Complaint: After the original estimate, Tobin and Sons tacked on a $644.70 charge to my estimate for "Day Certain Load". I asked numerous times why this was added, but was never given an explanation. I spoke to someone at the national van line company (Bekins) who said this charge was not appropriate for the circumstances. I contacted Tobin & Sons numerous times requesting they remove the charge before the goods arrived and payment needed to be made. I was told that only the owner of the company could remove the charge and that he was on vacation until the day the goods would arrive, but he would contact me the following day to resolve this. They would not deliver my goods until the FULL amount was paid, including this charge, so I was forced o pay it. That was nearly a week ago. I have not heard from Mr. Tobin and all of my emails go unanswered. I can provide copies of my communication if needed.

Desired Settlement: I want Tobin & Sons to issue credit on my credit card for $644.70.

Business Response: 1. This Customer was provided an estimate with the Day Certain Load
(DCL) charge of 644.70 listed. After the customer spoke with our salesman xxxx)
who explained the DCL charge to her, she signed and returned the estimate to
be booked on 01/03/14.
 
2. The customer had no issues until Bekins Van Lines told her on 1/27/14 of
a planned delivery date  that would be out of the agreed delivery
date spread due to bad weather for the driver. Bekins credited the customer a
total of $300 ($100 each day late).  
 
3. Bekins explained they must collect payment in full before
shipment can be delivered or else shipment would have to go into storage.
Rich had explained again on 2/5/14 to the customer about the DCL charge. The
customer's destination apartment would not be available until 1/19/14 and the
customer could not be in any time before that requesting a spread delivery date
start 1/20/14 resulting in the customer having to be out on 01/10/14 to meet
this requested spread. xxxxx also called to explain that the owner was out on
vacation and flights were delayed due to weather and as soon as owner was back
he would speak to him and call her back. It seemed that the customer did not
believe this information and the call resulted in her hanging up onxxxxx.
 
4. Once the owner had returned, all of this was brought to his
attention. The customer was explained the DCL charge before she signed the legal
estimate document, she signed with this $644.70 charge listed. Bekins explained
this to the customer on 2/4/14 when she sent them over a copy of her signed
estimate with the DCL $644.70 charge listed, And Bekins explained when there are
issues to be resolved they resort to the signed paper work which she had
forwarded over to them. This paper work did have the $644.70 charge listed. We
did not adjust pricing at any point after she signed and returned the original
estimate. Bekins did gave her a $300 credit due to the shipment being
late.

Information provided in the response is untrue.  Day Certain Load charge was NEVER discussed with salesman or explained by him.  Only discussion with him was in regards to obtaining permit to move from ********* address.  Discussion regarding this charge was with xxxxxxx, who did not understand what it was, but said it "had to be on there."  The issue of the charge was raised not because the shipment was late, but because the van line was asked for an explanation of the charge and responded that it was not appropriate for the situation.  Tobin & Sons provided an ESTIMATE.  It was adjusted for extra items at delivery and it should also have been adjusted to remove this excess/unfair charge.  Also, Mr.xxxxxx should have responded to the customer's concerns as promised.

 

 

 

Business Response: Our salesman, xxxxxxxx, went out and met with xxxxxx and provided her and her mother, xxxxxxx, with an estimate for her move to CA. After the initial meeting with xxxxx,xxxxxx andxxxx only spoke with her mother xxxxxxxxgoing forward as she is the one who signed the relocation paperwork. This shipment was under 3,500Lbs and was picked up in *********, an area where a tractor trailer cannot fit and parking permits are needed.  Day certain loading charges are a cost for small (under 3,500 Lbs) shipments that must be picked up on a certain day. Also where tractor trailers are not accessible, as in *********, and need parking permits. Permits must have a certain day pick up. This shipment weight was estimated at 2,500 Lbs.  The city of ********* requires parking permits which can only be issued for one day, not multiple days. Additionally, xxxxxx apartment would not be ready until Sunday 1/19/14 and xxxxxxxrequested a delivery spread date span starting 1/20/14. Allowing the van line the required amount of transit days which brought us to a 1/10/14 pick up date and the permit to be booked for. The estimate was forwarded over to xxxxxxx and xxxxxxxwith these date spans as requested along with the day certain load charge. After Richard explained the DCL charge to xxxxxx by phone, this estimate was then signed and returned by xxxxxxxx, then booked in the van lines system. Due to bad
weather, the shipment was delivered late and this is when xxxxxxx was dealing directly with the van line who compensated xxxxxxx $300 for the shipment being delivered late. It seems the van line gave a very simple explanation of a day certain load to xxxxxxxxbut did not explain why one would be used in xxxxxxx specific situation. The last conversation xxxxx had with xxxxxx he tried to explain again the reasons why a DCL charge was used for this move which resulted in ******* hanging up the phone on *******. The DCL charge will not be refunded as it was necessary for xxxxxxxxs move. It was listed on the estimate, the customer signed and returned this estimate to our office and the van line directly.  We can provide signed contract paperwork if desired.

There are inaccuracies/omissions in your response: 
xxxxxx NEVER explained the charge by phone. The only discussion with him was regarding permit fees.
Discussion regarding the DCL charge was with xxxxxx who could not explain why it was added but said, "it had to be on there"
xxxxxxx hung up on xxxxxx because she no longer wished to be subjected to his rudeness
It was agreed that Mr. xxxxxx would review the situation and respond.  This never happened.
