Complaint: A few days after I moved from Boston I called the owner, ******** *****, to let her know I had overpaid her $140 for her services in walking my dog ****. At that time she apologized for the error, obtained my new address, and told me that she would send me a check for that amount, and to call her in one week if I had not yet received it. Two and a half weeks later after not receiving the check, I have left many messages as well as called many times, with no answer. When I call I am put right to voicemail. I don't understand why she won't return any calls or messages when she is the business owner and I was only following her instructions. I am still looking for work at my new residence and even that small amount of money would really help me financially.

Desired Settlement: I just want what is due back to me, $140.

I would like to begin by apologizing for the delay in responding to the "complaint" from Ms. *****.  She did contact me to say that she had overpaid (I do not send invoices so the error was on her part), a few weeks before the Christmas holidays.  This is the busiest time of year for pet sitters, so I suggested that she call me in a week to remind me if she had not received the check. 

She did call back a week later  but then proceded to call 3-4 times a day. I sent a check to her on the December 24, and heard nothing from her for a week - so I assumed she had received it. About  10 days later she left a message on my voicemail that she had not recieved the check, at which time I returned her call, left a voice mail and sent her a text message informing her that I had sent the check. I even described the envelope in which it was sent, in case she had mistaken it for a holiday card and hadn't yet opened it.  She never replied to these messages.  Then, out of curiosity I checked my bank statement and discovered that she had in fact cashed my check on 12/27.  This means she called after she had actually deposited the check. Frankly, it made me wonder if she actually overpaid in the first place. Unfortunately I did not record the exact dates of the phone calls, but the sequence of calls is accurate.

I appreciate how dilligently you have followed up on this, and again apologize for the dalay in my response. Please feel free to contact me with any other concerns or questions.

Consumer Response: I did receive the check ******** sent and did deposit it on 12/27. I did not call her after I had done this. All calls were placed prior to the receipt of it. I had overpaid.

I have reviewed the response submitted by the business and have determined that the response does satisfy my issues and/or concerns in reference to complaint.
