Complaint: I contracted with Boston Webdesign, LLC. to create a website for my business. The signed contract in March of 2011 stated that Boston Webdesign would complete the site within 3 months of initial payment. Initial payment was sent out ton the 30th of March. It is now January of 2012 and several of the services listed in the contract are not completed. The contract also states that Boston Webdesign, LLC would warranty and correct their work if problems arose for a period of 6 months after the services were completed. Parts of their design are broken and not working, and the company now states that that they will not warranty that work and do not have the skills necessary to complete the work. I have had to hire another company to clean up their mess. Boston Webdesign, LLC will not provide me with the files that I paid for and they claim to no longer have them. Most of the work they completed within the original contract was done by developers overseas. The website I was originally provided was in a translated, broken english at best. When I asked the company to correct the grammatical and spelling errors, they requested additional funds. Several of the pages they created did not display correctly. The outlook of Boston Webdesign, LLC from what I have gathered on this project is one that the customer is never right. Instead of working with me to resolve the issue, they insisted it was correct and send multiple rude, unprofessional emails. It finally took me having to create a video of everything that was wrong with the site from multiple computers and multiple browsers before they would even address that their was an issue. This entire project has been one large hand-holding session. This company has no problem taking your money for services that they are not capable of performing. Their delays have cost me over 6 months of profitable business in addition to having to hire another company to come in behind them and clean up their mess. I would not recommend this company to anyone looking for web design services.

Desired Settlement: I would like Boston Websdesign, LLC to provide the .FLA and .AS files they were contracted to modify. If these files are no longer available I would like a refund of the $2,500 that was paid to them to compete this service. I would also like a penalty assessed of $1,000 per month for every month that the contract was not completed in its entirety past the deadline.

Business Response: It is very unfortunate when one comes across individuals who try to get work done and then tries to get their money back somehow. I have attached the original contract which is signed and agreed by *** *****. We built him a great website with all the functionality that he wanted.
*** ***** changed his own mind about everything about 2 -3 times. Most of the time he contradicted his own design e.g: he made us change the logo about 3 times (all logos that he provided). Boston Webdesign, LLC. has accommodated all of these without any extra costs.

More than 6 months after the  site has gone live, he wanted us to add more functionality at no cost. When reminded of the terms of the contract, he started with the threats. We still went ahead and changed quite a few things which we had internal expertise in - unfortunately this was not enough for him.

The .fla and .as files he referred to are flash files from an open source FLASH music player that "*** ****" found on the internet and wanted us to implement - we made him aware that we did not have in-house expertise to modify 3rd party proprietary code and charged him only for implementing the music player.
*** **** is also in violation of the terms and condition of the original contract by removing Boston Webdesign's attribution from the footer of their website. Which our lawyers are aware of.

The attached contract, signed 3/30/11, states that Boston Web Design had 3 weeks to complete the contract.  The contract was never completed and I had to hire other firms to complete the design. 

 

It is unfortunate that all businesses can not have intergrity and pride in their work.  The website that you supposively completed was full of errors in appearance, grammer, spelling, and functionality.  The logo you provided, that I paid for, looked like a 3rd grade art project gone wrong.  I once again had to hire an outside firm to complete a task I paid you for. 

 

I did have to make many changes, as you call them, during the project, and for each one you requested money and were promptly paid accordingly.  Most of these changes stemmed from your inability to design what was previously requested due to your firms lack or knowledge and skill in your profession. 

 

I am asking for the .FLA and .AS files for the music player.  You did not have any problem asking for the money to implement the player, so why am I now finding out that you dont posses the knowledge to complete this task?  I think that it is fair that you provide the files for the services paid, or return the money.

Business Response: First of all this client likes to make false allegations and we have a email trail to backup this claim - it is true that the contract was for 3 weeks - but the contract also states that the client and Boston Webdesign, LLC. works "together" to complete the project. If the client keeps requesting changes - it takes time to implement the changes - (we have an email trail to back this up).

BTW: The 3 weeks was not a problem till we completed the website and the client paid most of the money due and the site went live - but it is a problem now because the client feels this is an opportunity to make some money out of us.

As you can see in the contract the client wants a pop-up music player - when that was delivered, the client wanted something else - this is a client who will NEVER be satisfied. I would like the client to point out where in the contract it states that ".fla" and ".as" files are required by the client?

The point is - the flash player we implemented based on the client's request - worked and works. But now the the client wants to see the code that developers used to make whatever changes they made based on a flash player that the client identified. Note: that the client was completely happy with the flash player for > 10 months and did not request any further modifications and then suddenly based on some other companies request is trying to extort money from Boston Webdesign, LLC. I repeat we have email trail to prove all that we have said.

I would highly recommend the client stop this nonsense and wake up. Buyer Remorse is not something we pay for.
