Complaint: In July of 2010 we contracted with Tunnera & Sons Roofing to have our roof replaced. This included a shingled roof and a flat roof that was to be covered with a rubber membrane. We have since had leakage on the back of the house, in two seperate areas, where the rubber roof was installed. We have had contractors out and were told that the leaking was due to incorrect/inadequate flashing. We also contracted with ******* to replace our wooden deck with Trex Premium Decking. During the installation of the product we pointed out to *******'s installers that the Trex was warped. Mr ******* was outy of town at the time so they continued to install the deck. The decking that they installed was found by two seperate Trex representatives to be defective and improperly installed but, we were told that the Trex company had no obligation to warranty the defective decking due to improper installation. Tunnera & Sons also contracted to construct a new set of stairs off the deck, also using the Trex product. These were done incorrectly according to both the building inspector and the Trex representative. Mr. ******* assured the building inspector that he would make the neccessary corrections. To date the stairs have not passed inspection! We provided ******* with a list of our complaints and were told to "do what you have to do" as he had no intention of honoring either the initial contract for which he was paid in full minus a small amount for "extras". We are left with a warped deck that we will have to pay to have reinstalled, stairs that are not up to building code, and a leaking roof, none of which he intends to honor the warranty on. We are also filing a complaint with the state due to the lack of disclosure that another contractor would be named on our permit application. We were informed that ******* was licensed and insured and would be pulling required permits.

Desired Settlement: At this point we have no confidence in the ability or willingness of Tunnera & Sons to correct the problems. We would like to come to a settlement amount to be refunded to offset the cost of having to now pay someone to do the job we have already paid Tunnera to do.

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********

We do not see how he can possibly allege that these complaints are inaccurate when we have stairs that have not passed inspection per the Marlboro Building Inspector ***** ****. We still have water coming into the house and the back porch despite our one year old roof that has a warranty that he refuses to honor! We have allowed him ample time to correct these issues and others. He has refused. We believe that his response indicates that he has no concern for the fact that he has been paid in full and has not fullfilled the contract that we entered into with him. Every contractor that we have had give us estimates to correct the issues, has made us aware of more shoddy workmanship. We would certainly like to pursue this matter to a conclusion and do not believe that this is the type of contractor that should have an "A" rating.

Business Response: **** had done most of the damage and tried to make it look like Tunnera & Sons fault, he tore holes in his rubber roof and said that the squirrels ate it...Really since when do animals eat rubber. He put in a slider and its leaking, and Tunnera & sons had nothing to do with that. We had gone back and done additional work which he has never paid for,  he has become belligerent and rude.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
