ON DECEMBER 6th 2015 I BOUGHT A 2006 KIA OPTIMA FROM AUTO DEPOT IN FRESNO, CA. AND THE CHECK ENGINE LIGHT CAME ON DURING TEST DRIVE AND THE SALESMAN TOLD ME HE WOULD HAVE IT FIXED AND THE CAR DETAILED FOR ME AND I COULD PICK IT UP THE NEXT DAY, SO I PAID CASH $6,300.00 FOR THE CAR. WHEN I CALLED ABOUT PICKING UP THE CAR THEY SAID THAT IT WAS READY, BUT THE VERY NEXT DAY THE CHECK ENGINE LIGHT CAME BACK ON SO I CALLED THEM TO LET THEM KNOW, THEY TOLD ME TO BRING IT BACK AND THEY WOULD HAVE THEIR MECHANIC TAKE A LOOK AT IT. SO I DROPED IT OFF TO THE MECHANIC AND HE SAID HE WOULD CALL WHEN IT WAS READY, I ENDED UP CALLING EVERY COUPLE DAYS TO SEE IF IT WAS READY AND FINALLY ABOUT 12 DAYS LATERIT WAS. AS I WAS DRIVING AWAY I GOT ON THE FREEWAY TO GO HOME AND THE CHECK ENGINE LIGHT CAME BACK ON, SO I CALLED A & D TO TELL THEM AND THEY ASKED ME TO TAKE IT TO THE KIA SERVICE DEPT. IN FRESNO. LES AT A & D TOLD ME THAT LEGALLY THEY COULDN'T SAY WHAT WAS WRONG WITH THE CAR BECAUSE IT WAS STILL UNDER A & D OWNERSHIP. ON MONDAY I TOOK THE CAR TO KIA IN FRESNO,OVER 3 WEEKS LATER THEY CALLED ME TO SAY THAT THE CAR WAS STILL AT MECHANICS BECAUSE THEY WERE CHECKING THE ENGINE CODES TO MAKE SURE THEY WERE NOT THE SAME AS BEFORE, THEY SAID THE CODES WERE DIFFERENT BUT NEVER SAID WHAT THEY WERE. THEY CALLED A FEW DAYS LATER FOR ME TO GO GET THE CAR AND THE NEXT DAY THE CHECK ENGINE LIGHT CAME BACK ON, I CALLED DEALERSHIP AND THEY HAD ME BRING CAR BACK TO THEM. THEY SAID IF THEY COULD NOT FIX IT THIS TIME I COULD PICK ANOTHER CAR OFF THEIR LOT. SO I LEFT THE CAR THERE, THEY SAID THEY WOULD GIVE ME $4,000.00 CREDIT AND $2,000.00 CASH AND FIND ME SOMETHING ELSE ON THEIR LOT I AM STILL WAITING TO HEAR FROM THEM AFRAID EVERYDAY THE CAR WILL LEAVE ME STRANDED. I WORK NIGHT SHIFT AND GET OFF WORK AT 1AM WHAT IF THE CAR BREAKS DOWN ON THE FREEWAY RIDE HOME.?

I WOULD LIKE FULL CREDIT ON CASH PAID FOR ANOTHER CAR IF IT'S FROM THEIR LOT OR ANOTHER LOT THAT DOSEN'T MATTER TO ME, I JUST NEED A CAR TO TAKE ME TO WORK AND BACK.

UPON RECEIVING CUSTOMERS 1'1- COMPLAINT OF CHECK ENGINE LIGHT ON, AUTO DEPOT HAD PAYLESS BRAKES & TIRES CHECK VEHICLE AND MAKE NECESSARY REPAIRS, WHICH AUTO DEPOT PAID FOR. WHEN CUSTOMER STATED THE CHECK ENGINE LIGHT CAME ON AGAIN, AUTO DEPOT HAD CUSTOMER TAKE VEHICLE TO KIA DEALERSHIP. THE KIA DEALERSHIP CHECKED VEHICLE, CLEARED CODES, TEST DROVE, RECHECKED AND CLEARED AS NORMAL. AUTO DEPOT COVERED ALL CHARGES FROM KIA DEALERSHIP.
CUSTOMER RETURNED TO AUTO DEPOT AGAIN STATING THAT VEHICLE CHECK ENGINE LIGHT CAME ON AGAIN. AUTO DEPOT ADVISED CUSTOMER THAT IF THIS WAS A DIFFERENT PROBLEM THAN PREVIOUSLY CHECK, CUSTOMER WOULD NEED TO COVER REPAIRS. PAYLESS BRAKES & TIRES DID DISCOVER A DIFFERENT PROBLEM THAN PREVIOUS. CUSTOMER WAS THEN OFFERED A CREDIT FROM THIS VEHICLE TO TRADE FOR ANOTHER VEHICLE OF HER CHOICE. THE CUSTOMER REFUSED THE OFFER. AUTO DEPOT FEELS THE OFFER WAS A FAIR DEAL, BECAUSE OF THE FACT THAT AUTO DEPOT DID HAVE THE VEHICLE CHECKED AND REPAIRED, NOT ONLY PAYLESS BRAKES & TIRES BUT ALSO BY THE KIA DEALERSHIP. THIS WAS A PURCHASE OF A 2006 KIA OPTIMA FOR S600 TOTAL OUT THE DOOR. IF CUSTOMER WOULD LIKE, SHE CAN CONTACT HEADY OR **** FOR FURTHER ASSISTANCE TO RESOLVE THIS ISSUE.

I was told they would give me full price if i could come up with $2000 more they would get me into a different car, we even went and test drove other cars, and the sales mgr was even told the price range we were working with so he could help us to find another car on their lot. Yes i did take it to their mechanic Payless Brakes and Tire they checked it but didn't fix the problem they just unhooked the battery so the light would go off. The Kia dealership didn't fix the problem they were not authorized by AutoDepo to fix it, only to diagnose the problem, then I took it back to their mechanic and when they call AutoDepo to tell them how much it would cost $3XX-XXX to fix Les from AutoDepo said oh no that would cost to much. anyone can unplug the cable from the battery so the check engine light would go off or reset itself, A Depot even told me how to make the check engine light go off. I took the car back to Kia and they told me it was the same problem and A Depo should have it fixed . I then took it to my mechanic for a smog and it DID NOT PASS smog because it was misfiring on all 4 cylinders. You cant sell a car that wont pass smog so now the BAR is also looking into this. The service dept at Kia will vouch for issue not being fixed ever, only the light was reset each time. I did all the running back and forth from the day after i bought the car, and was told the only reason they are not fixing it is because i paid cash if i would have financed even $500 it would be up to them to have it fixed as they told me they would do the day i bought the car. What they are trying to get away with is just wrong. When they told me they would give me $3000 as a trade in, really i had just spent two times that much 6 weeks prior out of that 6 weeks the car was in the shop for 5 weeks at 2 mechanics. They should be made to fix the problem that is all im asking for....

AS STATED IN OUR FIRST RESPONSE, AUTO DEPOT IS MORE THAN WILLING TO RESOLVE THIS MATTER WITH ****** *****. AUTO DEPOT FEELS THAT BY OFFERING A CREDIT FOR THE PURCHASE OF ANOTHER VEHICLE IN EXCHANGE FOR THIS VEHICLE, THIS MATTER CAN BE RESOLVED. THE SMOG ON THE 2006 KIA OPTIMA WAS COMPLETED AFTER PURCHASED BY AUTO DEPOT, SEE ATTACHED COPY. ALSO ENCLOSED IS A COPY OF THE INVOICE RECEIVED FROM FUTURE KIA, WHICH CLEARLY STATES THAT CODES WERE CLEARED AND DTCS NO LONGER PRESENT DUE TO SERVICE COMPLETED ON VEHICLE. AS STATED IN EARLIER RESPONSE, THE CUSTOMER CAN CONTACT AUTO DEPOT AND SPEAK WITH HEADY FOR FURTHER ASSISTANCE IN THIS MATTER.

Spoke with **** in Collections about insurance laps and payment we got new insurance gave her a payment than the car got rep-ode.
We spoke with **** the collection person about us having a laps of insurance I went out and perchance new insurance for 175. Than she said we are behind so I took here a payment of 250 and owed 365. she said she going call corp and let us no if they can work with us. My husband told her next week Ill give you the rest. They rep-ode my car today. I went in last week and ask **** why don't I get print out to see were my payments are going she got very offended I wanted to see what was applied to my principle sense I've given her cash. She said no gets print out of payment history y unless they ask Im concerned I dont no where my money went and we are at 24% interest with out a new contract I was unare of that also.

Customer was behind in payments. Her insurance also lapsed so we picked up the vehicle. The contract she signed is clear that payments have to be paid on time and the vehicle has to be insured while the vehicle is financed. There cannot be a lapse in insurance. She currently owes $116.17 for November, $366.70 for December, $55.02 in late charges and $325 for repo fees. We sent a letter of intent by certified mail giving her a breakdown of the fees owed. If the fees are paid within the time allowed she can pick up her vehicle.

I did show proof of insurance and made a payment was told every thing was okay.
