Complaint: On Sept. 4, 2012, I called Quality Floors Direct in Wareham to see if they had 51 pieces of American Olean Vallano VL10 Universal Wall Accent tile and was told by ********, "Yes, we have over 60 pieces in stock in our warehouse in Maine." She then said, "Our truck comes every week, and we can have it here in two days" I explained that the company that my contractor is working with on our kitchen remodel was Pro Source in Canton, MA and that they were told by American Olean that this particular tile was out of stock until October 22, 2012. I asked ******** how much she would charge for the tile and she said, "$8.99 per piece." I told her that Pro Source was only charging $7.35 a piece and she quickly responded, "I can match that." I told her that was great and she asked for my credit card number at that time but never told me that this was a special order and that I would not be able to return it or get my money back. Two days later, I picked up the tile and noted that the color was not uniform among the different pieces of tile and ******** said, "Oh, your tile installer will know how to make it blend in." I signed the invoice and when I got home and laid out all 51 pieces of tile, I found that only 10 of the 51 matched the tile color on the display board. I called Quality Floors Direct right away and spoke to ***** *****, the owner, and was told for the first time that this was considered a special order and that I could not return it or get a refund. I questioned how a special order could arrive in 2 days and was told to look at my invoice. It was only then that I noticed in small print at the bottom of the invoice "This Material is Special Order; Non-Refundable; Non-Returnable." I asked ***** what he considered a special order and how it could arrive so quickly and he responded that he sells very little tile - mainly flooring - so he considers tile a special order. I replied that his business is listed on the American Olean website as a certified American Olean dealer and that I would like to at least be able to return the merchandise for a restock fee., which is what Pro Source would have done. He said this wouldn't be possible because he didn't have that type of agreement with NRF Distributors Inc. in Augusta Maine , the American Olean distributor that ******** referred to as "our warehouse" when I first spoke with her. The only thing ***** could do was offer my husband $150 on a future order from his store. I am not satisfied with this offer because I don't believe that this was a special order in the first place. The main distributor to Quality Floors Direct in Wareham is United Distributors in Avon, and I spoke to them after my dissatisfaction and learned that nobody from Quality Floors Direct contacted them to inquire about the tile that I was trying to buy. I believe that the tile that I received may have been a returned item and that it was being passed off onto me as a "special order." I called NRF Distributors Inc. in Maine to see if I confirm my suspicions and if I could return the tile to them and pay them a restocking fee directly, but they said they couldn't do anything without the order number used by Quality Floors Direct, which was not on my invoice or receipt.

Desired Settlement: I would like to return all of the tile that I purchased from Quality Floors Direct in Wareham, MA on Sept. 6, 2012 for a full refund of $390.47 to my credit card.

Business Response: We are a wholesale business and not a direct retailer. The consumer called us looking for a product. The consumer signed and acknowledged a specific order that clearly states "This Material is Special Order, Non-Returnable, Non-Reundable." We even spoke with her thereafter to try and resolve. We even offered a store credit of $390 and she declined. Please see attached invoice. Thank you.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved

Complaint: I had made an order with Quality Floors using their online store on Saturday, 9/8/12 and had to cancel the order on 9/10/12. I called the company using the number listed on their website on Monday, 9/10/12 and asked to cancel the order, I was told no problem, however, my credit card was charged. I wrote an email to the company and "*****" emailed me back 9/14/12 telling me that he had credited my account when I called but it may take some time with my bank. As of today, 9/28/12, our money has not been refunded to our credit card. I wonder if this is a bogus company and it is a scam site.

Desired Settlement: I wish to have the money $650.49, refunded to my credit card.

Business Response: Customer placed an online order over the weekend, cancelled the order Monday. We processed credit in full. The customer then claims to not have received refund. She then cancelled the charge with her credit card company. On 10/17/2012 her credit card company issued a charge back in the amount of $650.49. Amount refunded in full. Customer must take up issue with her credit card company as we have no other available avenues.

Consumer Response:

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint.

I had never received the so-called refund on Monday as stated by the business.  I called by credit card company to tell them I had never received the refund, they are contesting the charges as of 10/9/12.  Company never refunded charges to date.

Business Response: We agree that there is a refund, but as stated in our response, the credit card company already took the money on 10/17 from us in the form of a chargeback. There is nothing more that we can do as the customer's credit card company has the money in question. We will do everything we can to help her retrieve her money including proving the debit from our account.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
