Problems with Product/Service
Read Complaint Details
Complaint: ****** and ***** ***** (the *****s) entered into a contract to add an addition to their home with Timber Construction and ****** ********* (the owner) on 3/23/16. At that time the contractor didn't know the city setback variance requirement and advised he would confirm with the city. Prior to confirming with the city, he presented the *****s with a contract for the work and requested a down payment of $11,850.23 which the *****s paid. On 4/4/16, Mr. ********* submitted an application to the city of New Braunfels asking for an exception to the setback variance to be made. On 4/28/16 Mr. ********* and the *****s appeared before the New Braunfels City Council to obtain their verdict for the setback variance request. The city council did not approve to grant an exception to the setback variance because they could not identify a hardship. After the hearing, Mr. ********* advised he would review the amount to be refunded to the *****s after calculating his cost for expenses and work done up to that point. He also agreed to provide an itemized receipt and refund check on 4/29/16. As of 5/2/16, the *****s have not been able to reach Mr. *********. Messages have been left several times and he has not returned their calls. Mr. ********* indicated the $11,850.23 was placed into an escrow account, therefore he should be able to refund the *****s promptly.
Desired Settlement: The *****s would like for Mr. ********* to refund them for the down payment they made for the addition less his expenses and provide documentation illustrating how he derived at the amount he refunds immediately.
