On March 29, 2007 the Arizona Department of Financial Institutions (Department) issued a Notice of Hearing against SJJ Corporation, Inc. dba Home One Mortgage Services and its principals Steven P. Smith and Jerry J. Tuzil (Respondents) alleging that Respondents had violated Arizona law. Respondents have consented to the following order in lieu of an administrative hearing. Between November 2006 and February 2007, the Department conducted an examination of this mortgage broker business which revealed several violations. It was found that Respondents 1) Failed to ensure that the responsible parties were knowledgeable about Arizona activities and applicable state laws and failed to ensure they had sufficient authority to ensure compliance, and 2) Respondents made a false promise or misrepresentation or concealed an essential or material fact in the course of the business. In light of these findings, it is ordered that the mortgage broker license issued to SJJ Corporation Inc. shall immediately be surrendered to the Department upon execution of this consent order. At the time of the execution of this order, the Respondents shall submit a report of the winding down and closure of all loan files showing that all files have been closed or transferred to a mortgage broker or mortgage banker licensed by the Department of exempt from licensure and provide to the Department a report of the arrangements made for storage of the closed loan files, including a list of all files placed in storage as well as the location and contact for retrieval. The Respondents shall immediately pay the Department the examination fee in the sum of $30,000 and shall be jointly and severally liable for payment. This order is binding upon the Respondents and all persons participating in the conduct of the affairs of the Respondents.
