Complaint: Greenwood Construction Company was hired in September 2012 to restore a church in Seguin, Texas. His company estimate according to the contract was for a job not to exceed $92,000. We have paid him a sum of $86,000 yet the church is still not completed. Several days and even months would go by and he would not be on the worksite doing any work. He did leave the building's back wall completely open when he removed the wall and he left it open to the elements. He also did no work on the roof which was open with holes. The exposure has left the wood rotting and in return has created more problems. For $86,000 all that was done was leveling of the building, new doors on the front, insulation of the walls, and some particle electrical work. No painting, Septic System, Bathrooms, Pastor's Study, Flooring,Roofing, AC/Heating duct work, Windows, as specified in the original contract was ever done. He did admit that he mismanaged the funds, yet it is now 2015 and this is going on 3 years with no work completed. He paid himself and others, with no monies going to the repairs of the church. I am looking for him to come and complete the job that should have been done as per the contract, which states the work would be completed within 6 months to a year. He is asking for more money to complete the project, yet as per the contract you are owed only $6,000 more and the bulk of the work is still not done. He needs to complete the job and generate the funds to finish it.

**** ********* Construction was contracted by ****** ****** to do Restoration work on a church 147 years old.  This project according to the Committee and the State Historical Society, was to be restore to its originality as much as possible without changing, very little of its existing materials.

    The Church was completely taken apart by a numbering system. Done by a Licensed Architect and Current members of the State Historical Society.

    Board by Board were removed and replaced, the Materials of the entire walls were re-enforced by Details and Drawings provided by a Licensed Structural Engineer. This project was extremely costly, and the Church was aware they would need additional fund's to complete restoration for the 147 year old edifice.=

    This was not a Remolding project, It was a Restoration of an Historical landmark. The Committee was knowable  they were attempting to get Historical Benefits and Historical suffience by Restoring the Church to its Originality.

    We have provided all Documents and notes to Capote for examination. The Committee is split on their decision as to which way the church is heading.

    We have, and do continue to try to work with the Church to get this Project Completed.

I am rejecting this response because:
  The details presented are not true.  The contractor presented the contract to the church and the committee.  It clearly states that the project would not exceed a cost of $90,000.  We managed to raise $86,000 to start with $4,000 as more to come.  On the contract (which was breached) it clearly states that $12,000 was needed for phase I which was paid.  Phase II was also paid which consisted of leveling the building, the roof, the inside flooring, air system, a septic system, with bathrooms, a pastor's study, along with painting and electrical work.  A cost of $37,000 was laid out and he needed $17,000 to start.  All this was paid to the contractor.  This left a balance of $40,000 which was the final phase III of the job.  Upon giving him the $17,000 it states in the contract that a contract has been secured with Ace Total Renovations to do the leveling of the church.  I called the company and the owner stated that he had never been to the church and a contract was never secured with him.  He finally came to the church because he was mad that someone whom he did not know is using his name falsely.  Upon inspection of the church he informed us that the church has never been leveled.  This was also the same thing told to us by 2 other contractors.  The church was left open to the elements when the back wall was removed, and the roof has openings where you can see the sky.  We had several meetings trying to give the contractor a chance to come back and finish up the job, but to no avail. At times he would come to the worksite and do work, but most of the time no work would be performed for sometime 2,3,or 4 months.  At one meeting I asked him if he mis-managed the money and he admitted to me and others in the meeting that he did.  If pictures of the church are needed please let me know, because I have them.  This project was started back in 2012, and it is now 2016 and the church is in worst shape than when they started.  The contractor also said he made $34,000 in labor on the church which goes to say that the team paid themselves first and neglected the church completely. All of the $86,000 has been depleted and everyone from the team has vanished as well. I secured the help of an Attorney and he stated that if we wanted to move with this case we would win "Hands Down"!!, because this is clearly a Breach of Contract.
