Additional NotesComplaint: Purchased blinds for my entire house with the expectation that the tax credit would apply and is the only reason why I agreed to spend $2000 with the knowledge that I would be able to apply $1500 towards a tax refund. That I would get approximately $500 back at tax time. I know that the company was not paying out this money but the sales agent talked to me at length regarding this credit and convinced me to buy blinds for all windows. I agreed and that was fine. However at tax time when I gave my tax people all the info they came back to me that I did not have the blinds that applied to this credit after contacting Gordons window they said the same thing. I have been in contact with Gordon's Window ever since January 2011 trying to work this out with them and this is what they sent to me:
I sincerely apologize for the delay in coming to a decision regarding this matter. We are unable to give any tax credit for the following reasons:
1. For every job that was sold that was applicable for the tax credit the attached document was given to the customer along with the invoice. Our designers were meticulous in their tax credit
documentation; so you would have been given the papers if you qualified.
2. In the paper work that you would have been given (which was also posted on our website) we specifically state that Gordon's Window Décor is not liable for the customer’s ability to receive
the credit (please note the attached document). We are a small business so we could not possibly take on the risk of agreeing to pay for the tax credit if the IRS was to refuse.
we respect and understand your frustration at the lengthy delay of our answer. The lack of communication on our part with your original inquiry was inexcusable and has been utilized as a learning example for the entire company so that we may better serve you in the future. We thoroughly appreciate your business and if anything should happen to your products in 10 or 15 years, we want to be in business to support you. We sincerely hope that you can understand our position as well.
Sincerely,
********** ******* - Retail Sales Manager Desired Settlement: $500 refund from Gordon's Window Business Response: Our customer, **** *********, claims that she was due a tax credit for blinds purchased in 2010. However, she did not purchase blinds with the side tracks necessary for the tax credit. The only time a tax certificate was given was when side tracks were purchased. I have attached copies of the tax credit requirements, the certificate, pictures showing the side tracks and her order. Please let me know if you require any further information. Consumer Response: Better Business Bureau: I now understand that the blinds I purchased were not the blinds that were part of the tax credit, but that wasn't what the sales agent described to me. At the time of our initial phone call I explained that I saw their ad regarding the tax credit. Then again when the agent was at my house doing measurements and making up the sales agreement she stated that I would be able to bring my bill of sale to my tax agent. As she was leaving my house that same day, she wanted to make sure that I understood that the tax credit only applied to $1500 of the sale and that it was about a third of $1500 that would be in a tax refund. Therefore for misrepresentation I am owed $500 from Gordon's Window Design or from **** *** ******** (sales agent) for Gordown's Window Design. Regards, **** *********

Additional NotesComplaint: This is to acknowledge your letter of March 22, 2011. I would like to inform you that to date, the defective products installed in my condominium on Dec 1, 2010 have not been corrected. For the soft treatment which is not mentioned in your letter, I paid a deposit of $1000. The treatment was not installed because everything was wrong with it, wrong color, wrong fabric and wrong design of the cornice. There were other problems for which I told Don on Dec 1, 2010 that I did not want the soft treatment to be re-ordered. another error occurred. I received a letter dated March 22, 2911 from **** ******, accountant with an enclosure stating the ship date as March 22, 2011. I asked for clarification but I have not received a reply. I wrote a follow letter. the merchandise was installed on December 1, 2010. It does not make sense to have a ship date of March 22, 2011 which is also the date of her letter informing me that my payment is overdue on the defective merchandise. I decry this inaccuracy of record keeping even from the accountant. Desired Settlement: I would like the above deposit to be accounted for. I want to know what is the Ship Date 3/22/10 on the invoice. I would like this to be a part of my complaint under muddled financial transactions
Business Response:
Hello, Consumer Response: If you are rejecting the business's response please enter your rejection comments here.]The conditions I set for settlement in my complaint dated March 28, 2011 are not met.I want the issues under these conditions to be responded to and acted upon within thirty (30) days from the date of this e-mail. Thank you. Sincerely, ** ** *******, M,D.
