Complaint: The basis for my dispute is “ FINANCIAL CONTROL SERVIC,******* ****, VP” 108XXXX was required to notify me prior to 2/2/2016, or no later than 30 days after furnishing the negative information to credit bureau reports, in writing...under such section 623, subsection (7)(A). However, in my records I am unable to locate documentation you complied with this requirement, which is a violation of the FCRA & FDCPA. Also, FINANCIAL CONTROL SERVIC,******* ****, VP failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA 809, which is $1000 per violation and the state of TX allows treble damages. Under 809. Validations of date and Mini-Mirandi under Section 807(1) FINANCIAL CONTROL SERVIC,******* ****, VP failed to send me my initial communication before placing this alleged item on my credit reports further violating the FCRA, with $1000 per violation. FINANCIAL CONTROL SERVIC,******* ****, VP is held liable as well for defamation and in the state ofTX a creditor is who collects their on debt is considered a debt collector under TDCPA. Smith v. Heard 980 S.W.2d693(Tex.App-San Antonio 1989 reh.den.)citingMonroe v. Frank 936 S.W.2d 654(Tex.App-Dallas 1996 writ dism'd w.o.j.)

Desired Settlement: I will if the account is not taken back and removed from any and all credit bureau reports, I will turn this over to **** ******* FDCPA and FCRA national Attorney to look and take over this complaint. Therefore, provide me documentation of notification (i.e. a copy of the notification sent), and proof that it was delivered to me in a timely manner (i.e. a dated certified mail delivery confirmation with my signature).. 30 days before or 30 days after ( 2/2/2016) the date it was opened with the bureaus as you have listed

Complaint: I contacted Financial Control Services via USPS certified mail, (Certified Number: **** **** **** **** ****) on April 27, 2016 for debt validation per Texas Finance Code 392.202 for two accounts in total of $117.00 each, from original creditor South Texas Radiology Group. Financial Control Services has failed to respond to my debt validation request. They have essentially admitted, per Texas Finance Code 392.202(b)(2), that the debt in question is inaccurate. As such, all collection efforts on the debt must cease and any derogatory listing should be permanently removed from my consumer credit reports. Last 4 of my social #**** ****note: Account number not provided to me on consumer credit reports.

Desired Settlement: Remove items off my consumer credit report, and I will find this matter closed.

We have responded to consumers dispute on the 27th, we attached itemize statements. The open date is not May 1, 2007, date opened is 10-11-10, letter sent out to consumer on 10-12-10 informing of accounts in collections. Consumer never called our office.  We left numerous messages with no return call and we received no return mail. Feel free to deny the request, after I have proven that this debt is inaccurate, and has been damaging my credit for the last 6 years. Complaint: I recently pulled a credit report to find that there were several accounts in collections from Financial Control Services, when i contacted them by phone to verify the debt the representation claimed that documentation was mailed to me regarding the debt, but they never received a response, i verified the address that the letters went to and the rep stated a Austin address, i advised the rep that i havent lived in Austin in over 8 years and the address that was provided was never a residence of mine. The rep stated that she couldnt give me anymore information over the phone, and that i would have to send a validation letter to get furthur information. I sent a validation letter to FCS requesting evidence regarding the alleged debt. I sent this certified mail requesting a list of documentation that proves this debt belongs to me, such as, a copy of any legal instrument bearing my signature, which supports your basis for the continued reporting of this alleged debt, an itemized accounting of all debits and credits on the alleged account for the entire history of the account, the assignment or purchase agreement for the alleged debt between your company and any other entity, and to prove the statue of limitations has not expired on this on this account. I received a response from FCS stating that the debt was investigated and no actions will be taken on the account. FCS did not provide proper validation on this debt as requested which violates the fair act reporting law, is a violation of the fair debt collection act, and is defamation of my character.

Desired Settlement: Due to the fact that FCS could not provide the proper validation documentation I am requesting that this debt and any debt listed under Financial Control Services be removed from all 3 credit reporting agencies

We responded to consumers dispute on April 1, 2016, we provided her an itemize statement.  Informed her that "there is no basis in law to substantiate right to such information.  I fact, court cased and Federal Trade Commission have found there is no duty to comply with such excessive verification demands."  The debts will not be deleted.  Consumer was informed of the debts being in collections when we received them and sent her a letter.  We have on file same address as she has provided in the letter received.

Complaint: 100% of the collections against me are erroneously billed anesthesia claims. Many of them duplicated 3 or 4 times. I have yet to receive any evidence proving I owe this debt.

Complaint: Financial Control Services originally sent me a collection letter a few years ago stating they held a collection account that I owed from medical procedures. Not aware of the account or balance with that medical office, I requested for Financial Control Services to send me proof of the debt. I never received such information from them from that request. Sometime went by before we received anything from them and it ended up being another bill, with no requested information and instead of responding to our letter, they reported on my credit report that I was disputing the debt, which I never had. I simply requested for them to provide proof. Time went by and since then we have tried several times to settle these matter over the past several years by sending them request to settle this collection. We have been met by silence from the letters we have sent. We have sent them a total of 4 letters over the years. During that time we also sent letters to all the credit bureaus explaining the lack of response from Financial Control Services as well as the continuation of reporting without following the federal guidelines to do so. Each time Financial Control Services validated the debt with the bureaus but never has responded to our request.

Desired Settlement: Due to the negligence of Financial Control Services in NOT following Federal Guidelines set out to protect consumers from wrongful collection processes such as this (failing to respond to my letters to not only provide proof of debt but to settle matters). I am requesting that the collection be removed immediately.

We responded to consumers dispute on that was dated January 25, 2015 and received on January 26, 2015.  We provided him a signed validation signed by our client along with itemize statements on February 25, 2015.  Then we received a letter from consumer dated March 6, 2015, letter states "after receiving your response to my inquire about validity of debt" means he received our correspondence.  We then received a letter wanting to settle the balances. Letter stated "your response must be postmarked no later than 15 days from your receipt of this settlement offer or this offer will be withdrawn".  We did not response as we did not accept the offer.

Complaint: After noticing a collection claim on my credit report from Financial Control Services, I contacted the original creditor, PathAdvantage Associates, to request further information. It was discovered that the original insurance claims were processed incorrectly to my insurance by PathAdvantage, therefore, needing to be resent for incorrect processing. The billing department at PathAdvantage recalled the collection from Financial Control Services for incorrect processing and sent notice via email to their FCS contact on 1/29/16. I contacted Financial Control Services on 2/19/16 to inquire about the collection claim as it was still appearing on my credit reports. I was told that they had never received any communication from PathAdvantage regarding my account. I called PathAdvantage that same day and they pulled up the sent email to verify, the representative also called Financial Control Services on 2/19/16 to verbally recall the collection claim for incorrect processing. I was told that I would be receiving a letter in the mail. On 2/25/16 I had still not received a letter in the mail and now an additional, DUPLICATE, collection claim was listed on my credit reports. I called Financial Control Services on 2/25/16 regarding the duplicate and was told that it was a mistake because of their new computer system and would be deleted and that they would be reporting to the bureaus by the end of the month. I was told my concern had been escalated to the supervisor, **** ********, to be resolved. I was also told on 2/25/16 that the letter would be sent out, as it was not sent previously. I called Financial Control Services on 2/29/16 to confirm that the supervisor, **** ********, had resolved my issue and was told by the rep that she was still seeing open and would escalate the issue to the supervisor again. I asked if they would be reporting to the bureaus by the end of the day and was told yes. I again asked about the deletion letter that I had not yet received and was told that one would be sent out that day. I called Financial Control Services on 3/3/16 to follow up and was told the letter had been sent on 2/29/16 and the collection claim was marked as deleted in their system. I asked if that information had been reported to the bureaus and was told yes it was reported on 2/29/16. I finally received my deletion letter on 3/4/16. Over the next three weeks my credit reports continued to reflect the collection account and I called Financial Control Services twice during those three weeks to again confirm it had been reported to the bureaus on 2/29/16 and was told yes. The last time I confirmed with Financial Control Services was 3/23/16. On 3/24/16 I began reaching out to the credit bureaus directly to follow up on my reports being updated with the information sent to them by Financial Control Services. I was told by the credit bureaus that they have not received any updates to my account from Financial Control Services and the last time an update had been sent to them from Financial Control Services regarding my account was 2/18/16. I have begun the dispute process with 2 of 3 bureaus at this time.

Desired Settlement: I have repeatedly received false information from Financial Control Services, both verbally and it writing. I demand Financial Control Services to contact all three bureaus IMMEDIATELY to report the deletion of the collection claim on my reports and to notify me with confirmation that this has been completed.

Complaint: Financial Control SVCS is reporting a negative collection on my credit reports. FCS has reported that I was placed in collection on (Aug.31, 2010) and owe $214.00 for a medical bill. This is not my account. I was a minor when the debt FCS is reporting was incurred and could not have entered into contracts at that time, they are reporting. I have not received any notice of any kind from this company. FCS has added a fraudulent mark on my credit history. This is a violation of FCRA and FDCPA regulations. If this illegal entry is not removed from all three credit reports I will take legal action and file a complaint with the AGO.

Desired Settlement: For Financial Control Services, LLC to delete this tradeline on E-Oscar from my credit file with all consumer reporting agencies

Complaint: I had several items that I disputed in October and was approved to be removed as not valid debts. I checked my credit report today and FCS has added back on the disputed items. Since I was not notified and it was already approved deletion they are in violation.

Desired Settlement: I want all items removed from my credit report as they were fraudulently added back on to it. If they are not again removed and remain removed I will have to file legal action.

Complaint: I have asked them to validate two debts several months ago. They are unable to provide this information. All they can provide is paperwork that does not validate the two debts. The last communication with them, I stated that the information is not a validation, and they responded that is all they have, some basic accounting paperwork.

Desired Settlement: Provide validation showing there is monies due or cancel and remove from credit reporting agencies.

For the validation of these debts,  I requested items that would show this debt is mine.  I did recieve statements and verification that this agency is contracted witht he medical group claiming debt,  but did not recieve proof that these debts were mine or that no errors were made in the posting of payments.

My fax requested the signed contract between myself and the group as well as the Explenation of Benifits that shows payments and writeoffs per their insurance contracts.

I have only been furnished paperwork of the business that does not show what was charged,  what was billed,  what was recieved and how adjustments were made.  They would have recieved this information with the insurance check.  In addition I requested the date these were sent to collection.  So again I request EOB's to show now accounting mistates were made.

Our office has verified the balance we are collecting is accurate. I have sent itemize statements from our office.  As a patient and as the insured it is your responsibility to follow up with your insurance and verify the EOB and proper billing.  Our healthcare provider bills insurance as a courtesy but it does not absolve the consumer from his responsibility as a patient to review his EOB's and billing statements.

We are more than willing to reinvestigate this matter however the consumer has not provided us with a specific reason for disputing the debt.  Currently we have responded to his requests for validation and we are not required to provide him with the additional information he is request.

I am asking for your cooperation to investigate the amounts due.  I am asking that the billing is double checked to assure the amounts posted, written off and patient responsibility are correct.  This can only be done with original documents that the billing entity would have recived.  So please provide me with A genuine copy of the document that accompanied the checks for any servics that would also show how the payment and contractual amount are to be posted.  This and a simple ledger will end this issue.  These are medical records and should be held for 5-7 years depending on the type of document.

Complaint: First, I was told that my physician's office sent over my entire balance with them to Financial Control so that I needed to pay higher monthly installments. We couldn't afford it, but made due anyway. I later found from my doctor's office that this was not true. Then my husband and I called because we have been paying hundreds of dollars for almost a year and one of the accounts never was removed from my credit report. Customer Service said it was because their new billing system takes out payments and divides it across every medical account that we have with them. Then they asked for my card information over the phone again (during that call). I was uncomfortable giving that information over the phone, especially since the system was already taking the money out of my account every month. The woman on the phone explained that they had moved to a new system and that they needed for me to authorize my card again in order to begin recurring payments again in February. My husband lost his job in January so that, along with the fact that we stopped receiving notifications about the bills that were being paid off and the fishiness, we declined in doing so. We told the woman on the phone that we would prefer to pay each account as we are able to online and asked for an itemized bill of every account that we owed including the account numbers. We were told it would come in about 10 days and that our account will no longer be charged the recurring monthly installment. I was still patiently waiting for the letter in the mail, but much to my surprise about an hour ago, I received an email from my bank that I was overdrawn because Financial Control Systems charged my account (after they stated that they acknowledged that we were no longer authorizing the recurring installments and preferred to make the payments to them on our own due to our situation) anyway. Not to mention that yesterday, I pulled up my credit report and saw that the account that was never removed has now been reported twice and now is viewed on my credit report as a new negative account. Before all of this, I viewed them as a satisfactory collection agency and trusted that with working with them, it would be one step towards progress in my life. I am very disappointed and didn't need this on top of everything else we are going through right now. We are trying our best to make things better and don't need someone taking advantage of our family.

Desired Settlement: I need the account that was incorrectly reported twice to be removed. It is seen as two negative accounts on my report instead of just one (which should have been removed last year with all of the payments I had already made). I also would the recurring payments to stop just as I discussed with customer service when I called them. Thank you.

Business Response: The consumer set card for payments on 09-29-15 and when it was ran it declined she was then reached on October she gave new card information to run her monthly payments. Accounts will only update as paid in full not deleted.

The September installment amount was before I was asked to increase my installment payments. It doesn't resolve the issue that I called and specifically asked to received an itemized bill, which I still have not received, and that the representative I spoke to acknowledged that I no longer authorized charges to my card after January. And that I was told that my card would not be charged in February which it did. The charge that was made to my account in February has nothing at all to do with the payment that was MADE in September. So, I don't see how that is at all relevant. It does not resolve the issue that my card was charged after I was told that it would not be.

Secondly, I understand that once a payment is made towards an account it will be shown as paid in full. What I don't understand is why there is a DUPLICATE account now reported on my credit report. It is an account that HAS BEEN OPEN ALREADY on my report for months, despite the fact that I have paid hundreds of dollars already. Now THE SAME ACCOUNT is shown as being reported TWICE as if it is a new and different account, which it is not.

I am not asking to have the account removed. I am asking for the DUPLICATED account to be removed. For example:

The above shows an example of what I mean. Instead of there being one negative account reported, there are now two negative accounts reported. I'm not disputing that there is money owed, just the *duplicate* account.There is a DUPLICATE account reported on my credit report. I just need the issue with the duplicate account fixed.

It will help to resolve the issue when (1) the payment from February is reversed because I did NOT give permission for that charge. (2) I receive the itemized bill in the mail so that I can begin making payments online as soon as I can. (3)  Correct the duplicate account that was just reported to my credit report.

I called my insurance company and they provided me with an EOB from both of my visit's to the ER and the remaining amount owed is $55.87. When I asked ***** at FCS to provide me with more information on what the $1,215 is from she stated she could only give me the amount owed and refused to provide any additional information. Based on my EOB there were no claims submitted for the amount given by FCS, thus I should not have been sent to collections for it.

Desired Settlement: I would like a complete breakdown of the alleged amount owed to FCS. If they cannot provide me with this I will not make any payments and I will be forced to take legal action. I would also like any credit inquiry's to be removed immediately.

The resulting documents were review, and have inaccurate information. I also notice on the statement “PAYMENT” in the amount of $635.78, how is that so if I have no knowledge of this bill and doesn’t belong to me? I dispute the validity of the debt and the documents I received are not proper validation of this alleged debt. Complaint: Financial Control Services, LLC (FCS) is in violation of multiple provisions of the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA). Specifically, FCS has violated the following provisions of the FCRA and FDCPA. FCRA: 15 U.S.C. § 1681s-2(a)(1)(A) 15 U.S.C. § 1681s-2(a)(1)(B) 15 U.S.C. § 1681s-2(a)(3) FDCPA: 15 U.S.C § 1692c (c) 15 U.S.C § 1692e (2)(A) I originally received correspondence from FCS of an alleged debt dated June 11, 2015 (Attachment: FCS Debt Notification). I replied to FCS in regards to this correspondence on June 17, 2015 asking for validation of the alleged debt (Attachment: Debt Validation Letter to FCS). I also requested that FCS “cease and desist.” This correspondence to FCS was sent via United States Postal Service (USPS) using certified mail receipt and delivery confirmation. My correspondence was received by FCS on June 19, 2015 by FCS’s employee Brenda Bittick (Attachment: FCS Dispute Letter Receipt). FCS provided correspondence dated June 25, 2015 (Attachment: FCS Dispute Response) in response to my dispute notification. In the correspondence, FCS stated that they were ceasing collection efforts and removing the account from all consumer reporting agencies. On December 5, 2015, I received a notification from my credit monitoring service, Identity Guard, that a new account had been placed on my credit report. This account was an alleged collection account reported by FCS with a balance of $621.00. This is after FCS stated that they were ceasing collection on this account and that they were not reporting the account to the consumer reporting agencies. FCS is in violation of 15 U.S.C. § 1681s-2(a)(1)(A) because they are reporting information that they know is erroneous. FCS is also in violation of 15 U.S.C. § 1681s-2(a)(1)(B) because they are reporting information after I sent them notice of the inaccuracy of this debt and they confirmed the errors. Additionally, FCS is in violation of 15 U.S.C. § 1681s-2(a)(3) because they have not annotated the account as disputed and are still reporting this disputed account on my credit reports. FCS is in violation of 15 U.S.C § 1692c (c) since an employee named Debra at extension 501 contacted me several times after I provided written notice to FCS to cease communication. FCS is also in violation of 15 U.S.C § 1692e (2)(A) by falsely representing the amount and legal status of the debt. As per evidence presented above, FCS is in violation of multiple provisions of the FDCPA and the FCRA. I request that FCS delete this tradeline from all consumer reporting agencies including, but not limited to, Experian, Equifax, Innovis, and TransUnion.

Complaint: I had payment arangements setup with this company for the total amount due of 432.90 which were paid in full on 10/02/2015. A month later on 11/3/2015 they called me again saying that my last payment was rejected and if didnt pay right away thwy would report to the credit bureaus that day. I was shocked because my bank statement donot reflect any rejected payments to anyone. I asked them for some time to get home and check my statements. And disconnected the call a few moments later with out my concent while i was still driving just to tell me again i had to pay out of fear i paid the amount they said i was passed due and thay said that would be the last amount due. After i got home i started checking all my statements and realized i was right i had paid them the total amount i owed, 4 payments of 86.58 and 1 payment of 91.58 5 payments total covering the amount they originally stated i owed so the payment they harassed me for i didnt even owe them. I contacted them the next day to make thwm awear of the situation but the manager was rude and said to do what i had to do but id i didnt pay or if i revocked the payment with my bank they would report to my credit negatively. I dont know what to day i feel made a fool of because they are taking money from me that i now donot owe but im scared to not pay since they threatened me with a bad credit report. PLEASE HELP!!

Complaint: I received a call from this company while on my way to my mother in laws funeral. I took the call thinking it may have been related to a timely delivery we were expecting. The person on the phone was extremely rude and refused to give me any information about himself or the company he worked for unless I first provided personal information about myself and he eventually hung up on me, this was the last thing I needed on my way to a funeral. I googled the number and found many complaints about rude calls from this company. At best this was a unscrupulous telemarketing call or at worst a scam trying to steal personal information. I will be filing a complaint with the attorney general next.

Desired Settlement: An apology and no further contact by this company.

I would like to request your help with a problem that I am having with “ Financial Control Svc” on “6/24/2015 ” I requested a validation of debt from “Financial Control SVC” . I have yet to receive a response - their silence is their agreement to the facts. “ Financial Control Svc” failed to provide me with a legal validation of this account under the rules of evidence and the FDCPA within 30 days § 809. Validation of debts. I am demanding that “ Financial Control Svc” delete this account from all credit reporting agencies(,Equifax,TransUnion), because they have not abided by the laws of the Federal Trade Commission. Also, Financial Control Svc failed to notify me about reporting derogatory info. In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); “The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after "05/2013",09/2013, 02/2014 furnishing the negative information to a consumer reporting agency described in section 603 (p),’ 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC § 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response.

Desired Settlement: Therefore, they have tacitly agreed that they are using unfair and deceptive means to collect a debt. I demand they cease and desist any and all collection efforts and immediately remove any derogatory reporting to all the credit reporting agencies. Any further action will constitute their tactic agreement that they are attempting to collect debt using unfair, abusive and deceptive collection practices.

I am rejecting this response because:  pIF does not reflect.  As a positive on my credit report    It is still reflecting as a negative collections.   I did my part and pay these three installment payments I was told they would be taken off my credit report when they were complete and they were not.   It does not take much for yawls company to go online and take these off my credit report and that's what I'm asking to be done.   Paid in full reflects the same as not paid it all on a credit report when it's under negative accounts

Complaint: Debt was placed on my credit in January of 2014, I paid the debt immediately after it hit my credit. I called financial control service and spoke with a manager named ****, who was very unprofessional and insisted I was a liar when I advised I was not aware of this debt being sent to collections because I was still receiving bills from ***** ********. I also explained there were no messages left on my voicemail from their company. The 2 calls I received from their number showed to come from ***** ******, they called twice after 3pm which is after my work days starts. I checked my voicemail and there were no messages left so I assumed the calls came from a private individual who had the wrong number. **** insisted there was a message left, I explained I have a youmail account which not only shows the caller ID, it sends and email indicating if a call was just missed or if a message was left, I emailed a copy of the call showing there was no message left to ****@*************. **** refused to help remove this item from my credit. To add insult to injury; I disputed the item as paid on my credit, FCS, responded stating the debt was good and still unpaid. This company has very bad practices, their call takers are rude and unhelpful as well as the supervisors. One does not have to be rude to solve an issue. I have pretty good credit, I pay my bills on time and feel this a slap in the face.

In reviewing the account letter was sent to consumer on 11-2-13, It also show numerous messages were left for consumer on November 11, 2013, November 18, 2015, November 26, 2013, November 31, 2013, returned call on December 31,2013 and was non-committal. Then she called back upset it was on her credit report on January 6, 2014 she stated she did not get any mail, we did not received any return mail from letter sent. She also stated she got no calls but the number she was calling from was the same number we have been calling and leaving messages. Was told if she paid in full it will update as paid in full but would not delete. She got upset and hung up.  She called back and super calmed her down and was told no deletion said okay and promised to make the payment on line, thereafter to rejected to make the payment. She called back again same day complaining some more that we never left message and kept arguing. Supervisor pulled call and let her listen to it, said will contact BBB. As far as the call she said she received showing ***** ******  on her caller ID not sure why this name came up under our number.  At that time we spoke to our IT guy and he did not know why this happened.

 I called our client today to see if the account has been paid in full and was verified that the consumer paid it on January 9, 2014, they failed to report the payment to us.  I have posted the payment to the account and due to the fact that our client failed to report the payment and it was never updated as paid in full with CBR, we have deleted the account. I will send a letter that account has been paid in full and deleted.

Complaint: On 6/5/2015 and 6/30/2015, I paid two separate collection accounts in the amount of $170 and $321 respectively. Both were paid in exchange for 'Pay for Deletion' exchange. I was told Cntrl Fncl Srvs reports to the Credit Bureau on the 1st of every month and would be deleted then. As of July 4th, 2015, both accounts are still being reported on my credit reports. I spoke with the apparent "Unit Manager" named ***** *******. I have paid off several collection accounts over the years in exchange for having it removed from my credit report, and this is the first time I have had to manually dispute an issue of this kind with any collection agency. This is usually smooth sailing. I am a bit disappointed.

Desired Settlement: Please delete the accounts from my Credit Report report ASAP. Thanks

Since they were paid on June 4 and June 30, I had already done my credit bureau update on June 3.We do our updates the 1st of every month.  Our update has just been sent today for July due to the holiday it was done a little late..  Normally this takes at least 4-6 weeks to update.  I am going to do an E-Oscar on both accounts and get this done sooner.  I will send a letter and will be providing you an AUD# for both accounts.

Complaint: This company contacted me in 6/19 @ 12:30pm. The gentleman that contacted me identified himself as **** *****. He said this was a business matter and began harassing me to tell him my personal information. He told me that he needed my date of birth and my address. I said to him that I had no idea who he was or why he was calling and I was NOT going to give him my personal information because I didn't know who he was or why he was calling. He never one time identified himself as a collection agency, he refused to tell me what company he was working with, he just kept pushing me to give him my personal information. And told me he wouldn't tell me who he was and why he was calling unless I gave him my personal information. I called the company back to speak with a supervisor, and the operator hung up on me each time I called back, two times in a row. The third time I called back the transferred me back to **** ***** who again only wanted to take my personal information.

Desired Settlement: #1-If I owe a company money and they are trying to collect it, they need to call me and inform me about it. #2-**** ***** is obviously unfamiliar with my rights as a consumer and needs to be schooled, and if this is a legitimate collection agency, which I do not believe it is, he should be fired #3-In fact, I'm sure this is not a legitimate company and they are a bunch of crooks, the feds need to investigate them and shut them down

I know that I did not incur this debt, because I have spent more than half of time during the past 10 years opening new stores for ********* who is my employer in ******. As a matter of fact, there have been instances where I was away for up to two consecutive years, making it physically impossible for me to acquire these debts. Should this company disagree, then the burden of proof is on them, not me and consequently they are obligated to prove these allegations and provide me documented proof of their allegations against me.

On 3-3-13 consumer called in wanted to know if on his credit was informed no he made a payment and a hold was placed on account to keep off credit  to give him time to clear the remaining balance  left msg on 4-21-15 was contacted and on May 22, 2015 was contacted promised to pay remaining balance to call him at 10AM. On 4-23-15 no answer left message and we called again on 4-28-15 we got a pick up and hang up at this point the hold was removed.  Reached on 5-5-15 he said will get with wife about payment and was advised on credit the hold was removed said will not pay and was advised we held for 60 days and kept arguing . The times that we spoke to the consumer he never stated it was not his account or requested validation. If he wants to pay the remaining balance it will update with credit bureau as a paid account.

Your business failed to provide any type of information regarding the charge. I am in the process of buying a house and I found out that the charge went to collections and my credit score has been affected. I called them at the beginning of this year, 2015, and have given this company plenty of time to send over a verification of debt and they still have not. I told the woman I spoke with at Financial Control Services on the phone, that I did not believe that this debt was mine because I had recently moved from the city where the charges originate from almost two months prior.

Complaint: A charge was reported on my credit score at the end of 2013 that I had never received notification for (email, phone call, mailed bill or invoice, etc.). When I inquired about the charge on January 2, 2015, I spoke with ***** and she attempted to explain the charge. She said that they had previously attempted to send a bill once via mail but that it was returned since I had moved. This is interesting, since all of my other bills and mail had easily been forwarded to my newer address without a single problem. They also verified that they had the correct phone number and email the entire time but never attempted to contact me in either of those ways before reporting the bill as an account in collection. She said that the charge was for a hospital, but the only medical records I have from the date of service are from a walk-in clinic (I also have my receipt from this clinic). I would really like to get this mark off of my credit score, but have been scammed in the past by "collection agencies" and want to verify that the charge is legitimate before I hand over a card number or payment. She said that she would mail me an explanation of charges to my new address and that it would take up to ten days, after which she would call to verify that I had received it. Over two months later, I have not received an explanation or contact in any way from the company, and every time I call them myself, I am greeted by a very vague automated message system. I do not like leaving personal information on public voicemail, and really just want proof that the charge is legitimate so I can pay it and remove it from my credit report. The fact that I can't get them on the phone and they don't follow through on providing explanations makes the company look extremely questionable.

Desired Settlement: I need to be contacted and mailed/emailed/faxed proof or explanation of charges and have the collection closed. I have never tried so hard to pay someone before.

Debt was reported to credit agency before contact was ever made on behalf of the business. Supposed phone calls and messages were never received, even though business says "calls were made on 10/30/13 11/22/13 12/26/13 message left," and my phone number has not changed since 2003, so I'm not sure who they "called" but it was not me. For the record, the hit on my credit report came up 10/21/13, before any alleged contact was ever initiated or made. None of my other bills or mail was returned to sender because a proper address change was filed through the post office and all other mail was accordingly forwarded without issue, so this is extremely hard to believe. From someone with decent credit and who wishes to keep it that way, notification of a charge or invoice would be appreciated before reporting said bill as a debt and refusing to accept communication or payment.

Complaint: Financial Control Services has failed to provide proper validation of a debt they allege I owe. In accordance with Texas Law Sec. 392.202 (d)(1) Account # ******* provided by Financial control Services upon receiving a collection notice from Financial control Services about a debt I have no knowledge of, I sent a Debt Validation letter in accordance with Texas Law Sec. 392.202 (d)(1) letter via certified mail. In this letter I also asked that all communication be done via mail. During the 30 day validation process they continued to call me and attempt to collect on the account. Even after telling them that they were in violation of a cease and desist and that they had yet to validate the debt they continued to call me and they reported to my credit report. This debt validation letter was sent to them on November 17 which they received on November 21. I received a letter from them dated December 17th in which they dismissed the letter and only sent a bill from the alleged original creditor. Texas law requires any collection agency to provide a minimum of certain information which included the following *The name and address of the original creditor *The original date of default or non-payment of the debt with original creditor *The date the debt was transferred from the original creditor to the third party debt collector *The original balance *The current balance *Any fees added by your agency. Sec. 392.303 (a)(2) *Texas Surety bond information as required by Sec. 392.101 In the certified letter I sent to Financial Control Systems I requested the above information and only received part of the information requested. I did not receive the original date of default, the date the debt was transferred, or their bond information. This is not proper validation of this alleged debt. Also in regards to their violation of the FDCPA 805(c) that they continued to collect after I asked for all communication to be via mail I’d like for them to remove the collection from all three credit bureaus immediately or I would like to file charges with the FTC for this violation. I have also included a list of times and dates that they have called since November 17th which is when they received the debt validation and request to contact only through mail letter. January 6, 2015 – 5:42 pm January 2, 2015 – 1:06 pm December 9, 2014 – 5:24 pm December 9, 2014 – 5:27 pm December 22, 2014 – 5:09 pm

Also during this debt validation process the debt collector was supposed to cease any collection efforts and I requested that all correspondence be via mail and the collection agency continued to call in an attempt to collect the debt.  Attached is a copy of the original letter I sent to you certified stating that information.

We wanted complete validation under the Texas Finance Code 392 before we could make an informed decision.  The company did not comply with this request that are under my rights as a consumer in the State of Texas.  I request that the report be removed from the credit bureaus until a full debt validation can be completed and we can confirm with the original creditor and the insurance company the validity of the debt.

I was hospitalized and the hospital did not bill my insurance company. Had the hospital have billed my insurance like they were supposed to, this amount would have been much less, and would have been affordable to me. I can not, and will not pay an inflated amount because the hospital did not bill my insurance in time.

Desired Settlement: Remove the inflated charges from my credit report, and tell the hospital to bill the insurance company so that this can be resolved for the correct amount.

Complaint: Company placed negative information in my credit report in an attempt to collect a disputed medical debt from Stric MRI center. I had provided Stric MRI center with both Tri-CARE and my supplement American Society Insurance (ASI) Corporation insurance information. ASI pays my co-pays, Stric accepts Tri-Care, Stric billed my supplement, so the issue was between Insurance companies and Stric. Unfortunately, I had to wait out the whole back and forth between them. After, American Financial Corporation (AFC) took over the account and it took me a long time to catch back up to the issue. Presently, I talked with AFC and we had agreement for them to email the details so that I could do research and clarify my position or pay. I never received the email and thought the issue was closed. On the 11th, I check my report and found they were still reporting me negatively and called on the 12th. Fed up with the issue, I decided to pay them against my best interests and requested they clean my record of the negative reporting. They refused and I don't get it, their own records have the notes stating they would email me. When Sabrina Romero read back the email to me, the got it wrong, despite them reading it back to me during our 2013 phone call. This is serious problem because it was noted during that phone call email was the primary way of contacting me due my intensive work schedule and the fact I am not able to take non-business calls at my work center. Ms Romero stated phone messages were left for me, but that doesn't work when it was made clear I can't take them and we had agreement on email for contact. In any case, this has went on for so long, I made the full payment today.

Desired Settlement: It is still a mystery how Stric could turn over their collections and hold themselves unaccountable while an outside agency is holding my credit hostage for payment. Then, that outside agency agreed in principle to provide me the details to research the issue and then didn't. Stric and AFC got paid, I want my credit report corrected and cleaned of record.

We spoke with consumer on 12/30/13, made him aware accounts were placed for collection.  He requested a statement, it was emailed to him.  We tried to contact him three times after the email.  He never let us know he did not receive the statement.  He called from his credit report, wanted accounts deleted from the report, told him no, they would be updated as a paid account, he said fine and paid the bill in full.  The credit bureaus will be made aware of the change when we drop our file to them the end of the month.  Our calls are recorded so everything said can be verified.

Complaint: I was bitten by a dog at work (I work in delivery services). A couple days later my leg was becoming infected, so I went to the emergency room, expecting to have the wound cleaned and debrided, etc. Instead, after waiting over two hours in an empty waiting room, I was led to a room to wait for another 45 minutes before the doctor came in, poked my infected leg, said "yep, that's infected", and wrote me a prescription for some antibiotics. About two weeks later I receive a bill for over $1200. I contested the bill, stating that this was obviously an absurd amount to pay for the services rendered. They, however, disagreed and, so, we had reached an impasse. I refused to pay an obviously inflated bill, and they refused to let me refuse. Some time passes and the bill has been sold to a collection agency with whom I settle the account in full for $220. My complaint comes here. They have refused to delete the account from my credit report, so that I now have an account in collections for a $0 balance! Needless to say, this is having an adverse effect on my credit rating. When I contacted the company concerning this, a Mr. **** ******** responded through email "we only update accounts to a paid status we don't delete the item from the report." It seems to me that if a person has an account in collections and then settles that account, it should not adversely affect them.

   After reviewing the complaint, the account should have been covered by workmans compensation.  For this reason only,  I will remove from the patients credit.  If workmans compensation was not involved, the paid account would update on the credit as a paid collection.  Workplace injury should always be reported to the employer.

Complaint: I contacted this collection agency and they refuse to give me any details of the debt they are trying to collect other than the clients name who filed the debt with them. The first message from this agency I received came earlier this week, and I was given until Monday to pay the debt before it goes to the credit reporting agencies. I spoke to **** ***** at extension ***, a supervisor, who told me the doctors name was ****** *******. This was all the information he would give me. He refused to send me a copy of the invoice so I could dispute the debt with his client, stating he didn't have a license to do business in North Carolina. He refused to give me any additional contact details for Dr. *******. My insurance company has no contact information for Dr. *******, and they are stating that this $50 is part of another procedure and is not a valid charge. My insurance company is being transferred between departments and dumped into an office closed message in the middle of the day when calling the number we were able to find for Dr. ******* using a Google search. We still do not know for certain this number is the correct contact number for Mr. *******. All information I have available to me says that the debt Financial Control Services is trying to collect is not valid, and they are refusing to investigate further on their end. The only recourse I have on their end is to file a dispute, which will not prevent the debt from going to credit reporting agencies on Monday. In other words, I have no way to resolve this matter other than paying a $50 (erroneous according to my insurance agency, the only company in this transaction trying to resolve this matter with me) charge to a collection agency I did not elect to do business with and is not licensed to do business in my state.

Desired Settlement: FCS should cease all collection attempts immediately and turn this debt back to the Dr. ******* as invalid. Dr. ******* should contact my insurance company or me directly to resolve this matter.

Complaint: I recently had this collection agency turn my account from 2012 over to the collections bureaus without any for warning they were doing so. Since this account is from 2 years ago I am assuming it was one of the many bills I received from a hospital bill but I do not agree that it is appropriate to file a case on someone's credit with a for warning. The supervisor **** ***** was very unprofessional and all he could explain was he was not obligated to send me a letter or statement. The amount he turned my case into the credit bureaus was for a small amount of $93. I was unaware of this outstanding account because I never was sent anything in the mail nor received a phone call. I do have another account with this same company in which a representative ***** calls me about and I make small payments toward because that is all I can afford. ***** never once told me about the other outstanding account. Last month I was advised by ***** I needed to increase the amount I was paying to avoid anything hitting my credit so I did which was the amount ***** suggested. Today after speaking with **** he advised me that the account I have been paying on and just paid this month, he was going to turn this account over to creditors as well. He explained that the amount I was paying was not enough even though his employee told me so.

Desired Settlement: I would like to make sure this other account of mine does not hit my credit and the account that already did be removed. I understand his job and needing to receive payments but when I am making payments and the amount I am being told by his employee but it still isn't enough is very frustrating. Also I believe if they have an outstanding account and before turning a small amount into someone's credit before sending out a letter is very unprofessional.

In response to consumers complaint the consumer was sent a letter from our system on the old acount on 7-20-12 informing her of the balance owed.  We never received return mail.  She was contacted and spoke to on 7-25-12 and promised paymnt in full. Thereafter she had been left several messages and on 8-14-12 she sent us a $10.00 payment so she was aware of this old balance and we had continued to leave here messages and she never called us back.  We then received the new account  and letter was sent to her on 2-26-14. We then continued to leave her messages and she returned our call on 3-3-14 and was informed of both accounts then also. She then sent a check that was returned for NSF. On July 28, 2014 she also spoke to collector complaining of not being informed of older account and was told to make some arrangements and said is going to report us and hung up and then now that she finally paid accounts.

The consumer did know about the 1st account because she did make a payment on it back in 2012 and failed to make any more payments and it was placed on her credit report and she was informed when we received the new account of the old account also on 2-16-14. What I am going to do is in good faith delete the accounts on E-Oscar and send the consumer a letter.

In regards to the business response if I answered in August of 2012 and made a payment then I see no reason as to why I would not answer to their other calls they are claiming they made. No other calls were ever made to me, no messages left, and no letters sent to me. Its obvious I care deeply about my credit and how it is effected which is why I made this complaint. The way the supervisor handled this case was very unprofessional and in the end he stated he was going to turn my other account in to the credit bureau's as well even though I have been making payments on that account. I did call again yesterday and got a very professional, understanding representative which in fact stated on my open account it had been noted that I had been making payments and to not turn my account into the credit bureau's. This is the reason why I went ahead and paid the accounts off. A little consideration and good customer service always pays off in the end.

The original amount of $100 was related to cancellation appointment fees by Texas Diabetes and Endocrinology. Complaint: On May 12, 2014 Financial Control Services received my request for validation of account they are attempting to collect ****************. I have not received a response. While they are not required under federal law to respond, if they dont respond with proper validation then they are required to cease all collection activity. Proper validation consists of copies sf some type of current creditor records, not records which only verify that the collector believes an account is valid. As of June 14, 2014, they are still reporting a collection account on my credit report. Under federal law, I could sue them and ask for $1000 in damages, since credit bureau reporting is considered a collection activity. However, I am confident that by channeling this dispute through the BBB, a more simple resolution can be made. If they delete the account, cease reporting it to the credit bureaus, and provide written confirmation of the same, I will consider this matter resolved.

Complaint: Financial Control Services has filed against me a false collection report with the 3 credit bureaus.I contacted them several times and they said they will send me a copy of the fictitious $340 from *** *********** * *****, MDI have never received the bill and I spoke today with **** ***** and he was very rude on the phone and hanged the phone when I told him that I will be taking them and *** *********** * *****, MD to court if they do not at least send me a copy of this bill.I told **** ***** that I have filed a complaint with the credit bureau to dispute the $340 fictitious bill and he told ma that it is a waste of time to contact the credit bureaus since he will just tell them that the bill and the information is correct and then the credit bureaus will just do nothing.**** told me that I must send a "please" request to his "dispute person" and maybe they will send me a copy of the bill.This is outrageous and discourteous and all they do is they 100% support *** *********** * ****** ** and his fictitious bill while destroying my credit score from 725 to 625 and causing me along with *** *********** * ****** ** serious financial damage and heartache.I will be taking them and *** *********** * ****** ** to the small business claims in Travis County but **** ***** from Financial Control Services has utterly refused to give me a copy of the fictitious bill from *** *********** * ****** ** so that I will have a hard time taking them to court as he said on the phone after I called him back because he rudely hanged up the phone in my face.

He then went on about taking us to court and sueing us that this doctor created a fectitious. The representive tried to explain to him that this was ** ********** bill.  He would not let her get a word out to explain. He continued to talk about sueing, she finally transferred call to **********.

The ********** took call and he also told him that the doctor made these charges up. He started back to sueing us and taking us to small claims court.  The ********** asked if this was not his bill he said no he was at hospital and bill was $2,500.00 not $340.00. He still would not let ********** explain to him this was ** ********** bill he kept on arguing and would not listen and the ********** terminated the call.

I mailed a letter to his verbal dispute today attached itemize and validation.  Copy to BBB of letter and validation without PHI.

Complaint: This company supposedly reported a paid debt to all three credit agencies but it was still shown on my credit report as an outstanding debt. This was a medical debt from someone else's insurance company (a drunk driver hit me) and should have never gone into collections. Nonetheless, I never received any bills, payment receipts, etc. but when I requested a receipt for the account paid so that I can dispute it with the credit agencies, the supervisor told me he would e-mail me one. Instead, I was lied to and this company has BLOCKED my phone number. They now refuse to talk with me. They have collected money without reporting it to the proper credit agencies and they refuse to provide proof that they received the funds.

Desired Settlement: A copy of the receipt for the amount that the insurance company paid them. Or a letter authenticating their debts paid since it is not my insurance company and I have no way of proving that they received their money.

Business Response: We never refused to talk to consumer, we talked to him 3 times on July 31. 2013, we do not block consumers numbers from calling us. An e-mail was sent to consumer on August 1st providing him itemize statement showing account has been paid in full.  I have also updated his account as paid in full on e-***** and I am sending him a letter right now informing him of this and providing him an AUD number so that he can use this to verify it updated with all 3 credit reporting agencies.
