Refund and Exchange Policy
CANCELLATION & REFUNDS
You may cancel this agreement any time by notifying us in writing.
However, you agree that once you approve our initial design
specification based on our initial consultation with you, and once you
accept the terms of this agreement, we will begin work under the terms
of the initial design specification and this agreement. You understand
and agree that once work begins on this project, we are entitled to
compensation for time and labor we have spent on this project, even if
you should for any reason decide to abandon this project, and that
therefore if you cancel the project for any reason after work has begun,
only partial refunds will be administered, based on the following
schedule:
Prior to start of work: Refund amount 100%. (Site will not be delivered.)
After start of work but prior to first demo: Refund amount 50%. (Site will not be delivered.)
After first demo but prior to final demo: Refund amount 25%. (Site will be delivered as-is.)
After final demo: No refund. (Site will be delivered as-is.)
This refund schedule shows that after work begins, we keep a
significant portion of the base website design fee, because the bulk of
the core design work is done early on, and therefore we keep a
substantial portion of the base website design fee to compensate for the
time and labor involved in the early phases of the project.
You understand and agree that any additional hourly work that was
specified and approved by you outside or beyond the initial design
specification or this agreement will not be refunded, and you agree that
you will pay for any billable hours that accrued prior to your
cancellation. We agree that we will send you a final invoice for accrued
billable hours within 14 days of receiving your written notice of
cancellation, and you agree that you will pay any such invoice according
to terms set forth in the Payments section of this agreement.
If you cancel the site prior to the first demo, you agree that we
will not deliver any of our design work, though all of your original
materials and data will be returned to you in the same form that you
provided them to us. If you cancel the site between the first demo and
the final demo, you agree that we will deliver whatever work we have
done to that point, and that the site may not conform to all or any of
the specifications agreed upon, since the work is still considered “in
progress”. If the project advances to the final demo and you cancel
before we can complete the final build, you agree that we will deliver
the site as-is, and that it may remain incomplete and substantially
non-functional at that point. In any case, if you cancel the project,
you agree that we will not be responsible for any missing features or
functionality, even if they were included in the design specification
documents that we produced and that you agreed to, since the project was
canceled by you prior to completion of the build cycle.
