Complaint I provided a $675 deposit when I moved into the apartment at ******************************** Altamonte springs FL, XXXXX, which was managed by Reid Management but then transferred over to Park Avenue Property when ****** ****** left Reid Management and started this company. When I moved in I noticed that the carpet was in very bad shape with stains and carpet pulling up in areas. It was so bad it even made your feet black after walking on it. I went ahead and rented a carpet cleaner and cleaned the carpets myself which made no difference. The dirt was ground into the carpet. I put in the walk through paperwork that carpets needed to be replaced. The previous renter before me even came by and asked what I thought about the carpets and how she had even offered to pay half to have them replaced while living there. She moved out because of the carpets. The carpets were 11 to 12 years and were original to the apartment. I put in a request that for me to renew my rental for another year, they would need to replace the carpet and fix the air conditioning unit that had have the compressor jump started two weeks after I moved in and was never replaced even after multiple attempts with Reid Management. The owner refused and replace carpet and compressor so I moved out of the apartment. They are know trying to charge me $800.00 for carpet replacement,$75 cleaning and $75 paint. When I left the apartment it was in better condition then when I moved in. I hired a guy to clean the apartment after I moved out and there was no damage to paint and they even used the same paint can that was in the closet when I moved in. They are trying to steal my deposit. I am acquiring written statements from my neighbor, previous renter and I have all paperwork to prove my case against Park Avenue Property Management. Desired Settlement I want my full refund of my deposit of $675.00 and I will be satisfied. Anything less, and I will take this to small claims court and go after the additional costs to my electricity bill for the air conditioning unit not being replaced for an entire year, which averaged $200.00 when I used the air conditioner for a 898 square foot apartment. I will also go after all court costs that I endure and my time and effort for having to go after the deposit.
Business' Initial Response Park Avenue Property Management sent a statement of deposit to the tenant via certified mail stating that a claim was going to be made against his security deposit as required by law. As well, the notice clearly states that the tenant has 15 days to object to this, in writing, and that the objection must be sent to Park Avenue Property Management. If no objection is received, then Park Avenue Property Management will be authorized to deduct the claim. The tenant called the day he received the certified letter and was informed that he needed to send in his objection with reasonable proof within 15 days and he stated this would not be a problem. Park Avenue Property Management has every intention of working with this tenant and is unsure why a complaint was filed after he spoke with our staff. To further complicate things Park Avenue Property Management did not write the lease for this tenant nor did we collect the security deposit. This unit was rented by another company and Park Avenue Property Management began management partially through the lease. We did not receive any move in paperwork from the previous company stating the condition of the unit upon move in.
