            Arborist wrote a proposal for $16,000.00 to remove trees, etc. in preparation for building a home at *** ******* ****. ***** ******* paid half as a downpayment ($8,000). Arborist removed some undergrowth and scraped the gravel driveway. ***** was soon asked to pay $5,000.00 more. Arborist claimed that the work was completed and asked for final payment. At this point, ******* ******* (*****'s son) met with the arborist at the work site to demonstrate that the work was not completed. Michael, witnesses, and the Arborist walked the site and identified 25 trees, 2 piles of logs, etc. that still needed to be removed to complete the job. There are detailed notes of this meeting in a letter sent twice to the Arborist. Arborist committed to returning to the worksite to complete the work. Arborist never returned over the course of more than a year, even though he responded affirmatively to multiple texts and calls. ***** has paid $13,000.00 for work that is substantially incomplete.
