this agency to keep their word and not tell lies .

Business Response: I confirmed that our paid in full letters went out in this morning's mail.  We do not request the deletion of accounts with the credit bureaus for payment.

If the BBB has other concerns, please feel free to contact us.

Consumer Response:  I would like to see the company policy / agreement with the provider stating they will not delete any collection from credit report after payment is made.

Additional Notes

Complaint: On May 8th and May 11th I was in contact with Choice Recovery regarding a debt they had acquired of my wife's. I spoke to a supervisors on May 8, on the 11th in the AM, the supervisor stated that she would remove the debt from my wife's credit report once we had paid the debt in full. I paid the debt in full on May 20th. When making the payment I inquired if the debt would be removed from my wife's credit report since the debt was paid in full. The customer service representative stated "No, we do not delete debts from credit reports, it will only be listed as paid in full, BUT not removed the credit report". she stated that on May 8th the supervisor had told me they would not remove the debt, but mark it paid in full. this is not what I was told by the supervisor on May 11th. It is my understanding that “the company agreed to delete the account for payment, after the fact they said they will not delete the account and therefore violated our agreement, that statement in itself, is actually a violation of the Fair Credit Reporting Act”. I specifically inquired if the debt would be removed and was told it would be, once the debt was paid in full. I want the debt removed from my wife's credit report, as it was originally agreed upon by the supervisor and myself.

Desired Settlement: I would like the debt removed from my wife ******** ****'s credit report. and we are requesting monetary damages for time and effort spent.

Business Response: Please provide us with the person you spoke to on the 11th and the number which you called from.  We will review the recorded conversation once you provide this information.

Consumer Response: The number that I called was *************.  I am unsure of the name of the person I spoke to, I only know that she identified herself as a supervisor.

Business Response: I personally spoke with Mr. **** on May 8th and was very clear that the account would be updated in our system to paid in full and we did not request a removal with the credit bureaus.

I have reviewed all incoming calls over 2 minutes from 9:45 to 11:54 received on ###-###-#### and none are with Mr. or Mrs. ****.  If you are able to provide me with a number from which you called in, I can search all incoming calls from that number (via caller id).
If the BBB feels as though we can research this matter any further, please advise.

Complaint: I have contacted this company about a debt for a bill from ******** **** *********. I told this company how many billing problems I have had with the pain treatment company and asked them to get me copies of the bills I have paid. They never send me a bill for the amount due!!!! How was I suppose to know I had anything due. Choice recovery has never called me back and I have asked them to not turn this into collections. They say they are going to help me but they never do!!!

Desired Settlement: I want this amount due gone and I don't want anything sent to collections

Business Response: We have sent *** ****** a copy of her requested itemization of charges via US Mail.  We have validated the balance due with our client.

Consumer Response: I explained to Choice Recovery that I wanted a copy of the billing from ******** **** ** because they never sent me a bill for the amount due. They asked me to sign a form stating they will get me copies of all payments made to ******* ****, which I did as they requested and they have never gotten the paid statements for me. The ******* **** ** has a horrible billing system and I don't trust them. I never did receive a bill for the amount they are asking for. Why didn't they send me a bill before turning it into collections? I do pay my bills and this is totally unfair to me!!!

Regards,
****** *****

Business Response: Choice Recovery, Inc mailed a copy of the itemization of charges today (5/21/15) via US Mail.  Please give some extra time due to a holiday weekend.  If the consumer would like to provide a fax phone line, we would be willing to fax this notice.  The consumer would assume all liability of third party disclosure if they choose to receive a fax regarding this protected health information.

Consumer Response: I did receive a copy of a bill showing very little. I went back and checked all the payments I have submitted and none of the payments that I have made were on this bill and I asked for an itemized statement showing ALL payments made by me and my insurance company. Also the bill they sent me was dated 12-12-14 and I never received this bill last year, as I spoke about before.

Regards,
****** *****

Business Response: The itemization of charges sent to the consumer had all charges and payments as related to the balance due.

If *** ***** would like a copy of the explanation of benefits, she will need to obtain this from her insurance company.  The explanation of benefits will show each service with the allowed/write-off amount and amount paid to the service provided.  Please call ****** with the number located on the insurance card for further explanation.
Choice Recovery has met the guidelines of validating the debt and providing an itemization of services for the consumer.

Consumer Response: That is not true. There were lots of payments I made that didn't show up on the bill you sent me. I asked for a total itemized statement of the money I paid directly to the pain doctor.

Regards,

****** *****

Business Response: Our client, ******* **** ********* ******, is reviewing the bank statements sent by the consumer.  Since the payments were made before the account was placed in collections, we will be unable to respond until the review is complete.

Consumer Response: I reviewed the response made by the business in reference to complaint ID ********* and find the resolution is satisfactory to me. I will wait until they have my account fully reviewed of the payments I have made to the **** center. I will wait for your reply from them.

Additional Notes

Complaint: I've made several attempts to call this collection agency in regard to an invoice from my doctor of which no one wants to return my calls and the charges are much higher than what is actually owed to the doctor office. I continue to call them and no return calls. This is causing the billing to be in a default mode; hence this is what I am trying to avoid. When I checked my invoice through ****** ****** **** that total was $164.61, there was another charge from *** ****** ****** from **** ******* **** which brought the total to $223.47. This is the amount I am willing to pay as I spoke to my insurance carrier on 05/28/15 at 7:30pm, regarding these charges and the amount that this collection agency is charge is $290.51.

Desired Settlement: The collection agency is billing for $290.51 but what I actually owe per my insurance provider is $223.47, which is what the doctor invoiced and that is the amount I am willing to pay. I cannot get anyone to return my calls and this is very frustrating as I am willing to pay. I sent in the payment in the amount of $164.61 and this was sent back to me with a release form of my personal information which violates my privacy as personal information would have to be faxed to Choice Recovery.

Business Response: We have confirmed the balance with our client, **** ******* **** ***.  The consumer signed financial liability paperwork at the doctor's office that stated she would be charged a collection fee if the balance was turned over to collections.  This is the additional amount that is added to the account (disputed).

We have made several attempts to return *** ******'s calls with voicemail picking up.  Our agency does not leave voicemail messages in ********.
We have the account marked as disputed.  The validation of account letter was sent to the consumer on 5/19/15 with her partial payment to the account.
If we can answer further questions, please let us know.

Consumer Response:

I have never recieved any phone calls. I did not sign any documentation at the doctor's office to indicate that I would pay for any collection fees if an amount was sent to collections. I had made several attempts to contact the doctor regarding the initial invoice and they never returned my calls either. I sent a payment based on the invoice from my insurnace which Choice Recovery returned to me. I'm appalled at the response from the collection agency since no one ever seems to return calls and I've left messages to their organization. If they made such calls why do I not have any missed calls from there general phone number? That would have been an indication that they called but I did not recieve such calls.

Regards,
****** *******

Business Response: Please review the attached agreement signed by the consumer.  The last sentence of the Guarantee of Payment agrees to the collection fees.

Consumer Response: I reviewed the response made by the business in reference to complaint ID ********, and find the resolution is satisfactory to me. I guess I did not read the document I signed. I'll send the payment to CHoice Recovery.

Complaint: I recently pulled my credit reports and saw an amount of $196 in collection to this company. I have never received any kind on communication from them and have no information regarding this amount in collection. I've been promised several times that I will receive a call back from them after requesting the information, but that has yet to happen.

Desired Settlement: Unless information can be provided about exactly what this charge is for, I would like this to be removed from my credit promptly.

Business Response: I apologize *** ********** did not receive the information he requested via phone.  I cannot give an explanation of this because our call software doesn't show an incoming call from the number provided by the consumer.

We will attempt to validate the debt and follow up with the consumer via US Mail.  This process can take up to 30 days.
I have attempted to call *** ********** at the number provided but was unable to make contact.
Should the BBB have any other questions relating to this matter, please feel free to contact us.

Consumer Response: I did not receive a call nor any voicemail providing call back information. When I called originally requesting information, I was told it would be mailed to me. That never came to fruition.

If I cannot be given explanation of this debt, I cannot conceive why I should be held accountable for it. This seems unfair and abusive.

Additional Notes

Complaint: On January 27th, 2015 I contacted Choice recovery to inquire as to the collections accounts I had with them I was informed there were four accounts all under $20, to which I asked to use a pay to delete method due to the fact that I am currently trying to be approved for a home loan and am trying to improve my score. I spoke with a lady who told me that I could pay them off but would only receive a payoff letter and that it would not be removed. At this point I asked to speak with a supervisor, a gentleman got on the phone and I explained the situation to him to which his reply was "We don't do pay to delete, actually its illegal based on the fair credit reporting act" the gentleman was very unkind about the situation and still refused to help although I made it clear my intentions where to pay off the debts in full if they would remove them. I feel that these collections need to be removed from my credit due to the fact that I was given false information stating that it was "Illegal" to use a pay to delete method to which I know was false information.

Desired Settlement: I feel that this company needs to remove these collections from my account

Business Response: I apologize the consultant used improper wording when discussing your request for removal.  We have continuous training to avoid these types of mistakes and have coached this consultant based on your conversation with him.

We do not offer any type of a "pay-to-delete" program.  We cannot meet your request for deletion based on the information provided.

Choice Recovery will update the credit reporting agencies with any payments you make on the account.

Should the BBB have further questions please feel free to contact us.

Consumer Response: I am rejecting this response because whether it was a mistake or not the supervisor stated that it cannot be removed because its illegal and that is a false statement which violates the Fair Credit Report Act and this needs to be removed because it is illegal for you to tell me that it is against the law to remove a collection

Additional Notes

Complaint: A payment arrangement was set up for the account for *** ********* and ********* to take 25.00 on the first and last day of the month from my bank account. This was set up by a ***** ****** at Choice Recovery. I received a letter dated Jane 2, 2015 stating I owed 338.00 which with payments made would not have been that amount still due and that the payment was due on Jan. 11th 2015 not Jan 15th. This is what prompted a call to ***** for a second time on Jan 12th, 2015 when there was no response to a voicemail I left on Friday Jan. 9th 2015. I talked to ******* (no last name given). She stated that she saw the agreed upon dates of the 15th and last day of the month but that they had used some of the money for other collections, the example used was ********* ******** even though it was past the statue of limitations that it could be collected on. She refused to send anything showing where the money went stating by law she did not have too. She then stated that the collection agency would have all funds transferred back to *** ********* and ********* and that she would send a new statement out. I advised that I had never set up that type of arrangement with *****, I was never updated or advised of where my money went for a bill that I was under the impression was going to my dentist. Her only other response was I should pay this bill in a timely fashion or it would count against my credit. Well I was, so if she was applying the money elsewhere and not showing a monthly payment then wouldn't that go against my credit?

Desired Settlement: I want in writing information on where the money went and get a VALID update that all monies were applied to the agreed upon account to the dentist . I want to know what law does not allow me information on a company setting up a particular pay arrangements and then they just pay whatever they deem even though the statute of limitations has run out on these old accounts. I gave them permission to my checking which now is a major concern. My other concern are people that employ them to collect in this case the dentist that they monies are getting less than what is owed and showing me lagging behind in what is owed. I also want to see what they are reporting against or for my credit.

Business Response: Choice Recovery has reviewed the consumer's complaint.  We are mailing out a statement for the *** ********* and ********* *** account.  Payments were adjusted at the request of *** *****.

We currently have no checking or credit card information for *** *****.  The consumer requested deletion of her scheduled payments in a phone conversation with ******* on 1/12/15.  She will need to mail in payments to honor her arrangement.  She may specify on her check or money order to apply payments to any selected account she wishes.
If the BBB feels we can be of further assistance, please let me know.
***** ******* ********** *******

Consumer Response: on Jan 12, 2015 ******* did not give me any other accounts that I would apply anything to, but she mentioned ********* which is a hospital that no longer exists, I would not have any other accounts to apply the money to if I was not aware of it.. Again I kept the arrangement for *** ********* *** ********* but they would not have received the monies as promised to show that I was current. I would like to know where my money went. I did cancel the arrangement that day because they were covering where it was going by saying by law they did not have to tell me. Again my contract was for the dentist no one else. I also need a statement showing the correct amount owed because the one sent was incorrect.

Business Response: Choice Recovery has requested a statement be sent to *** ***** for the balance she would like to pay on.  Our accounting system doesn't have a function to print a statement for each payment as it was applied to her account after the payments have been adjusted.  I cannot meet this request.

Though your service location may be out of business for the ********* ********** ********, the amount is still due.  We understand *** ***** does not wish for any of her payments to be applied to this invoice.  All payments will be directed to the *** ********* *** ********** *** balance until this balance is paid in full.
We will coach our consultant as to using  the word "legal" for a reason she couldn't send the letter.

Complaint: I called Choice Recovery attempting payment for a debt that is being claimed as mine, through a settlement. I asked that Choice Recovery verify, settle the debt with me and once and remove the debt from all three credit reporting agency, once paid. He refused to help me in anyway other than paying the debt in full. I explained that I was unemployed but seeking to clear the debt and he laughed at me saying people pull this all the time and Choice Recovery is not a pay to delete company. I asked what was pay to delete and he would not explain it, so I goggled it. I called back several times and he did not answer and do not return my calls. I finally was able to speak with him after a transfer and when asked to speak to supervisor he got angry and said that he was the supervisor and refused to let me speak to any one else and threatened to hang up me, he was very uncooperative. I was also made aware the debt removal is at the discretion of the debt collector and asked to have it remove after payment in full. The representative are rude and make no effort to listen.

Desired Settlement: Removal from my credit report after payment in full

Business Response: In agreement with our attorney and insurance carrier, we do not remove from credit for payment.  We will update our records (and forward to the credit bureaus) any payments made on these accounts and will update as paid in full once the account is satisfied.

In regards to a settlement, there is no settlement available on these accounts.  The original creditor already made credits to the account as allowed by her insurance carrier.  The balance is due in full.

Complaint: I had a $26 collection item from a doctors office that I didn't even know about, so I paid it and ask them to remove it from my credit report, they said they couldn't that they weren't allowed too. I had another collection with a different agency and asked the same and they said sure no problem its paid so we will remove it. I am trying to get a home loan and this $26 collection item on my credit reports is drastically bring my score down. They said due to the fair credit reporting act they couldn't remove it.

Desired Settlement: Its paid and all I want is it removed from all 3 credit bureaus. PLEASE!!!!!

Business Response: We have reviewed *** *******'s complaint and request for removal.  Choice Recovery's policy is to report all information accurately to the credit bureaus.  We have updated *** ********s account to a paid in full status.  We do not remove accounts from the credit bureaus for payment.

Should the BBB have further questions or feel we can assist in another way, please feel free to contact us.

Consumer Response: It is very unfair not to remove it after it is paid. It is only a $26 dollar collection for a dr bill that I didn't even know was there. If I had known, I would have paid a $26 bill. This is keeping me from getting a loan for a house that my family desperately needs. I would greatly appreciate it if they would remove it. Regards,
****** *******

Business Response: Choice Recovery's interpretation of the Fair Credit Reporting Act is data furnishers (Choice Recovery) must attest to the accuracy of the information provided to the credit bureau.  The information we are reporting is accurate.

Choice Recovery has provided notice of the debt via US Mail and in telephone conversations.  We have made attempts to explain the policy and reasoning behind our decision on credit reporting and deletion for payment.

We will not honor *** ********s request for deletion.

Consumer Response: This is not acceptable to me. Yes it is accurate that it was in collections but now it is paid and should be removed not just marked paid/ Regards,

Complaint: Went to the doctor in May of 2012, after being involved in an accident ( that was the other drivers fault), a little while later started getting notices from choice recovery, contact the other drivers insurance who said they had been taken care of not to worry about it, well eventually stopped hearing from them so I assumed it was all good, well was I wrong, me and my fiance are trying to buy a house now and can't because my credit is shot because of these people and this is crap! Complaint: Got ahold of Choice Recovery and spoke with ****, told her my situation; I was involved in an accident back around May of 2012. The accident was not my fault as deemed by the local authorities. I then proceded to the hospital to get checked out. Was billed for $118 and submited that in to the insurance company to pay off the bill. Apparently this never got done and the bill went into collections, I recieved a few calls early on and was informed by the insuance that it would be handled, this also never happend and now this is on my credit for a negative of $380? So when I spoke with **** I told her I do not mind paying it but I would like it removed from my credit as, because of the strange situation and she informed me this would be lying. The lying would be paying it as that is the insurance companies debt! And because of this crazy situation I can not buy a home? Where am I supposed to live? Choice Recovery claims to be a company that isn't out to get you. This proves they don't really care!

Desired Settlement: I want this removed from my credit! I don't think its my place but i will pay the $118 bill that the auto insurance was supposed to pay.

Business Response: The hospital bills for the facility charge.  This bill is for the doctor's portion of the bill.  If you can provide proof of payment for the doctor's portion of the bill, we will be happy to have this removed from your credit report.

Consumer Response: I need more information, i need the doctor name and things like this, i have no problem paying them but i do not know them, i want this resolved, the auto insurance was supposed to handle all of this and they didnt now it falls on me, instruct me on who to pay and how and ill do it, if this is removed from my credit.

Complaint: I contacted Choice Recovery in December of 2013 because I saw a charge of $175.00 on my credit report. I was told that it was a past due bill for **** ****** *****. I did not think this was my bill because I have **** ****** ***** and was not told about a past due bill when I had my service turned on two years prior to this. I wanted this removed from my credit report an I was told the only way to get it removed was to pay the bill. I was not happy but I paid the bill. It really hurts your score to have something in collections. I was told that when this item was paid it would be removed from my report. I made three payments. One for $63.67 in December, one for $59.67 in January and one for $59.67 in February. That would be a total of $183.01 had to pay extra if I wanted to make payment, they get you no matter what, but that is not even my issue. I have called back so many times because this is still on my credit report and it states that it is still in collections. I was told the last time I called that it could take up to 90 days from the time my last payment was made to have it removed. Well here we are 5 months later and it is still on my report in collections. I did my part, they need to do their part like they said and remove this from my credit report. I have my bank statements that prove that I paid them this money.

Desired Settlement: I want the credit reporting agency contacted and told that this is no longer in collections. That I have paid this bill and I do not owe any more on this bill and it is no longer in collections.

Business Response: As told to *** *****r on December 5, 2013, we agreed to update the account as paid in full once the final payment processed.  I have attached a copy of the recording for review.  It was reported as paid in full to the three major reporting agencies - Experian, Equifax, and Transunion - in March of 2014.

This account was closed and removed from credit reporting in May of 2014 as we no long represent this client.  If there is a record still reporting, we encourage *** *****r to sent a current copy of the record to us.  We will need a copy directly from the credit bureau and not a third party.

If the BBB feels we can be of further assistance, please feel free to contact us.

Complaint: Choice Recovery Inc attempted to collect $212 from me as a collection that was reported to my credit report as a Medical debt from ************** ******** that has stated this debt as an "appointment cancelation fee". I did not agree in any form including writing or verbal to this appointment that was made and missed. This charge is a false charge and false debt that I do not owe. I did not sign anything with the Medical company nor verbally agree to any appointment. In addition I have already disputed this incorrect and false debt to all 3 major credit companies who will notify Choice Recovery of my dispute.

Desired Settlement: I ask that Choice Recovery completely remove this charge/debt from all 3 major credit companies (Equifax, Transunion and Experian) when they receive the dispute that has been filed to all 3. I do not want it simply "Closed" or "paid". I want it REMOVED from my credit. I would also like to suggest that Choice Recovery in the future require proof that debts are owed before taking the file.

Business Response: Choice Recovery has validated the debt of $212.08 with our client.  *** ******* is mistaken on the charge related to this debt.  We encourage him to contact his insurance company for a break down of charges or we can assist him with a description of charges once he signs a medical release.  The dispute has been noted on the account.  We encourage the consumer to contact us to pay this balance or can work out a payment plan with him.

If the BBB feels we can be of further assistance, please let us know.

Consumer Response:

Choice Recovery is stating and suggesting that I should contact my insurance company. My insurance company has no part of this bill and is in no way related to this claim. If this was a bill that my issuance was not covering or paying (i.e. Co-pay, additional costs, referrals, unapproved surgeries, etc) then my insurance would submit a bill showing what they covered and what they would not, thus leaving me a bill I owe to the original medical office. However, this bill is directly from the medical office for a surgery cancelation that I never scheduled. This meaning, my insurance company has no bearing to this debt, thus meaning they will not and cannot be involved. Choice Recovery suggesting that I speak to my insurance company proves to me that they do not know what they are collecting money for nor do they have any proof that I owe this money other than the fact that it was submitted to them by the medical office.

I do not feel trying to collect on a debt that does not exist, passing the blame onto an insurance company that is not involved in any way and putting my credit in a negative standing and using it as a bargaining chip to collect money is the correct or professional way to handle this situation.

I ask that Choice Recovery revisit my first complaint and investigate as to what they are collecting debt on and legitimacy of this said debt. They will not find any. I as the defendant in this matter should not have to prove that I owe nothing, rather Choice Recovery should prove that I owe a debt in order for them to ask me to settle it. I stand by my original dispute that this is not a debt I owe, it is false and I would like it to be removed from my credit.

Regards,
******** *******

Complaint: On June 25, 2014 I paid off in a full a balance of $135.67. I spoke with **** *****, he told me I would get a receipt for my payment within 24 hours via e-mail. Well today is July 9, 2014 and I still have no receipt. So today I called and spoke with **** ***** again and he said I should of gotten one. I explained to him that I did not or else I would not be calling him. He proceeded to tell me that he has no access to being able to re-send one to my email or to mail one to me. Then I asked to speak to a supervisor and he sent me to a voicemail of someone named ****** who for all I know is not a supervisor but probably a co-worker who is as incompetent as he is. I left this ***** person a mean voicemail that all I want is a receipt for my payment but I have not heard back from her. All I want is a receipt!!! How difficult is it to give someone a receipt for a transaction that a company accepts from a consumer. I want a receipt ASAP!!

Desired Settlement: I want a legitimate receipt on company letterhead that says the account is paid in full with a remaining balance of $0.00.

Business Response: Choice Recovery has obtained a copy of the receipt from our credit card processing company and attached it to this response.

*** **** was transferred to the voice mail of our ********** Officer, ******  Her voicemail was returned within 24 hours but the call was disconnected as we tried to confirm the account which lead to this complaint.

Complaint: I had an allergy attack in March 2012 and went to ******* ******* in ******** **. After paying my co-pay, giving them my insurance information and seeing the doctor, I left and never saw or heard from them again. I recently checked my credit report and was shocked to see a collection account from Choice Recovery on it for $293. When I called them and asked about the details about this, they said that they've sent me many letters, and also contacted me 4 times on my phone and that someone has answered that this is a wrong number. How can that be ? I have had this phone number for longer than I can remember and have never lost it for even a day. And why would I lie to them if something as critical as this is at stake? Also, I am very careful about my credit history and maintain a 100% payment record. I have never had even a single late payment or any collection on my credit. I need to take a home loan for me and my wife as we're expecting to start a family and this collection account has brought my credit score down severely from 750 to 706. This has also affected my employability as employers do a credit check now days and a collection account is a black spot on my credit which will stay for 7 years. On Choice's website they claim that they are not out to ruin peoples credit, but they will ruin me if the collection account stays on my credit. I honestly have never received any letter or call from them as they claim. I am not at fault here but I'm being punished nevertheless. Now because of one collection account, I will have difficulty in securing a home loan from any bank and even if I do, it will be at a very high rate. Please help me !

Desired Settlement: Choice's website claims to be in the business of not ruining a person's credit but just collecting for their customers. My sincere ask and cry for help is that I pay in full $293 to Choice Recovery and they remove this negative collection from my credit report, so I can secure a future for my family. This is the only negative report I have on my credit. Please consider and resolve.

Business Response: The consumer was sent letters on 3/6/14, 4/6/14, and 5/28/14.   Calls were made to the phone number provided by the consumer on 3/6/14, 3/21/14, 4/9/14, and 4/23/14 with no answer.  On 4/23/14 at 5:01 pm we received an incoming call from the number provided by the consumer who told us it was the wrong number for the consumer.

Before placing in collections,  the client sent statements with no mail return on the account.  The account was validated with our client on 5/27/14.

Attempts to resolve this account before credit reporting were sufficient.  We are more than willing to work with *** **** on a payment arrangement but feel the information reporting to the credit bureaus is accurate.

If the BBB feels we can be of further assistance in resolving this matter please contact us.

Consumer Response: The collection agency says that on 4/23/14 at 5:01 pm we received an incoming call from the number provided by the consumer who told us it was the wrong number for the consumer. Please can you provide me this recorded call which you have for that conversation. Also, they say that they called me on 3/6/14, 3/21/14, 4/9/14, and 4/23/14. If they have called there should be voice mails, but there are no voice mails on my phone. I did receive a blank call from their number once and on calling that number back more than 3 times, it would just ring and go dead after the 1st ring. Had I been contacted, I would have paid. I want to hear the recorded call in which I've told you that this is a wrong number.

Thanks and Regards,
********** ****

Business Response:

Choice Recovery consultants do not leave voicemail messages for consumers, therefore we are unable to provide the recording which the consumer requests.   We encourage *** **** to contact our office to make complete restitution on the delinquent balance on his account through a one-time payment or to establish a payment plan.  Until that occurs, our records indicate that the amount reporting to the credit bureaus is accurate.

Consumer Response:  Choice Recovery does not have any proof that they contacted me. They do not have any recording of the call where someone called them and said that this is a wrong number. They also have not left me any voicemail, and yet they have made a collection remark on my credit history and ruined it for 7 to 10 years. This is a total lack of regard for an honest consumer's reputation and is totally unacceptable. This completely goes against their business claim that they are not out to ruin a consumer's credit but only here to collect for their customers.

I have never defaulted on any payments and request that they accept my offer below as I am not at fault here and should not be punished for no fault of mine.
I am willing to pay the entire amount in full if choice recovery deletes the collection remark from all the credit bureaus and guarantees that my credit history will be 100% clean as before.

Regards,
********** ****

Business Response: We do not offer a Pay-to-Delete option in compliance with our interpretation of the Fair Credit Reporting Act.  We will update the credit bureau status as paid in full once the account is paid.

Consumer Response: The supervisor ***** from Choice Recovery says that only ******* ******* can authorize them to remove the account if they say they had the wrong address, and ******* ******* says that they cannot authorize Choice to remove the account because they "dont want to do it" and because they have no proof that I called them to update my address. This is a deadlock situation and now the only solution I think for me is to get a collection lawyer. What proof does ******* have that I did not call them to update my address when I moved 2 years back, they said that they don't maintain call history. ******* says that they sent 19 letters to my old address and not one was returned to them. How can that be, then USPS is liable for this confusion. Choice recovery says they called me multiple times and and got a response that this is a wrong number, and when I ask for proof of that call, they say they don't have it. Also, they say that it is not in their policy to leave voice mail messages. This whole system is flawed and there is absolutely no accountability anywhere in the system.

I am totally disappointed have never been in such a situation before. For the last time, I am requesting Choice Recovery that I am willing to pay the amount if they remove the remark from my credit history. (this is not a request to pay for delete). I have never had any debts, ever, and all my payments towards my creditors have been 100% on time as can be seen from my credit history. Unless they provide me proof of the call in which I say that my phone number is the wrong number.

Regards,
********** ****

Business Response: In additional communication with the consumer via phone, he is aware we can remove the account if the client placed the account in error or with bad information on the account.  The client has confirmed again that they provided us with accurate information and location information as provided by the consumer.  The account is due and accurate.

Complaint: I offered payment for a debt that is being claimed as mine. I was greeted with rude people. Who kept calling me a debter. They refused to help me in any way other then taking my mlmey. I requested a supervisor and was promptly told one was not avalible. I requested the CEO and was dropped in a guys voicemail. This guy called me back and basically laughed at me saying people pull this all the time All I want is this removed from my credit after I pay the bill. This company is full of lies and rude people

Desired Settlement: Removal from my credit report after payment in full

Business Response: Due to upholding the integrity of the Fair Credit Reporting Act, Choice Recovery does not pay-to-delete.  The call with our consultant was reviewed and we didn't found the claims of rudeness to be inaccurate.  Our consultants are not required to listen to profane language and the call was abruptly ended.  A recording of the call is attached for review by the BBB.

In the conversation with the President of Choice Recovery, *** ******** did threaten us with filing complaints if we refused to delete this account from the credit bureaus for payment.  Once again, we do not offer pay-to-delete.  The consumer was informed in conversations in May and June of 2011 of the debt.  The validation notice was mailed on May 31, 2011.  The consumer had ample time to resolve the account before it was on his credit report.

Should the BBB have further questions or concerns, please contact us.

Consumer Response: After I told the president of the company abkut filling complaint he laughed and hung up on me. After I filled the complaint I emailed him a copy of it and he said oh that's a shame because I was going to help you out by reaching out to our client. I offered to pull the complaint but received the response that he was going to fight the complaint. Clearly this company is not doing things by the book. Not to mention the debt is not reporting correctly on my credit report.

Should he choose to keep fighting I will be seeking a lawyer to go after him and his company. For not only not accurately reporting the debt but trying to lie to convince me to pay the debt.

Complaint: I recently ran a self credit report and found I had 5 collections on my report. I was shocked to find this because I have no negative credit in my history and I have an extensive credit history. I am very particular about my bills. These collections were for $5, $46, $9, $21, and another $21. Choice recovery had never contacted me by phone or U.S. mail to make me aware of these debts. After 25 plus years of credit history totaling nearly $1,000,000 and zero late payments or collections, it is quite obvious that if contacted, these petty debts would have been settled. The day following the evening I received these reports, I contacted Choice Recovery and was sent to a voice mail. I left a voice mail with all of my contact info and no one called back. One week later, I again contacted Choice Recovery and they again attempted to send me to a voice mail. I told them I wanted to speak to a person and after several minutes on hold, I finally was given someone to talk to. I feel this company never made an honest attempt to make me aware of these debts because they stood to make very little money collecting such small amounts. I feel this is a deplorable business ethic and now I suffer from Choice Recovery's unethical practices.

Desired Settlement: This collection should be removed from my credit report and other consumers should be notified of this unethical practice.

Business Response: I spoke with the consumer this morning and we have come to a mutually satisfactory resolution.  Should the BBB or Mr. ********* have additional concerns please contact me.

Consumer Response: I have reviewed the response made by the business in reference to complaint ID********, and find that this resolution is satisfactory to me.

Complaint: the medical service that was charged sent the bill to my old address and this was then sent to a debt collection agency which was choice recovery. when i check my credit report, i found out about this and called them and payed the money i owed on 1/2014 and ask them to remove this debt as i was not notified of this at my correct address. they have failed to remove this from my credit report

Desired Settlement: remove this from my credit report as it was sent to the wrong address and has been paid in full

Business Response: Notification of the debt was sent to the address the consumer provided to our client and as provided in this complaint.

The account has been reported as paid in full to the credit bureaus.  This debt is reporting accurately to the credit bureaus to the best of our knowledge.

Should the BBB feel Choice Recovery can be of further assistance, please feel free to contact us.

Consumer Response: This is an error as if it was sent to my correct address I would have paid the debt in full and it and it would have never gone to collection. It was only sent to collection as I had no knowledge of this debt. I have no other debt collection in my credit report which should inform you that I have always paid what I owed in full for by the Grace of God I have always had the money to pay if only I was informed of it before I was sent to  collection.

Complaint: I called this company to inquire why I had a collection on my credit report. I realized that I had not paid my medical balance of $72 due to moving and the invoice was never sent to the right address. I asked if I could pay it and have it removed from my credit report I was told yes. I paid the bill on the spot. A week went by and I saw it was still on the report and called again and was told they would never remove it from the report because it would keep them from being able to report to the bureaus. Given the promise to remove and update my credit report and then being told they would never remove the collections as it would prevent them from reporting to the bureaus I am asking for full reimbursement AND a removal from my credit report. This was a big misunderstanding and I don't have any other collection issues. I was also told that they use to remove collections from the reports but don't anymore because they won't be able to report to the bureaus. Which is a lie. This company is unfair and tells lies to the consumer.

Desired Settlement: Full reimbursement and removal from my credit report.

Business Response: We have reviewed the complaint and call recordings where payment was made by the consumer on 4/15/14.   Our consultant explained at the time of payment that the record would be updated as paid in full.   There was no promise to delete the record with the credit reporting agencies.  We have found the consumer's complaints to be invalid.

Business Response: We validated this debt on 2/18/14 and sent the validation notice to the consumer on 2/19/14.  This debt falls under medical.  Due to the HIPAA privacy laws, the consumer will need to sign the release (included in the validation notice) and return to us for Choice Recovery to obtain PHI (protected health information).  As it has been over 60 days, we will re-validate this debt and send the consumer our client's response via US Mail.

Complaint: On my credit report Choice Recovery states that I owe $263.00 to Time Warner Cable from a 2009 bill. I have never received a bill from Time Warner Cable and Choice Recovery has made no attempts in the past five years to contact me regarding paying the amount owed. In the interest of improving my credit score I have made several attempts by phone to pay the amount in full (though no proof has been offered or supplied to show that this collection amount is accurate) as long as they remove the account from my credit report once the payment has been made. Those offers have all been refused. An email was sent to Choice Recovery asking that they remove the account once payment was made and to reply by email, phone or letter with their response within fourteen days has gone unanswered for more than thirty days.

Desired Settlement: Since no proof of the debt has been offered, no collection attempts have been made and Choice Recovery will not reply to written requests to pay the amount I would like the account removed from my credit history. If of course Choice Recovery would like the amount paid they must agree, in writing, to remove the account from my credit history once the amount has been paid in full.

Business Response: Numerous attempts were made to the consumer in 2009 and 2010 by mail and phone.  The initial notice was sent to the consumer on April 3, 2009.  An itemization of charges was mailed on September 10, 2009 at the consumer's request.  On March 31, 2010 and August 9, 2013 the consumer entered into payment agreements for the balance due but no payments were received. We have no basis to remove the delete the charges from the consumer's credit report, however, we will update the bureaus with any payments applied to the account.  Should the BBB feel we can be of further assistance in this matter please let us know.

Consumer Response: I will not dispute that I may have requested an itemized list of charges but I have never received them, nor have I ever received a phone call from Choice Recovery.  When I have spoken with a Choice Recovery representative they have offered to set up payment arrangements but I have never entered into any kind of agreement with them for the reasons stated in the original complaint.

As stated in the original complaint, I will agree to pay the amount due if Choice Recovery agrees to delete account once payment has been made in full.

Business Response: We are sorry the consumer rejects our response; unfortunately, a review of our records shows that the account was handled in accordance with our guidelines as well as in accordance to federal law.  In regards to the consumer offering to pay his balance in exchange for us deleting this entry from his credit bureau, we must decline that offer as it violates our polices and weakens the integrity of the Fair Credit Reporting Act.

Consumer Response:

Choice Recovery states that,, "the account was handled in accordance with our guidelines as well as in accordance to federal law."  What does that mean exactly?  Choice Recovery has made no genuine attempt to recover any funds in the five plus years that they have had this account, I have also not received an itemized list of the charges as I requested.  The allegation previously made by Choice Recovery that I have twice entered into a payment agreement is a complete falsehood.  It is my belief that this is an underhanded attempt by Choice Recovery to restart the statute of limitations of this account.  I believe that constitutes a violation and an inherit lapse of integrity against the Fair Credit Reporting Act that Choice Recovery claims to value.

I do not believe my request to have the account deleted for payment is unreasonable.  Choice Recovery is a debt collection business; from my experience they don't seem to be terribly interested in collecting debts since all attempts to pay this particular debt have been initiated by me.  They seem much more interested in playing hardball over a debt of $263.00 which I have offered to pay, in full, numerous times by phone, email and now through the mediation of the Better Business Bureau.

Business Response: The courtesies the consumer is referring to in this complaint have been addressed.  Choice Recovery will mail an additional itemized statement from the client to the consumer directly at the address on file.  We will not agree to delete from the credit report for payment.  Should the BBB have additional questions, please let us know.

Additional Notes

Complaint: Good afternoon: I had a difficult time getting receipts from Choice Recovery and I am absolutely frustrated with that company; first the bills should not have been sent to collections in the first place. I am still seeing the Cardiologist, imagine that!! And have never been given a bill or provided the opportunity to even pay the bills; when Dr. ********* sends me to the front, nothing is ever said. I haven't even received a bill!!!! I called Choice collections the week of November 11th to begin the process of paying off the collections; I was denied an apartment to rent due to some minor medical collections from ***** ***** apartments. First, getting someone to return the call was a stressful event. Then, finally I spoke to a live person, he informed me that if I pay by debit card, I could get the receipt immediately but if I pay by electronic check, I would have to wait a few days; this conversation took place on Friday, December 6th. I called them again on Monday morning. I left my debit card on my person; I left it in the car, I went ahead and paid it via electronic check. My plans were to go by the apartment complex on the weekend and since the representative I spoke with on Mon, assured me I would get the receipt 24-48 hours when the check cleared, I figured I would be okay. I asked this man several times and he told me it depended on my bank but it should take no more than 48 hours. He took my fax number down and told me they would watch for the clearance and fax a receipt immediately. On Friday, of course, I had to go through the tedious and stressful process of calling several times and leaving several messages and I do not have that kind of time, to get a live person; I called so much, all the receptionists knew my name. Finally, I got a live person who informed me that I would not get the receipt for 7-10 days!!!! She claimed it was policy. I asked her if this policy was one that only she was aware of? My sarcasm heightened. I then, very frustrated, asked for a supervisor. She repeated the same policy. I informed her that I should have been told this days ago. Had I known this, I would have simply called back with my credit card in hand. Sensing my anger, she told me that if I can send her something, documents from my bank, she would fax me a receipt at the close of the business day. I repeatedly asked if it would be by that evening (Friday). She assured me it would. I faxed her a letter from the bank, my statement, from online, and the actual check, all showing the instrument was paid in full!!! A few hours later, I was notified that they could NOT send me a receipt because their bank has not received the funds!!! However, first thing Monday morning, I would get a receipt faxed to the number I provided about four times. By this time, I was vivid. I was misinformed several times by even the supervisor. This appeared to be an unstructured, unorganized, "fly by night" operation that had no clear policy in place. And if there was, it was apparently only communicated to the person that I spoke with at a particular time. All I wanted to do is pay a bill, get a receipt and get an affordable apartment to alleviate stress causing me stress related issues, causing problems associated with my heart. Then on Monday morning, December 16th, I called again. I anticipated at this time, another disaster. And of course, another disaster is what I received. Again, I called and I called and I called. Finally, I got a live person who informed me that they couldn't send me a receipt because they haven't heard from their bank. You guessed it! Another policy.. ..they might be able to fax me a receipt the next day, 12/17!!!! At this point, I will not be sending Choice Collections any more money by any means, whatsoever. If I owe anyone, doctors, hospitals, clinics, dentists, more exuberant fees, whether it is for services or any other frustrating mishaps, then I will struggle to pay it to YOU; if you can't accept teh currency, check money order, debit/credit card once you send it to those inefficient, chaotic, ignorant, non-professional, fly by night, folks, then guess what? You won't get it. I don't care if I hit the lottery. I am DONE!!! Not sure why I have to go through this headache to get folks to take money I am struggling so hard to make!!! Then on top of that, they always, always, when I did get a person, start the discussion with "this is an attempt to collect a debt and any information used will be for that purpose." Really? First of all, when Choice Recovery, when you collect a debt, you have to have efficient people who are available to take calls, listen to the voicemails, and when they are able to, RETURN the calls expediently, second, when collecting a debt, consumers have a right to get a receipt in a reasonable time frame, and finally, they should their POLICY, don't change it daily or hourly, communicate that POLICY to everyone in the organization so everyone will be informed and stick to it; they cannot change the rules in the middle of the game. When I spoke to the representative on Monday, December 9th he should NOT have told me that I would definitely get a receipt faxed within 24-48 hours if the POLICY that they apparently just made up is that I have to wait 7-10 business days!!! When I spoke to the representative and the fly by night Supervisor on Friday, 12/13/13, I shouldn't have been told I would get a receipt by the end of the day if I produce or fax documents showing that the instrument cleared, then to find out later, another untruth, I have to wait until their bank receive the funds. If I produced a document that stated, "cleared" why should I be concerned when your bank or whoever receives it? I owed it, I paid it and it cleared my bank. I deserve a receipt and I was informed I would get one, several times.. . Then I was told I would get a receipt on Monday, 12/16 around 10am, to be told I have to wait until the next day, well, this was the final straw. These people need to get their act together!!! I'm not calling anymore. I am not calling ever again, raising my already heightened blood pressure.. . Finally, I received the receipts but it was too late. The apartment complex I was interested in, could not hold it for me any longer. I will just hold onto this letter explaining my experiences with those ignorant, non-policy, "just make it up as they go" folks and hopefully, I will get a reprieve. If not, then I guess whatever it is I am looking to get, whether it is credit, an apartment, is just not meant for me. Credit Bureaus, please include this letter in my files. And I wonder why I have heart issues.. .???!!!

Desired Settlement: Consumer did not specify desired settlement.

Business Response: The consumer was informed at the time of payment of our policy to send paid-in-full letters once funds were authorized to our bank.  Unfortunately, we cannot gauge timeliness of transactions between financial institutions.  The consumer was mailed a paid-in-full letter to the consumer on December 17, 2014.

Consumer Response: I am appreciative of your taking the time to assist me in the above referenced complaint. I received the message from the business (Choice Recovery Collections) as follows: The consumer was informed at the time of payment of our policy to send paid-in-full  letters once funds were authorized to our bank. Unfortunately, we cannot guage timeliness of transactions between financial institutions.  The consumer was mailed a paid in full letter to the consumer on December 17, 2014.

Please allow me to respond to the easiest part of that statement: I never once considered holding Choice Recovery responsible for the timeliness or lack of timeliness of transactions by their financial institution. By the time, the payment (check) was received and processed by the bank, the situation was beyond irreparable. They are obviously overlooking the purpose of my complaint, which is exactly what I expect from such horrific personnel. If you review the initial complaint, I was informed of the time of payment several policies from several different representatives! My problem with that company was not that I wasn't informed of the policy, the problem was I was informed of SEVERAL policies. And they should be held accountable for such. They shouldn't be allowed to reach into the "air" to inform consumers of several policies.

This could have been handled so much simpler. I was informed initially that if I pay by credit card, I would have been given a receipt immediately and if I pay by check, it could take anywhere between 24-48 hours, depending on my bank. After two weeks and dozens of calls later, along with taking several Tylenols, I was provided with several different policies and told that each previous representative I spoke with was incorrect. I am not even sure they would have given me a receipt even if I paid by credit card. Perhaps they would have waited until they received the payment from my credit card company. Judging from the poor service I received, I vote for the latter. Either way, I don't have to provide anything else. Obviously, I paid the three bills I told them I was going to pay. I followed through with it. Had I tried to "pull a stunt" or wanted the bills to disappear, I would not have paid it. The phone records on either end could prove that I called numbers of times. The fact that I repeated the same policy as the company did proves that I am not making this up. At the end of the day, the policy in their response to my complaint was just one of the policies that I was informed of. It was just a few days and "headaches" later than it should have been. But either way, what you all decide to do with this issue is completely up to you. I have forwarded a copy to the three credit bureaus, which will be attached to my file. I am NOT paying those "fools" one more dime. I just thought you should know what kind of business they run. Have a good day.

Business Response: We are not required by law to mail letters to consumers validating they have paid their collection accounts.  This letter was sent to the consumer as a courtesy.  We regret that the consumer feels it wasn't sent quickly enough to meet her expectations.  If the BBB feels we have left any matter unaddressed, please feel free to let us know.

Consumer Response: I am sending this letter to you with regret that previous efforts to get the dispute resolved against Choice Recovery, Inc. are still pending. As a matter of fact, I haven’t received any documentation, letters, or any form of communication from them since January, I believe. Therefore, I am asking that you do not reflect in the BBB Business Review that the dispute is resolved.

Business Response: The consumer will need to clarify the matters left unresolved for a response to be issued.

Complaint: I had emergency surgery on my knee that went out a few years ago. Our insurance had a $2500 deductible, so we had to pay most of it. Shortly after that my husband's sales job income was lost or minimal for quite some time. I paid small amounts of the bill, but was sent to Choice Recovery Collections anyway. I have 4 kids, so their needs came first. I continued to pay small amounts when I could each month. Finally, we relocated for a better job situation, so I called choice and had about $600 left on the account at this time. When I spoke to a representative (****). He told me that if I had paid Choice and not the medical company a predetermined amount that I would have been able to keep it from reporting to my credit. I told them to look at the notes on the account and see that I was NEVER offered this program. When he looked, he saw that I was NOT offered this program and my credit has been being effected all this time, so I requested to pay my bill completely and have it totally taken off of my credit since I had been paying all along and the program they have to keep it from my credit was not offered to me. When I investigated further, the supervisor (******) told me that the programs are offered to every client. It was not offered to me and Choice is refusing to remove the negative marks on my credit. On Choice's website it states that they are not out to ruin people's credit, but they ruined mine and never offered me the program that would have allowed my credit to stay on good terms. I paid my debt in full as soon as I could, but Choice did not hold to their bargain of allowing my monthly payments to count for keeping them my credit in good standing. Now because of 1 medical emergency I have 5 negaive collection accounts. Please resolve!!!

Desired Settlement: Clear my credit of negative collections reporting in writing.

Business Response: The Credit Freeze program is not offered in every circumstance but feel this information was misrepresented to the consumer.  After review of the recent call with the consumer and complaint on file, we are willing to make an exception in this matter.  Choice Recovery has requested the removal of the information from the credit bureau reports.  Please give up to three weeks for each agency to update their files.  Should the BBB feel we can be of further assistance, please feel free to contact us.

Complaint: I received a notice from Choice Recovery dated 11/1/13 for $73.10 that was for ****** Co Emergency Services for the balance owed from an original invoice in the amount of $459.00 for an ambulance. The $73.10 was the co payment after ******* paid. I had another invoice in the same amount that was for my son and I thought this had been paid but when I reviewed I realized the one I paid was the one for my son. I received this notice when my father was being placed in hospice and it did not get open timely. I attempted to call beginning on 11/25/13 to make payment and resolve but no one would return my call and the number provided on the statement I received from Choice Recovery went straight to the voice mail box of ******* ****** and if you call it now it just rings forever, although my statement said to contact ******* **** ext. ***. I was finally able to reach someone on 12/2/13 by hitting 0 several times and also receiving notice from my credit monitoring that it was on my credit. I spoke to two different ladies, the first put me through to a supervisor, who I explained my situation to while crying continuously. She showed no sympathy at all and just stated she had to follow the fair credit reporting act. I paid the $73.10 that day with Conf#****** and she assured me that the next month it would be reported that it had been paid and she would send me a receipt. I never received the receipt nor has it been reported paid on my credit. I explained to her how important this was as we were attempting to refinance our mortgage to assist my mother in being able to keep her home which is in a reverse mortgage with my father in hospice. This was clearly an oversight and not intentional on my behalf and I paid the invoice immediately. I additionally wrote an e-mail to customer service on Choice Recovery's website on 1/10/14 with no response.

Desired Settlement: From what I have read on Choice Recovery's website, they claim to not be in the business of ruining consumer's credit just collecting for their customers. Therefore, I am asking that this negative report be removed from my credit report with all three credit reporting agencies asap, so I can rapidly move forward in attempting to assistance my mother in securing a home to live in. This is the only negative report I have on my credit. Sincerely,

Business Response: As a one-time courtesy to the consumer, we will remove this item from the credit reporting agencies.  Please give two to four weeks for the item to be removed.

Complaint: I receive credit alerts whenever there are collections posted to my reports. I immediately noticed a collection from Choice Recovery ###-###-#### for a charge of $580. I contacted them to which they were not able to find any account attached to me personally. I highly suspect this collection belongs to a different individual possibly with a similar name to my own. The Creditor in question belongs to a company of which I have never conducted business with also in a state of which I have never been to. To date this fraudulent collection has not been removed from my credit report. This fraudulent report is substantially affecting my personal credit with no merit. I have filed complaints with both the ******** Attorney General and Ohio Attorney General to assist with the removal of this fraudulent collection.

Desired Settlement: As mentioned above; to date this fraudulent collection has not been removed from my credit report. I have filed disputes with with the three credit bureau's to no avail. This fraudulent collection must be removed from my personal reports promptly. I am requesting the Better Business Bureau's assistance in this matter. Thank You.

Business Response: We will be happy to help *** ****** ****** resolve this matter.  We will need the complete credit reporting to do so as none of the information he has provided ties to an account in our system.  Once *** ****** provides us with the full credit reporting number, we will make the request to have it removed.

Complaint: I have contacted this company via the credit reporting agency asking for the last six months for a debt validation regarding this fraud account ######. However, I haven't received a response. They still manage to keep reporting it on my credit profile every month even though they have not validated the debt. At this time, I am asking this company officially to validate this debt by sending me a copy of the contract which contractually binds me to pay the debt as being reported on my credit file. If this request is not met in approximately fifteen working days, I will have no choice but to contact a consumer attorney in hopes to resolve this issue. I have tried for months to be civil in hopes of reaching a mutual resolution, but to no avail. The company has chosen to practice illegal and unethical tactics in an attempt to get me to pay a debt that doesn't belong to me. I did not open this account nor did I benefit from this fraudulent account that was obviously made in my name. Please govern yourselves accordingly.

Desired Settlement: delete fraud account from my credit file

Business Response: We have reviewed the complaint issued by *** ******* and found no requests for verification.  However, we have now verified the account with ************ ER Consultants for services obtained at ******* ********* on May 29, 2012 in the amount of $196.00.  The information was verified by name, last four of social security number, and date of birth.  I sent *** ******* a copy of this verification.  Due to the nature of the service (medical) and HIPAA privacy laws, *** ******* must sign and return the medical release included if he would like more information.

We consider this complaint closed.  Should the BBB have additional questions, please contact us.

Consumer Response: I reject the response because this company is reporting a debt on my credit profile to which I did not enter into a contract with them, This is the reason that they cant provide any real information is because there is none. I have never had an account with this company nor at the hospital as stated in their response. Therefore, I am requesting that this company cease and desist reporting this fraud account on my profile or I will have no recourse except to file a civil suit for violations of my consumer rights.

Business Response: After review of *** ********s most recent argument, we have concluded that it is the best interest of the consumer to remove this item from his credit report.  This will be completed by the end of the month on our end.  Please give the credit reporting agencies 3 weeks to update their records.  If *** ******* has filed an identity theft report with his local police department, we encourage him to send this to us or our client.

Complaint: On 12.9.13 In the process of buying a home, I was made aware of collection report by by lender on Choice Recovery for $13.59 for some Medical gear from 2009. In the interest of having the debt removed from my credit report, I agreed to pay the $13 plus $4 service charge if I could get an email receipt. I provided my discover card number, called back 2 hours as i had no email, and was told it did not go through, they needed another card so i provided my visa card. Again no email, I called back a 3rd time around 7:25 pm to 614.358.9900 and spoke to someone that said thier name was ****** *****. I was told by him that he sees my 2 requests for an email, but they are not permitted to send emails. I indicated I was told on 2 occasions by his company I would get an email, and if that is not possible I would like to file a formal complaint. Hunter said - "consider it filed" , he then said if I provided a self addressed stamped envelope he could mail me a receipt, or he could fax it to me. I then requested given misrepresentation of 2 other individuals about sending an email, could the organization provide the stamp and send me the receipt that this has been removed from my credit report. He said he would check with his manager and give me a call. When I asked his name and he told me ****** ***** - my expectation for a return call dropped and I have yet to receive one.

Desired Settlement: Since I have no knowledge of the $13 bill from 2009 that this item be removed from my credit report. In addition, because I have paid the amount plus a $4 service fee and was told on 2 occasions I would receive an email confirmation and did not, there should be some corrective action performed in the area of training to avoid future misrepresentation.

Business Response:

We apologize for the original receipt email not being delivered.  We were unaware of a technical issue with our payment processing center.  I have emailed *** ***** a paid in full letter to replace the credit card receipt.  Additionally, we have further trained  the consultants who were involved in the confusion of the promise of an email.

Complaint: My husband and I are preparing to buy a new home, when we pulled my credit report we saw a collection from Choice Recovery. We had not been contacted by them and was not aware that we owed anything. When I called them they refused to delete the collection from my credit report, despite the fact that I had never been contacted, and offered to pay the $33 collection in full. I spoke with a supervisor who told me it was unethical to delete a collection, despite the circumstances. I feel it is unethical that I should have a collection on my record of which I was not aware.

Desired Settlement: I would like the collection deleted from my credit report after payment in full is made.

Business Response: After review of our records we have found that we did mail the consumer, ********* *******s, notification of the debt and the ability to dispute or ask for verification on August 4, 2011.  No return mail was received on this address.  We made attempts to contact the consumer by phone, however, the number given by our client was disconnected.  Because we strive to change the perception of collections, we will remove this from the consumer's credit report as a one-time courtesy.  The balance of $32.65 is still due in full to our client.

Complaint: I recently had my credit report pulled for a mortgage loan and was advised that I had three accounts in collections. I was never made aware of this or the bill being presented. I contacted the company, and by the advice of individuals paid two of the three accounts while waiting to receive proof of the debt. I have been waiting over a month for a receipt and also proof of the debt and still have not received either. I have contacted the company twice since asking, and was advised that proof was sent out. I still have not received anything. The company refuses to also take the accounts that have been paid off my credit report.

Desired Settlement: I would like the company to remove the accounts off of my credit report, due to failure to deliver proof of debt and receipts.

Business Response:

The consumer is correct; the receipt letter was requested, but it appears that for some reason, our system did not send it. My apologies. I have attached scans of these letters to this response. In regards to the one remaining unpaid account for $118, I am unclear on what the consumer is requesting when she asks for "proof". I do see that a statement was successfully sent to the consumer on 8/8/13 for that remaining account. The account details if that is helpful are: $118.11, date of service of 6/2/12, placed for collections on 2/6/13, creditor was********* * ************** Associates, patient was listed as the patient. Due to HIPAA regulations, we do not have access to medical records or what services were performed. If i can do anythign further to assist in the resolution of this complaint, please don't hesitate to contact me. I will help however I can.

Consumer Response: Due to the Fair Debt Collection Act, copies of bills or proof of debt in writing is required within 30 days from consumer requesting it. I have requested copies of these bills several times because I have never received them, even from the original debtor. I was told that all bills would be covered by hospital financial aid and still have not received any proof of debt in writing. Also, I would like the accounts removed from my credit report because the company failed to make me aware of the collection before placing it on my credit report.

Business Response:

I have already given all account details regarding this outstanding balance. I am unsure what the consumer is requesting as "proof". If the consumer is requesting an itemization of charges, then we are required to collect an authorization from the consumer. We are subject to HIPAA regulations and cannot obtain a detail of charges without it. I have attached a release form to this response. The consumer may either return it through this complaint, or mail it to the address at the top of the release.

Consumer Response: Due to the fair debt collection act the company is required to provide proof of debt in writing within 30 days of the consumer asking. I have yet to receive this. Also the company did not confront me before submitting this debt to my credit report. I was never made aware of these accounts before being placed on my credit.

Business Response:

As stated in the previous response, if the consumer requires detailed charges, the signed authorization is required. We initiated a validation request with our client, and they have validated/confirmed that all of the account information is accurate, as well as the balance of $118.11 is still owed. I am unsure what further "proof" the consumer is requesting. We are required to validate with the original creditor, which we have done. If the BBB feels i have left anything unaddressed, please let me know. I will do whatever I can to assist in the resolution of this complaint.

Complaint: While battling breast cancer I had a series of lab tests done. I never received a bill for these tests until after I was notified they were sent to collections. The creditor assured me that the collections would be removed from my credit report as I never had a chance to pay them. At this time I set up a payment plan with the creditor an paid all my bills on time. After applying for home financing, my mortgage lender made me aware that the collections were indeed not removed; because of this, I have been denied for financing. According to the FCRA, I have to be given the opportunity to pay my debt before being sent to collections.

Desired Settlement: I would like the collections deleted from my credit report immediately so I am able to obtain a home loan. The following are the account numbers for the collections listed on my credit report: ###############

Business Response:

The consumer is correct; Our notes indicate that as a courtesy, we agreed to give the consumer the opportunity to pay the balance before credit reporting. The consumer paid this account to a zero balance, and it appears that the account was not properly flagged in our system. It was not done intentionally, and I have requested immediate deletion from the credit. This should be complete withing 24 hours. We spoke with the consumer today and confirmed the same. We apologize and will do whatever we can to help resolve any further issues.

Complaint: I had an account with **** ****** cable that went to collection in 2011 I paid this item off in august 2012.**** ****** insurred me that they would get with there collections agency Choice Recovery, I pulled my credit report July of 2013 and Choice Recovery is still reporting me to all 3 credit bureaus as of 06/13. I Called choice recovery and no one can help me, so I called **** ****** back and they put in a ticket on july 24 2013 to choice recovery to remove the negative item off my credit and send me a paid in full statement. I have faxed documents over to choice recovery that I had received from **** ****** cable office on leo st Dayton, oh. To show them there is no amount owed on this account. The case worker on my account has never returned my phone calls I have called multiply times and he wont return any calls. So I have talked to multiply supervisors and they were no help as well they gave me the run around as well. the only help was when I talked to a agent supervisor **** and he did he follow up with me about how he could not due expedited complaint with time warner. This has been an ongoing issue with Choice Recovery, all I want them to do is update my credit and send me my paid in full letter. There should be some type of compensation for this in some way. this item has been negatively reporting on my credit and effecting my credit score.

Desired Settlement: Item removed from all 3 credit bureaus, and paid in full letter from choice recovery inc

Business Response:

The consumer initially contacted us regarding this account on 8/6/2013 and indicated it had already been paid to the original creditor. At that point, we submitted a request to **** ****** Cable to verify. **** ****** contacted us on 8/12/2013 and advised us the balance had been paid in full. I feel that a 6 day turnaround for investigating a collection account from December 2010 is well within acceptable, and feel that filing a BBB complaint is unwarranted. In any event, the original creditor has reported that the acount was paid, and the balance has been corrected in our system. The account was placed for collections on 1/5/2012, and the consumer states that they paid it 7 months later. We are sorry for the issues that the consumer is experiencing; these problems arise when payment is made to the original creditor instead of to the agency handling the past due balance. Again, the account record has been corrected and will no longer show as past due on the consumer's credit bureau. If the BBB feels i have left any issues unaddressed or that i could do anything further to aid in the resolution of this complaint, please do not hesitate to contact me.

Complaint: This company called and spoke with my children when I was at work about court dates and proceedings as a scare tactic and fishing expedition concerning a debt that has not been verified. Also, phone calls two or three times a day placed to my residents with silences of up to 3 minutes before someone speaks and then busy signal,is unexceptionable. If this is what a A+ rating means I will no longer support BBB as a consumer advocate.

Desired Settlement: BBB rating decreased to reflect shady business practices

Business Response:

This complaint is unfounded and i show no record of ANY accounts in our system for a consumer by this name, and no record of any consumer in our system with the address listed. Also, our company does not litigate against consumers, so we would have no reason to mention court dates, especially to someone other than the debtor. The consumer did not list the number that was allegedly called, so there was no way for me to search by that method, but I would be more than happy to, if the consumer will supply it. Is it possible that the consumer is confusing us with another agency? Did the consumer get our number from caller ID, or look us up online? If he could please supply us with this information, I promise to investigate it further. Our A+ record has been earned by our commitment to treating consumers differently than most agencies. I will do whatever i can to aid in the resolution of this complaint.

Complaint: My daughter **** ***** had surgery by *** ****** an oral surgeon in ****** **** on November 3rd of 2011. At the time she was 17 and I ******** ****** took her into the office for 4 wisdom teeth and a biopsy for a lump on her tongue to be done. I signed the paper work and she had no part in that due to her being a minor. I was told the insurance company's would pay most of the cost and I paid out of pocket what was due. 2 months later I recieve a bill for 263.00 due to them. I in turn called them and told them I did not owe them any money. They then in turn sent it to thier billing office, who sent it to collection agency Choice Recovery. I am told by thier billing office that when collections turned it over to the credit agencies they reported it in my daughter **** *****'s name who was a minor and had no idea of this issue. This collection agency has caused my daughter to have bad credit and did this while being a minor. If this was done to us, how many other minors are being affected to? We have had a very difficult time trying to figure why should could not get a loan for college this year and all because of this error made by them. This will affect her credit and is not legal or right!

Desired Settlement: I feel they are at error and the collections agency had been illegally sending this bill to my daughter and reported it to the credit agencies illegally. This should be resolved by getting her report clean and not going on mine. We had no idea this was the case and they should be financially responsible and legally responsible for this.

Business Response:

We have already spoken with the consumer and informed her that this account was sent to us by our client in the minor's name in error. We also informed the consumer that the account has been removed from the minor's credit report (E-Oscar deletion # ####), and that the unpaid balance has been entered into our system under the correct responsible party, ******** ******. The account for **** ***** is no longer open or active.

Consumer Response: I was told by ****** at the collection agency for **** *** ************* surgery centers that the so called error occured from Choice Recovery. They are the persons who received the correct information and then in turn sent the incorrect information to the credit agency's. This in turn caused my daughter who at the time was only 17 to have bad credit scores. That is not ok with me. It has affected her and has caused many problems this year for her to get a loan for college this fall. They should be held accountable for this mistake and if they did not do this then the billing center for the surgery centers should be held accoutable for it. This sometimes takes years to come off of credit scores and now we dont know when it will be off of all 3 credit agency reports. We can't request to many times or it will then reflect a bad score on her credit for to many inquiries.

******** ******

Business Response: As stated in the previous response, this entry was deleted from all three credit bureaus on 7/12/13 via the national E-Oscar system. The control number for the deletion was ######.

Complaint: This BBB complaint is being sent due to lack of contact from Choice Recovery (listed as CR throughout the rest of this complaint.) Calls to the number listed go unanswered and messages left are not returned. My wife, J******* ********* received a collection notice from CR for a hospital bill that should have been covered by insurance. We contacted the hospital, ******* **********, and resolved the issue with them. The bill was credited due to the insurance mistake and the account was pulled from CR (per *******).We just received another collection letter from CR today showing the balance is still owed. I called the hospital again and verified the balance had already been credited and pulled from CR.Multiple attempts to reach the contact person noted on the collection letter, ********* *** at extension ###, have failed. She does not answer her phone and DOES NOT return your call after multiple messages. Business Response:

The consumer states they are having trouble contacting a representative in our office, but any person here would be more than willing to help them. As far as our efforts to contact the consumer, letters were sent on 5/15/13 and then again on 6/14/13. Telephone attempts were made on 5/15, 5/20, 6/05, and 6/24. All were unsuccessful. Business Response:

As we have still haven't gotten a response from *******, I have closed and returned the account from our collection system. There will be no adverse effects to the consumer. Complaint: On February 22, I received a letter from FFCC stating that I had been turned over to collections and as the letter stated "If not paid, this debt will be reported to a national credit bureau". I contacted them, and they stated that I had 30 days to pay or they would report it. I notified them that I had disputed the charges and was planning on contacting the physician who I had already been in contact with. After no progress with the physician, I called and paid the account through FFCC on March 8th, well within their time frame. After that, I was notified that the account was reported to all 3 credit reporting agencies. I followed the guidelines of FFCC, but was still reported eventhough they stated that it would not be.

Desired Settlement: I would like FFCC to remove the collection status from all 3 credit reporting agencies. I do not want a refund through FFCC as I am proceding with a complain with the physician.

Business Response:

I have reviewed the account and complaint. The consumer's statement seems to conflict with the notes on our file. The consumer states that he contacted our office and was informed he had 30 days to pay this or it would report to his credit report. Our records show no record of contact from this consumer before 3/8/13, when he called BECAUSE it was reported to his credit, and he requested removal. To clarify, the timeline is as follows:

1/7/13 - Our client placed this balance in collections.  1/8/13 - FIRST notice goes out informing him of having 30 days before eligible to report to his credit. 2/15/13 - After no response from the consumer, a second letter went out informing him that the account will now be reported to the credit bureau.  3/8/13 - The consumer called into our office, paid the balance, and asked for removal from his credit.

An account is eligible for reporting to the credit bureau after 30 days. This balance was paid on day 60. I find no inaccuracies in our reporting.

If the BBB feels I can do anything further to aid in the resolution of this complaint, or that I have left any matter unaddressed, please feel free to contact me. I will do whatever I can to help.

Director of Operations - FFCC Columbus, Inc.

Consumer Response:

They sent a letter on 2/15 and it stated "if not paid this debt will be reported to a  national credit bureau"

I paid the debt within 30 days of the letter.

Business Response: The consumer is again referencing the SECOND letter we sent him. On 1/8/2013, a first notification was sent to the consumer notifying him of eligibility to report to the credit if not paid within 30 days. As stated in the previous response, this account was paid after 60 days of placement.

Consumer Response:

I am rejecting this response because *** has clearly mis-stated the facts. Please see his statement below:

" 1/8/13 - FIRST notice goes out informing him of having 30 days before eligible to report to his credit. 2/15/13 - After no response from the consumer, a second letter went out informing him that the account will now be reported to the credit bureau.v"

I did not receive a 1/8 letter, and I supported the claim that the 2/15 letter did not inform me that the account was being reported to the credit bureau.

I clearly proved with my attached document that the letter stated "The account listed is due in full. if not paid, this debt will be reported to a national credit bureau." NOWHERE did the letter state the the claim was reported to the credit bureau like he previously stated.

It is obvious that *** is unaware of the practices within his business as he doesn't know what the letter states.

If I was provided an initial letter, I would have disputed the claim as I am not the responsible party for the bill. I at no point signed for care of that I would be liable for any charges.

*** and FFCC clearly did not follow any of the laws governing credit reporting.

I ask *** to provide a copy of the first and second letter which was alledgedly mailed and any/all proof of mailing/receipt.

***, if you have any questions, please feel free to call at 937-360-3171

Business Response:

The consumer WAS sent the letter. I am unsure why he "did not recieve" the initial notice when the second notice was delivered successfully. Even taking that into consideration, the consumer stated that he recieved that notice on 2/22/13, and did not contact us until two weeks later on 3/8/13. In the interest of resolving this complaint on a paid account, I have requested deletion from the credit bureaus. Our company has been fully compliant with the laws; in fact, we are not legally required to send notices to the consumer before credit bureau placement; we do so as a courtesy. In short, the consumer is getting their desired resolution, as originally requested. Full deletion of this entry from his bureaus.

Complaint: $50 False claim on my credit report. A doctors office claimed I missed an appointment. I had to call 6 times to get through to the correct person. Each time a spoke with someone they either gave me incorrect information, transferred me to to voice mail or dropped the call. Their website makes it almost impossible to pay online. They do not accept the normal means of payment. They do not except Visa, MasterCard, or any other form of credit card, debit card or PayPal. You are required to enter you personal banking information, then take a blank check from your checking account a discard it. I makes no sense and there are no instructions to guide you.

Desired Settlement: I would like this false claim removed from my once perfect credit report and reimbursed 5 thousand plus dollars for the penalties I will receive refinancing my home.

Business Response:

I am unsure of the main focus of the consumer's complaint. The consumer claims the bill for $50 was false, and due to a missed appointment. It seems that if there is a discrepancy as to a missed appointment, that would be a complaint against the opriginal creditor, not the collection agency they hired to collect that unpaid balance. I cannot answer for the office of Dr. ******* ***** MD. We are simply the agency they hired. I feel as if that part of the complaint is not warranted to be filed against our company. In reference to the remainder of the consumer's complaint, he states that we gave him incorrect information but does not reference which information we gave him, or how it was incorrect. The last part of the complaint is that we do not accept online credit card payments, only checks. I do not believe that the types of payments we accept online are grounds for lodging a complaint with the BBB. Additionally, we spoke to the consumer on 2/29/2012 (before they were placed on his credit bureau) and he stated that it was an error in billing and that he would look into it. It wasn't until a year later that we heard from him again regarding this matter.

Regardless of these facts, our client (the office of Dr. *****) contacted us on 2/22/2013 and asked that we remove these entries from the consumer's credit bureau once they are paid. The accounts now carry a zero balance, and they have been flagged for removal from the credit bureaus. If the BBB feels I have left any issue unaddressed, or that I can do anything further to aid in the resolution of this complaint, please feel free to contact me directly. Complaint: On 11/06/2012, I observed that the FFCC-Columbus One was reporting a fraudulent accounts #****,#****, and #**** on my credit file. I contacted the company by mail and phone asking them to validate the account that was erroneously being reported on my file. I asked in writing and by phone for this company to provide me a copy of the contract signed by me that contractually binds me to this debt in question. To this date, I have not received any information regarding these accounts. However, it is still being reported on my credit file. I know that my rights have been violated and I am insisting that this account be resolved expeditiously. I would like to resolve this matter without consulting legal counsel but I will not hesitate to do so if this matter is not addressed professionally without this company practicing unethical and illegal procedures.

Desired Settlement: delete these accounts in accordance with the FDCPA.

Business Response:

I am unable to locate the accounts in our system that this consumer is referring to. The account numbers given are partial numbers, and the only ******* **** we have in our system lists a post office box address. Additionally, the possible that I have located shows only 2 entries, and this consumer states she has 3 from us. I also show zero correspondence from the consumer on that possible account.

Unfortunately I cannot accurately respond to this complaint without having the proper information from the consumer to locate the accounts she is referring to. If we could get full account numbers, or even dollar amounts of the alleged entries, it would help a great deal. Once we have that information, I would be more than happy to help.

Consumer Response:

This company does not know anything in reference to these accounts . However, they are still reporting thses accounts on my credit file. How is this possible? The credit bureaus are supposed to support fairness and ACCURACY when reporting these accounts on ones credit file but I know for a fact that theses accounts are not mines. It is more than obvious that this company does not know if these accounts are mines either. This has been a nightmare for me. At this point, I demand these accounts be deleted as reported by this company.

Complaint: My mother and I received letters in the mail today regarding charges from a doctor's office in Fleming Island, FL that we have never visited. I have researched the FFCC, and judging by the complaints that I have read, I am more than sure that they will not cooperate with me in a professional or understanding manner. From what I have read, they send bills to people that they do not owe, and expect them to pay them or it will affect their credit score. I am a 21 year old college student who has yet to even establish credit, let alone have anything billed to me. Therefore, I am not prepared to allow a fraudulent debt collection company damage my credit before I have even begun to establish it. I refuse to hire a lawyer to handle this situation, and I am sure that is what the FFCC is hoping for. Because initially, paying the false bill would be much cheaper than hiring a lawyer for my credit's sake. However, I will not pay a bill that I do not owe. I am very disgusted by this incident.

Desired Settlement: The cancelling of these false charges and the erasure of this from my and my mother's credit report. Our credit and our wallets will not suffer for this fraudulent behavior.

Business Response:

Reading this complaint, the consumer's only complaint was that she recieved a notification from us regarding an account placed for collections. And her complaint seems to be based on what she has "read" about our company? She stated "I am more than sure they will not cooperate with me in a professional or understanding manner". She then ends her complaint that she is "disguested by this incident"... I am unsure of the incident she is referring to.

I am unsure how to respond to such a general complaint, based on an "assumed" lack of cooperation, but I will say the following. The consumer seems to be speaking for herself and her mother. Since her mother has not filed a complaint, I will not reply in regards to that, to protect her privacy. As far as an account in the consumer's name, she is 100% correct. Upon recieving this complaint, we vaildated the debt and the original creditor had made a mistake and had ******* listed as the responsible party, although she was a minor at the time of service. This was corrected, and put in the name of the correct responsible party. This could have been fixed with a simple phone call to our agency. I think if the consumer would have contacted us, she would have been pleasantly surprised. We have an A+ rating with the BBB and work very hard to treat people the way we would like to be treated.

If the BBB feels I have left any issue unaddressed, or can do anything further to assist in the resolution of this complaint, please feel free to let me know. I will help however possible.

Consumer Response: I have reviewed the response made by the business in reference to complaint ID *******, and find that this resolution is satisfactory to me.  Though, the representative who responded could use some work in professionalism when responding to a complaint.  Taking a customer's complaint personally is not appropriate.  I understand that I was relatively angry when I made my complaint, considering I assumed that my credit would be damaged because of this mistake.  However, they would be wise to validate who is working in their customer service department.  Their reviews are terrible in regards to customer service, and they wonder why I was so hesitant to call.  Hence, why I came to you, the BBB.  Thank you.

Complaint: I was spoken to by a highly rude and condescending representative from this company. I asked if I could please obtain a written statement of my bill to be sent to our new address as I had lost the other statement in our move. She argued with me that I did not need a paper statement even though I would like it for my records. She insisted on not sending a new statement to our home. I have no idea why. I am requesting simply that a new statement for what we currently owe be sent to our home at our new address on ******** Lane in Hilliard, Ohio. I feel like it is not an unreasonable request. I also feel like someone should explain to the last representative I spoke to that you should never treat people in such a rude, unprofessional manner.

Desired Settlement: I would like to have the statement sent out to our new address and for an apology from the representative or the company stating she has been informed that her behavior is unprofessional and she will not act this way toward someone else.

Business Response:

I reviewed the call, and I am sorry that consumer was unhappy with the conversation. Unfortunately the consumer hung up on our representative without updating her address on file. Upon recieving this complaint with a current address, I have manually addressed and sent a letter to the consumer at her home address, per her request.

If the BBB feels i can do anything further to assist in the resolution of this complaint, please feel free to contact me directly. I will assist however possible.

Consumer Response: I still feel like I am not being taken seriously.  The reason I hung up the phone was due to being spoken to in such a rude and unprofessional manner.  I used to be in customer service myself and would never in a million years speak to someone in that manner.  I feel that I should receive and apology from the representative or statement that she is being held accountable for what she did to make me feel like I had to hang up the phone.  It was completely disrespectful.  I would have gladly given her our new address had she simply been accomodating to begin with!  Again, I personally would have never treated a caller in this manner when I worked in this field and feel that she also needs to be professional at all times.

Business Response:

I have listened to the call in question, and I do not feel that our representative was rude. I could see how the consumer felt the comment made by the representative was condescending, but she was simply asking why the consumer needed the letter, since repeat letters are not typically something we send out. The consumer states that she has been "in customer service" herself in the past, but it is important to remember that we are not customer service. We are a collection agency attempting to recover unpaid funds for OUR customers, the original creditor. That being said, we try to treat everyone the way that we would like to be treated; so in that light, i do apologize that the consumer had a bad experience. As stated in the previous response, I have personally mailed the letter requersted to the consumer today. If she would choose to pay the past due balance, she can do so by mailing it to the address on the letter.

Consumer Response: Again, I am being told that the representative was not rude.  She was clearly rude.  Also, I did indeed do collections AS WELL AS customer service, and I KNOW that there is a way to treat a caller and a way to be unprofessional and immature. Until I hear that the representative has been fully informed that she needs to remain professional and NOT condescending to ANY caller, I am not going to withdraw this complaint.

Complaint: I received a telephone call from a FFCC agent on January 18, 2013, regarding an unpaid debt to my physician in the amount of $436. At the time of our conversation, I provided the agent with my credit card information and authorized a payment of $100. I also made monthly payment arrangements of $25 or more, if possible, commencing February 18, 2013. Following our conversation, the agent immediately withdrew the funds from my credit card then reported the debt to all three credit bureaus. I was notified by my credit monitoring service of the negative report. When contacted, the FFCC's agent abruptly advised that the $25 payment agreement did not meet their standards and she felt I did not want to pay my doctor. I did not understand how she came to that conclusion when I immediately paid $100 and set up the payment arrangements. I believe FFCC reported my debt without giving me a chance to pay in good faith. My first payment is not do until February 18, 2013. As it's only February 11, 2013, FFCC should have waited to see the actual amount of my first payment or advised that the amount was not sufficient at the time it was agreed upon. On Friday, February 8, 2013, I was able to pay the balance in full. This payment was made directly to the physician's office. I was the process of refinancing my home and do to their actions, obtaining financing now is highly unlikely. Their actions has dropped my credit score from 756 to 613. THEIR ACTIONS ARE HIGHLY UNACCEPTALBE.

Desired Settlement: I would like for FFCC to TOTALLY remove their negative report from ALL THREE of my credit reports.

Business Response:

The consumer was advised in the initial conversation that the account would be eligible to report to her credit if it remained unpaid. The consumer was also offered on that call, an opportunity to participate in a credit freeze program, which would allow her to set a secured payment schedule, which would hold the credit reporting as long as the terms were kept and payments cleared. The consumer declined to take advantage of this program. The consumer was made well aware of credit reporting.  The account was eligible to be listed on her credit file, and was done so justly. The listing on her credit was not a result of our actions, as she claims. It is simply the result of a past due balance from July 2012 remaining unpaid for nearly seven months.

In any event, the account has since been closed and returned to the original creditor, which will result in the removal from the credit bureau. So, the accounts will be removed, as the consumer has demanded.

If the BBB feels i can do anything further to aid in the resolution of this complaint, or that I have left any issue unaddressed, please feel free to contact me directly. I will do whatever possible to help.

Consumer Response:

I wholly disagree with FFCC's account in initially offering me an opportunity to participate in a credit freeze program, which I declined.  It totally makes no sense that I would make an initial large payment, set up payment arrangements and then tell them 'IT'S OK TO REPORT ME TO THE CREDIT BUREAU".  Who does that?  Although the account was outstanding for seven months due to issues with my health insurance, FFCC failed to mention that they acquired this account in January 2013, not seven months ago, as they are leading you to believe.

With that said, I have reviewed the response made by the business and find that this resolution is satisfactory to me.
