Complaint: They delivered oil to my home and I didnt order it. I have never been a customer of theirs. In fact I am in contract with another oil company. This company is trying to bully me into paying for their mistake. I pay $210 a month for a budget because I cant afford to pay large chunks at a time. They want me to pay them for something that was their office staff and devlivery guys mistake.

Desired Settlement: I want them to eat it. It was their error. They came onto my property, put unauthorized oil into my home and they are trying to bully me. Threatening me with legal action.

Business Response: The consumer will not be getting a refund, this will be handled by our lawyer.

Consumer Response:

[I am not looking for a refund, as I have paid nothing to them.  The owner of this company was rude and acting in a threatening manner to try to get me to pay for this oil.  I did not order this oil, I am not a customer nor have ever been of theirs.  I am in contract with another oil company, and pay them a monthly budget amount because I do not desire to pay lump sums.  This company's error is just that, their error.   Not to mention they put oil in that was 50 cents more a gallon than what was the rate of other oil companies that day.  He is a crook and hides behind his company to do it.   ]

Business Response: This letter is sent to you in response to a complaint filed against our company pertaining to a delivery that was made to ****** **** at ** ******* ***** ** ******** **. ****** **** has purchased Oil from Mathews Oil Co. in the past. For what ever reason the computer printed her ticket for a delivery to be made. The oil was delivered to her home, a couple of hours later, she called our office saying that she didn't order the oil and had no intention of paying for it. I explained to ****** **** that she was in our system and for whatever reason, her ticket printed. This is completely different from, what is known as a missed delivery. With a missed delivery, the oil is ordered by one party, a ticket is generated, and the oil is delivered to a third party, whom we have never done business with. When I asked her if she would please pay it, and that I was willing to sell it to her at below cost, her response was, that she wasn't paying for it and to EAT IT. I politely told her that under Rhode Island law, she had the choice of paying for it or giving the oil back, which she refused. I told her that I was not going to get into an argument with her and that I was going to turn it over to our legal department for advise. At that point she went on to call the local television station, of which they told that they had no intention on pursuing the matter and she called the Better Business Bureau to file a complaint. Let it be known that our small family business has been in operation for over ninety years and never has there been a complaint filed against us or has there ever been a judgement lodged against us. We have an honorable reputation. We make every attempt to satisfy not only our customers, but the general public as well. When ****** ***** publicly called me a CROOK on your website, she slandered my name as well as our families reputation. Currently this is a legal matter that our attorney is reviewing and we have not decided yet what avenue to pursue. We value our A+ Rating with Better Business Bureau very much, and we hope that this unfortunate situation does not affect our relationship with the BBB as well as our A+ rating.

Consumer Response:

I have record that his company left in my mail box showing many other deliveries made to me preiously. I HAVE NEVER BEEN A CUSTOMER OF HIS. I was a gas company customer for the last 13 plus years in Cumberland, where I lived. Obviously his office made a mistake somewhere when I called for pricing when I first moved here. Also, he NEVER offered to get the oil back. I told him I was not paying for it because I didnt order it. If he wanted to take it back he should have said so and he didnt. As far as calling him a crook, when somebody tries to force you to buy something you didnt order, what else would you call them.... Reputable companies would admit their error and apologize, not try to bully. He tried to bully and got very angry from the get.

BBB's Final Determination: After reviewing the position of all parties, BBB determined that the business made a reasonable effort to address the complaint. However the consumer remains dissatisfied.
