Complaint: I received heating oil from this company over this past winter which resulted in a bill of around $199.00. Due to personal circumstances with my daughter's health, payment of this bill was not possible at the time. On June 16th,
I was confronted by a worker of Magoon's (who isn't in charge of billing and payment) at a wedding, with several witnesses nearby who overheard the conversation. Though I mentioned several times that he should have his company send my husband an invoice, he continued on with threats of taking me to court and demanding that I get in there to settle my bill. Not only was the setting unprofessional, but the manner in which he spoke of this issue was unprofessional. He was neither kind, nor discreet. Later on that evening, I was approached at my place of employment by his son, who also made it clear that I would be taken to court if the bill was not 'taken care of.' Again,
I was humiliated at the fact that this issue is being brought to my attention in front of co-workers as well as family members from earlier in the day. I find that this has been entirely disrespectful, unprofessional and embarrassing.
I have not received any phone calls from Magoon's, but I am being confronted by their workers as well as the worker's family members, in the most inconvenient and inappropriate places. I now have my family members coming to me and asking what this is all about. I don't feel as though my bill should be discussed by anyone other than myself and the billing deparment of Magoon's Transportation, however, it is brought to my attention almost every day, and it seems like it is not being kept confidential whatsoever. Due to defamation of character, I will be discussing my rights with the Maine Attorney General's Office.

Desired Settlement: I would like for my bill to be resolved, as well as a written statement that my bill and any resolution hereof, will be kept one hundred percent confidential and not to be discussed with any workers of Magoon's Transportation that
is not in charge of billing and payment. I do not want to be harrassed by the workers of Magoon's Transportation.

Business Response: In regards to ******* ******* complaint #*******, this is our response.

There is not even an allegation of a violation of law here. Mr. ******** is an employee of Magoon's. Magoon’s can use its employees to attempt to collect debts. Fair debt collection laws do not apply to a creditor and its employees trying to collect the creditors own debts. His son, even assuming he approached Ms.*******, is not himself a debt collector since he was doing it—allegedly—due to the family relationship and not as a business. Again, Mr.  ******** is an employee and restrictions on disclosures under Federal and Maine fair debt collection practices law do not apply to a creditor and its own employees. Moreover, Magoon's holds itself to a high standard of conduct and respect for privacy of its customers well above what the law requires. Mr. ********, as an employee, was the referral person for Ms.*******'s account. Ms. ******* herself signed the account application and agreed to pay us for servicing her propane and heating oil account. We set up the account, delivered propane and heating oil. A balance has remained on her account since October 2011. After several calls to her and numerous statements requesting payment it was asked of Mr. ******** (who is family member as well as a Magoon employee) to inform Ms. ******* to contact Magoon's about her account. This request was done in a professional and private manner.Magoon’s treats its customers with respect. Unfortunately this is not always how our customers treat us. Ms. ******* should simply pay her bill. Please feel free to contact Magoon's if there are any questions or concerns regarding this response. BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
