West Bay Acquisitions, LLC provided debt collection services for the Hollywood Video & Movie Gallery accounts from September 2011 through June of 2013. The collections were done via mail. Consumers who appeared to owe debts to the Hollywood Video and Movie Gallery accounts were sent a letter from West Bay Acquisitions, LLC with information including who the original creditor was, who owned the account, when the account was opened and what titles the debt collection was for. West Bay Acquisition, LLC states that they were collecting on the lesser of either the late fee or the replacement cost as contracted by the Trustee and complying with the Agreed Order.  The business also states that at no time were any Hollywood Video consumer accounts ever reported to any credit reporting agencies.

Complaint: west bay acq opened an account on my credit report with Transunion stating that I owed $94 dollars for some bookclub. It is now on my credit report and is ruining my score. I don't have or have ever joined any book club and don't owe any money to any book club. Irritates me that people and companies can just make up bogus claims of debt and put it on credit reports and ruin your credit without first showing that the debt is valid.

Complaint: West Bay Acquisitions is collecting on behalf of BMG Music Services, a company which I have never done business with. I have sent several letters over the last 3 months asking West Bay Acquisitions to verify this debt with BMG Music Services and have had no response. I did not receive any type of notification or dunning notice from West Bay Acquisition that they would be collecting on the BMG Music Services debt ever, nor did they notify me that they had purchased the debt (if applicable) and they neglected to verify the debt. I have not done any type of business with BMG Music Services.

Desired Settlement: I request that this debt be removed from all three credit bureaus immediately and that they are not allowed to re-submit this false dead again in the future.

Complaint: Went to check my credit report this morning and discovered a new collection account from this establishment had been added. They did not list an address or phone number for just an account number which is ***********. I had to look this place up so I could call. I was informed that the $53 I allegedly owe is to *** Music for CD's I purchased and never paid for and was placed for collection in 7-2008. I did purchase CD's from *** in late 04-early 05 but paid for them. I have never received call 1 or any other collection attempts for said alleged debt. Luckily I have a credit report monitoring service or I would have never known this was added to it. West Bay supposedly acquired this debt in 7-2008 but waited until 6-2014 to place on my credit report? I have received NOTHING regarding this supposed debt and from what I've read this company does this quite often.

Desired Settlement: This is an absolutely ridiculous charge and I would like it removed from all 3 credit bureau's as I do not owe this debt. Thank you.

Complaint: This company has put a derogatory mark on my credit report. I have never ordered anything from this company and it was removed back in April of 2014 only for their purpose to reage the debt. Their practices are illegal to try to change the open date to their benefit.

Complaint: I looked on my credit report and saw a false negative collection report, from West Bay Acquistions LLC, attempting to get me to pay $47.00. The original creditor was listed at *** *****. I have never ordered anything from this company and someone has used my identity to try to collect money from me falsely, with West Bay Acq., being the company trying to get the money from me, falsely listing this collection report and negatively affecting my credit score.

Desired Settlement: I would like this claim to be taken off of my credit report and the collection account closed at once.

Complaint: I recently pulled my credit reports and saw that West Bay is trying to collect a debt from Columbia House with the account number************** in the amount of $127. I have not ordered from this company nor have I ever received any notice from the company nor West Bay concerning this debt that I supposedly owe. I have disputed this debt and I have also written the company. I never received response from West Bay to validate debt or where/when it originated. I have even called Columbia House and they have no record of me ever using them or owing them any money. I believe this debt to be in error and I would like it to be removed from my credit report and all collection activities to be stopped immediately.

Desired Settlement: I want the collections for this fake account to be stopped and removed from my credit report before any more damage is done.

Complaint: This company has repeatedly "Re-Aged" the "Opened Date" on account information provided to the 3 Credit Bureaus. Regarding this particular case the original creditor is Stream Energy an electrical power company that provides service in the Houston, TX area. The current area we live in and have lived in since April of 2010 is *****, TX. ***** ONLY has ONE utility company for both electric and gas which is ***** Texas Utilities Company (BTU). Yet I AGAIN find that West Bay Acq (West Bay Acquisitions) is AGAIN reporting the Date Opened using fictitious information or better known as "re-aging" of account(s), which is illegal. They are reporting in this case the Date Opened as June 10, 2014. Then using a Report Date of June 23, 2014.

Desired Settlement: I believe that they should have to REMOVE the entire account from ALL 3 CREDIT BUREAUS completely and permanently as penalty for reporting FRAUDULENT Consumer Credit information, Otherwise I will file a formal complaint with the Federal Trade Commissions and further request fines be imposed along with this.

West Bay Acquisitions abides by all FDCPA and FCRA laws. It is our company policy that all disputed debts be thoroughly investigated.

In response to Ms. *******’s dispute, please be advised the original creditor, Stream Energy, has confirmed the name and address listed on the account as well as the amount owed.  West Bay never “re-aged” the account.  What Ms. ******* is most likely seeing is the date within which the bureau reported the debt.  She can be sure by calling the credit bureau, but they commonly list “open date” as being the date of the account being reported and not the open date of the account itself.  At one point this account was outsourced to another agency.  This would be a reason Ms. ******* may have seen that it fell off of her report and then went back on.  We would have had to take it off her report and the new agency would put it back on her report.  If the account was returned to us, they would then remove it from her report and we may have once again put it back on her report.  In either case, the “open date” of the account has never been changed or “re-aged.”  The open date for this account is August 8, 2007.

We have sent Ms. ******* several notices regarding this account.  3 invoices/notices were sent in 2012; 3 in 2013 and 1 in March of 2014.   We have never received a written response or a phone call from Ms. ******* in response to any of these notices.   This is a Stream Energy account which was opened in the name of ***** ******* on August 8, 2007.  Stream has also provided the invoice(s) for this account, which are attached to this complaint.

Complaint: In October 2013, I wrote to the BBB about this company. I have included the original complaint below. They responded that they would not pursue and remove from my reports. That only lasted for one month. The inaccurate entries are back on my credit report. Original complaint: Problem description: I recently checked my credit report, and found that as of June 2013, this company has been reporting to the credit companies I am in Collections for $32 for "New Book of Knowledge". I was very upset when I saw that West Bay Acquisition had reported me to all the credit companies for this. I looked it up, it is apparently some sort of encyclopedia. I do not own it, never bought it, this account is not mine. I have not bought anything like this from any company, and definitely not them. I have never received a bill nor had any communications regarding this false debt. They are reporting different addresses of theirs to each Credit Company. Complaint: On April 29, 2014 West Bay Acquisitions received my certified letter requesting validation of account they are attempting to collect (**********). I never received a response from them. Under FDCPA it is not illegal for them not to respond, but if they dont respond they MUST cease collection activity until account has been verified. ***** law specifies they have 30 days to reply to my request. As of today, June 23, 2014 they never responded nor did they "cease collection activity." At this point, I am making every effort to get this matter resolved. I thereby respectfully request that West Bay Acquisitions do the right thing and delete the above mentioned account and cease collection activity at once.

Desired Settlement: Delete all reference to this account with the credit bureaus.

Consumer Response: First of all,  I never received their letter responding to my request for validation within the specified 30 days.  The state of ***** specifies 30 day time limit.  At this point , their response comes too little too late.    They have already violated federal and state consumer protection laws.  Also, they claimed that they never received a letter or notice that mail was undeliverable, but "undeliverable" does not have a bearing if mail was placed in the wrong box or given to the wrong person.  Furthermore, the postal service does not claim 100% delivery rate.  Not only that, but the FDCPA makes it very clear that debtor MUST cease collection activity until account has been verified if validation request is made.  From the time they claim to have received my request till present they never ceased collection activity. And credit bureau reporting is considered collection activity.  I would be curious as to the AUD number associated with their request to the bureaus to cease collection on this account.  I am already entitled to statutory damages set forth by FDCPA in this matter.  Should I take this matter to a court before a jury in my community I am confident there will be a fair outcome.  However, I am making every effort to keep this matter out of court by attempting to resolve with BBB. Complaint: I received a letter from West Coast Acquisitions, LLC in July 2013 stating that I owed them money from an old *** music club membership. I let them know that I had closed the account previously and sent West Coast Acquisitions llc a letter asking for verification / proof of this erroneous charge from 2005. They were unable to produce this proof. I then reached out to the credit reporting agency letting them know that I disputed the charge. The credit reporting agency then investigated and removed the charge from my account. I thought that their judgement ended this. Now flash forward to July 2014 and I have a new letter from West Coast Acquisitions LLC telling me that I owe them money for either the same debt or another fake debt and if I don't pay or contact them in 30 days they will report it to credit agencies yet again. I'm reporting this to the FTC, The Better Business Bureau, and the state attorney's office. I've seen several complaints online regarding this company doing the same thing to other unsuspecting citizens. I don't understand how business's can simply start charging people for things they do not owe and from almost 10 years ago. This is so wrong!

Desired Settlement: I would ask that they would stop trying to collect on a debt that I do not owe, take me off their list and send me a letter absolving me of this debt so I will have in the event that they try to report this again a year later.

Complaint: I had collection from a company I never dealt with. Regardless I paid the $80 with this collection company and it was removed from my credit report. To find it has resurfaced on my report after paying it when it wasn't even my debt. I have a perfect credit score and I do not need a collection on my report when it has been paid and wasn't even mine. I paid this debt and yet continue to hear from them via mail and I have not heard anything since I mailed them a letter with a copy of the check that was cashed months ago. This is fraud.

Desired Settlement: Remove it from my credit report. It has been paid to your collection company. Stop resurfacing it. I don't know who ordered from a book club anyway wasn't me or anyone in our home.

They are all for the same amount, just opened and reported on different dates. It shows it was for purchases through Mystery Guild book club. I don't have an account with Mystery Guild book club, and I certainly haven't ever had three accounts with them. I have also never received any invoices or notices in the mail from West Bay Acquisitions.

I haven't ordered music since I was a teenager from ******** *****. That was close to 25 years ago. My credit score went down 6 points because of this. I am paying on a car payment, a medical bill and student loans which are the only debts I have. I am trying to bring my credit score back up by paying all of the debts off. However whenever I try to call them they put me on hold for 15 minutes then hang up. I cannot contact them to remove this false debt report to my credit score. I did notice this a known scam with the BBB

Complaint: West Bay is illegally trying to collect someone else's nine-year-old debt from me. West Bay listed a delinquent debt on my credit for someone with a name similar to mine, and have never even contacted me regarding the debt. Another collection agency served as West Bay's agent for this debt last year. I got them to close the file, but now West Bay is on it. The debt is ancient, and cannot be collected on under the Fair Debt Collection Practices Act, even if it was my debt, which it isn't. West Bay has disregarded the law and caused my credit score to sink and caused me to be denied a credit card. Their business practices are inexcusable, as they do not even have a match on my last name. The other ****** ****** does not have a hyphenated last name like I do.

Desired Settlement: West Bay must remove the delinquent account from my credit immediately, or I will pursue legal action. I am an attorney licensed in four states, and will seek statutory damages against West Bay if this situation is not resolved.

Complaint: I recently received a collections notice from West Bay Acquisitions stating that they were collecting a debt as an authorized agent of Cascade Capital LLC the successor to Stream SPE, Ltd. West Bay has billed me for $52. I have never had dealings or an account with Cascade Capital nor Stream Energy and do not believe this charge to be valid. ore any other company associated with West Bay. I have disputed the charge formally in writing with West Bay Acquisitions as required to no avail. based on the literally thousands of similar complaints with the BBB against this company and their willingness to simply discontinue all efforts to collect similar charges upon the registering of a BBB complaint, I have a high degree of confidence that this company fabricates hundreds of thousands of fraudulent charges masked by vague "internet purchase collection" legal shelters. I would request that the BBB intervene on my behalf to stop further collection efforts. This seems to be a criminal organization. How can they create debt ad accounts where there was none and just charge people, seemingly at a whim. They seem to charge people a small amount, under the hope that you will pay it to make it go away... It's extortion.

Complaint: On/about April 9, 2014, my husband and I received a consumer explanation letter as part of our mortgage application process. Going though the letter, we noticed an account that did not belong to us. I searched the internet for West Bay ACQ and promptly phoned. I explained the to customer service representative the situation and he verified the account did not belong to us (specifically me since my name is ******* *******). I’m unsure how West Bay Acq “tied” this delinquent account to me since neither the name nor the address matched and the gentlemen verified my SSN was not used. My husband and I lived in ******* at *** **** Street with a zip code of *****. The customer service representative explained “name-address associations” are often used to collect delinquent monies. The name associated with the account is ********* ******* and the address is *** ** ********* with a zip code of *****. This is a horrible practice and I’m sure illegal as this transaction was not only reflected on our credit report but it only brought our credit score down causing us to qualify for a higher interest rate.

Desired Settlement: This debt must be released from my name and the correction made with TransUnion credit reporting agency.

Complaint: Spoke with these guys about a credit dispute for a collections that they placed on my credit rating under quality paper back books, I informed them that I disputed this collection and that the debt was not created by me and that they needed to prove that I entered into this debt as per the fair debt collections practices act and they told me that while there is no documentation of this debt, that said debt was created online and that all that they needed for this debt to be valid was the account had to be opened under my name without any other type of identity information. I told them that I dispute this and that I have never had a need for any book club let alone any that are online and that should I need a book I usually go to an actual bookstore and purchase one. As per this disputed debt, the collections agency was told that I dispute this debt and that by doing so they need to remove the negative impact from my credit rating and cease all collections against me until said debt can be proved without a doubt that I physically agreed to enter into this debt and have left identifiable information proving this point.

Desired Settlement: I want this company to remove all negative information from my credit score as it has unjustly caused me to be denied loans and or services that I would otherwise be approved for had this information not been on my credit score. It is causing me undue hardship and is dragging my good name through the mud.

Complaint: I have been working on rebuilding my credit. As I checked my history today I saw a new account had gone into collections against me. It claims I owe $32 to *** music. I had never heard of this company and had to look it up online to even find out what it was. I was NEVER contacted by this company to tell me that supposedly I have collection account against me. So I call the collections agency, to no avail. This charge is supposedly from 2007. The only way they had my information is through identity theft or it was done without my knowledge by my ex-wife, still without my consent or signature on any contract. Now the statute of limitations in my state is three years. The length something can stay on your credit report is seven years. So then how come I have never heard of this supposed debt of mine from, wait, SEVEN years ago. I am currently filling out my letter to the agency about them trying to collect a zombie debt and filing my complaint, as well as requesting validation. I am also disputing this with all three credit bureaus TODAY! This collection agency has disgusting practices. Oh yeah, to top it all off...*** MUSIC NO LONGER EXISTS. They were bought out in 2008!

Desired Settlement: I want this removed from ALL THREE CREDIT BUREAUS immediately. If not then I do have my rights and will file a lawsuit of my own.

Complaint: Hi, Please, I need your help. I am currently rebuilding my credit slowly, after a Chapter 7 Bankruptcy in 2009. My credit increased only 25 points in the last year, and in on e day, it decreased by the same amount, due to West Bay Acquisitions LLC adding an erroneous charge to my credit report as a collection item. I think they are targetting people who are trying to rebuild their credit, since they know these people may just pay the charge, even though it is erroneous. I pay all of my bills on time and I have NOTHING in collections. In fact, I paid all of my bills on time, until I could no longer do so in March 2009, when I filed for Bankruptcy - I owned several houses and was upside down in all of them, and still, I paid ALL of my bills, hoping to sell one of the houses, prior to my filing for Bankruptcy, so I know I have NOTHING in collection, and besides, it is now 2014 and I have not rented a movie from Hollywood video, since at east 2006, and like I stated, I paid EVERYTHING on time until I had to file for Bankruptcy in March, 2009. Please help - I think it is incredibly despicable that a company can shatter over ne year's worth of rebuilding one's credit, by putting a charge for a collection on someone's credit report, when it is NOT VALID. Complaint: I have received a letter following a call from an individual from a company called West Bay Aquisitions LLC. This letter indicated that West Bay Aquisitions LLC had purchased an an account that belonged to me from Disney Wonderful Wor. The stated account #************ and it was indicated that it was opened 03/21/2007 and past due $48.86 for specific titles. I am disputing this since a very long time ago I can remember indicating to a sales person that we were not interested in purchasing books since my daughter obtained all necessary reading from a nearby library for free. In addition due to work schedule away from home it did not permit monitoring of mailed items. The West Bay Acquisitions, LLC Reference Number on the mail is ******* Unfortunately it seems as though I was billed for stuff although that has now affected my once well protected credit score of 780. I have lost 80 points due to this.

Desired Settlement: I would like to regain my credit score and have the issue removed. I am not sure how and if this can be done. I do not know how to validate if books that I asked not be sent were mailed to my home in 2007. However, I am willing to pay the $48.86 to correct my Credit Rating.

The entries are false, inaccurate, and misleading and are causing harm to my finances and my great credit rating. I have researched this company and they have a reputation for putting false claims on credit bureaus that do not belong to the person.

Complaint: West Bay Acquisitions has placed a collection account on my credit report. I do not hold, nor have I ever held an account with "the literary guild". They currently claim themselves "collecting" on an account to the tune of $84. Apparently, the account was placed for collection on 6/11/2013. I cannot view anywhere I should have been making payments on the account, and I have gone through the trouble of paying for credit reports from all three bureaus -- nothing, nada. I never gave authorization for them, "the literary guild", to sign me up for anything. If this were the case, I'm sure they'd have some type of documentation alluding to this, and yet they do not. I have checked all of my email accounts looking for some reference to this "literary guild" and I have found nothing indicating that I signed up and agreed to pay for anything. I also have not received any written notification of this alleged debt. Furthermore, I recently graduated and everyone knows that students are kings at finding resources for cheap books. I rarely pay for a new book. Foolishness.

Desired Settlement: I require a letter from both "the literary guild" and West Bay Acquisitions stating that this account is false and that they will be annulling me of these charges, and clearing this collection from all three reporting agencies. This needs to be removed from my credit report and promptly.

I have never heard of West Bay Acquisitions but upon further research I have discovered they are collecting debts on behalf of "Hollywood Video". I have never once had a Hollywood Video account nor have I ever rented a movie from any video store. This charge is now affecting my credit, my application process for my refinance and I have never once received any formal notification of this debt of $30 owed to any business. The only way I learned of this charge was from it being on my credit report and my bank notifying/requesting me to explain the collection charge.

Complaint: West Bay Acquisitions, LLC is trying to collect from me on two fraudulent credit card purchases made on my credit card. One for $14.70 and one for $15.70 (Smart Readers/Book of the Month Club/BMC *BOMC ************ PA/BMC*CHILDRENS BOOK CLB ************ PA). I never made either of these purchases and Chase found them to be fraudulent back in 2007, and refunded my credit card. They contacted me in 2011 and I was able to email/fax someone at the time explaining this and they stopped contacting me. They've since again filed a collections notice, etc. to the credit bureaus. Please help me fix this. As it is ruining my otherwise good credit.

Desired Settlement: Remove any charges, close any accounts related to these episodes of fraud, stop contacting me ,and remove any collections notices, any other type of notice that they filed with all/any of the credit bureaus.

West Bay Acquisitions, LLC (WBA) purchased the account from Direct Brands Inc., the original issuer, on April 15, 2011.  The balance on this account is $125.15, not $14.70.  $14.70 was paid into the account.   Our review of the records for this account show that the outstanding charges are valid.   While we have completed our investigation of this account and believe the debt to be valid, in an effort to avoid further escalation, we have decided to cease all future collection activity and permanently close this account.   The other account which Mr. ***** spoke of was a Children’s Book of the Month Club which did not have a balance of $15.70 as Mr. ***** stated, but had a balance of $99.82.  $15.70 was paid into the account.  This account was closed on September 8, 2011 because Mr. ***** sent in a Cease and Desist letter, and we decided to not pursue the account legally and to close the account.  If this account is still showing on Mr. *****’s credit report, he needs to dispute it directly with the credit bureau.

Complaint: I found that I am in collections with this company when I have never heard of them before. I have also just found out that I have been the victim of identity theft and I am working to clear my credit. I stumbled onto the fact that I supposedly owe this company $32 for an account that I had no prior knowledge of. I have never been contacted by them nor have I received any goods or services from them and I am furious that a company can just place a damaging report on anyone's credit and not inform them. I do not want to add this to my identity theft case but I will gladly pass the information along to my lawyer if this is not removed from all 3 (three) credit reports within 30 (thirty) days. I have an anxiety induced autoimmune disorder that has been flared by this entire situation. When I saw this activity on my account this evening I had to be medicated so that I did not end up in the emergency room. If this is not handled quickly, I will easily be able collect damages for my decline in health and I will collect damages from West Bay Acq for damaging my credit as well.

Desired Settlement: West Bay Acq will remove all damaging collections accounts from my 3 (three) credit reports and no further contact ever.

Complaint: This company has filed a negative in my credit and cannot even find the account! When disputed as told, it still remained on my credit...all of $28...the manager told me he would get to the bottom of it and call me back in1/2 hour, but did not. I have now disputed this erroneous credit, but find it appalling that the company listed on my credit with an account number cannot even find it. This should be illegal and this company should not be able to do this! I cannot believe the credit agencies allow this type of reporting, it is just shameful!

Desired Settlement: This email shall stare that you will remove this $28 negative from my credit report immediately!

Complaint: I found a collection charge from them on my Credit Report for $31.00 last year from this same company which was taken off now they did it again for the same amount and when I called them they asked if I lived at *** *** street in *******, WA and I said no I have never lived at that address. She continued to tell me well the only way to get it off of my credit report was to pay it or dispute it. I told her I am disputing it right now and she said that I had to do this in writing or pay the bill. Why should I pay for something when I never lived at that address and I will dispute this in writing as well, but if it is not me then why should I. and if I am already disputing this by phone why can I not send them an Email disputing this as well. Very upset over this.

Desired Settlement: I want this off of my credit report ASAP.

Complaint: A collection has shown up on my credit report in the amount of $86. I have never received a letter or any notification as to the creditor whom I allegedly owe. I have never heard of this agency!

Desired Settlement: remove this from my credit report. Send a detailed letter explaining the alleged debt.

Complaint: This company has placed fake accounts for collection on my three credit bureau reports. I contacted the credit bureaus, Trans Union, Experian, Equifax and they stated that they contacted West bay Acquisitions and the company refused to correct and remove the entry WEST BAY ACQUISITIONS LL #***************.$54 I do not have accounts with them, or with anyone that they work for. I have never been contacted by the company regarding the entries. The entries are false, inaccurate, and misleading and are causing harm to my finances and my perfect credit rating. I have researched this company and they have a reputation for putting false claims on credit bureaus that do not belong to the person.

Complaint: I recently checked my credit report, and found that as of June 2013, this company has been reporting to the credit companies I am in Collections for $32 for "New Book of Knowledge". I was very upset when I saw that West Bay Acquisition had reported me to all the credit companies for this. I looked it up, it is apparently some sort of encyclopedia. I do not own it, never bought it, this account is not mine. I have not bought anything like this from any company, and definitely not them. I have never received a bill nor had any communications regarding this false debt. They are reporting different addresses of theirs to each Credit Company.

Desired Settlement: I would like to get this permanently removed from all 3 credit bureaus. I would like them to not report me falsely in the future.

Complaint: Back in October of 2011 a negative entry was made on my credit report by WEST BAY ACQUISITIONS for $65 for something that I never purchased. At that time it was investigated and determined that I did not owe anything and it was an error. WEST BAY promised to remove all negative credit information they had filed and remove me from their lists, which they seemed to do. Now, two years later, they are reporting the same nonsense again on my credit report, for the same amount and from the same company. This is completely ridiculous that they removed it for two years and are now trying to collect on something that I never even ordered or wanted. This is after they said it was an error and would be removed.

Desired Settlement: I want the negative entry from my credit report REMOVED and I want it to stay off.

The original account number assigned by the issuer was *********. West Bay Acquisitions, LLC (WBA) purchased the account from Direct Brands Inc., the original issuer, on April 15, 2011.  West Bay ceased all collection activity and closed this account on October 2, 2013.  At that time we submitted a deletion request to both Transunion and Experian (we do not report to Equifax) requesting a full deletion of our tradeline (attached). Our review of the records for this account show that the outstanding charges are valid.   While we have completed our investigation of this account and believe the debt to be valid, in an effort to avoid further escalation, we have decided to cease all future collection activity and permanently close this account. (attached AUD deletion)

Complaint: West Bay placed an account on my credit report for Disney Princess. I tried to contact West Bay for a week. Finally, I got an answer. The representative would not give me her name. She insisted that I had an collection account from Disney Princess. She wouldn't even give me their phone number. She told me to go on the internet and find it. So I did. I contacted DP customer service. They told me to call them back and ask for the account number associated with this. I did and they gave me #************. I called customer service for Disney Princess back and gave them the account number. This number does not exist and they could not find anything about me in their system. Or anything about West Bay. I contacted West Bay to tell them what I found. They did not want to cooperate with me. She said they were going to mail and form out to me. I ask her if she could call them to verify the information. I need this removed from my credit. I am in the process of buying a house. This is not fair, these people are scam artist. I never received any type of notice for this.

Desired Settlement: I did a little investigating of my own. These people have bad, bad practice habits. Please flag these people or something to help stop them for destroying hard working people lives. Thank you....

Because of the accusations made in this complaint, West Bay pulled the call recording and listened to the call.  It was quite the opposite in that Ms. ****’ would not cooperate with the agent.  Contrary to Ms. ****’ complaint, the call agent was extremely polite and very patient with Ms. ****, also giving her name when asked by the consumer and informing the consumer of all the details of the account, along with how to go about the dispute process.  We have this call recording available to the BBB or Ms. **** if either wish to review the call. A notice was sent to Ms. **** in which she will see all the details of this account.
 
This account originated as a Scholastic/Royal Disney Princess Club book account opened in the name of ****** **** on January 30, 2007; the titles listed on this account were ordered in January and February of 2007, and are as follows:  8 CHAR POSTER, A PROMISING DAY, JUST IN TIME, MIXED UP MORNING, PRINCESS TIARA, READY SET THROW, SWEET SUCCESS, WATCH OUT ARIEL.
 
Because Ms. **** claims to be buying a home, we do not want to cause any undue stress.  West Bay has investigated the dispute, denies the dispute, but has decided to cease all collection activity and close this account.  We have made the request to any reporting agency this debt may have been reported to, to have this tradeline removed.  This may take the credit bureaus 45 days or more and this is out of our control.
 
If Ms. **** has any questions, she should feel free to call this office at 1-888-737-7608.  We hope this satisfactorily resolves the matter.

I stand by my letter 100%. The real question is, did they send all the recordings in. I bet they didn't. They are not the good guys here. This should have never taken place. A copy of this letter has been sent to an attorney. He has contacted all the necessary people. No record of this information have been found. He has advised me to wait the 45 days. Then contact him with the results.

Complaint: I am trying to get approved for a home loan and have been working on my credit for the last 9 months and I check it tonight to see that I have a $366.00 charge with this company I have never heard of. I have never received a bill or anything regarding this charge please remove it from all three of my credit reports ASAP

In response to Ms. *******’s dispute, please be advised, this is a STREAM ENERGY account.  We have sent four notices to Ms. *******.  Notices were mailed regarding this outstanding debt on June 18, 2012, October 19, 2012, February 5, 2013 and again on April 3, 2013.  West Bay mailed these notices to ***** ****** Drive, ******n, TX  *****.  None of these notices were returned to our office as “undeliverable” so we can only assume she received them.  The notices included the original creditor’s name, the amount owed and the date the account was opened, along with all of West Bay’s contact information.  To date, Ms. ******* has never called this office to inquire about this debt on her credit report or the notices sent to her residence.  The original creditor, Stream Energy, has confirmed the name and address listed on the account as well as the amount owed.  Stream has also provided the invoices which reflect a breakdown of the charges.  Those invoices have been attached to this response, for her review.
 
Ms. ******* should call this office at 888-737-7608 and any customer service representative will be happy to assist her.  Her account number is ******.   In the interim, we have marked her account as disputed.

Complaint: I received an email from credit karma that my credit score was updated. I logged in to find out that a $31 charge had been sent to collections. The company charging the $31 is West Bay Aquisitions located in Cranston Rhode Island. I called them to figure what the $31 was for. They said in 2006 I ordered music from BMG music and never paid for the sales package. I do not recall ever ordering music from BMG and if I did, I am sure the charge would have been placed way before now. It has been almost eight years and it just now goes to collections? They refuse to provide details over the phone dealing with the account. They have no evidence at all to backup the charges. They also said that other companies had the debt before them. So I asked well why didnt they post it to my credit report? The man said " I can't speak for those other companies". I know I did not make a purchase on BMG and West Bay's story is flawed. This company has had over 600 complaints in the last month. I want my credit score returned back to where it was and West Bay removed from my report.

Desired Settlement: I want the $31 charge off my credit report and my credit score back to where it was. I also want West Bay Aquisitions to be investigated and legally punished for damaging peoples finances.

Complaint: I am calling in response to a credit inquiry that I authorized my realtor to make in order for me to be approved for an apartment. My realtor contacted TransUnion and TransUnion informed them that I had an account in collection, and that this was affecting my credit score. As a result, I was declined approval for the apartment on 9-24-13 based on this credit score. My realtor encouraged me to call TransUnion and I did. I check my credit score every January for accuracy and in January of 2013 my credit had no such collection action against my credit report. TransUnion told me that there indeed was a new collection in my credit history, which appeared on May 23, 2013. They told me the name of the group was RMG and I was given a phone number listed as belonging to West Bay Acquisitions LLC. I have no idea who these people are and I have never received a phone call from them, I have never received any correspondence indicating there was a collection action, or that I owed money to anyone. In fact, I owe no one any money. I called West Bay Acquisitions to dispute the charge and they were very vague about what the collection was about, saying only that it was from a 2002 subscription. I told them I had no idea what they were talking about and I wasn't paying. I asked them why they did not try to get a hold of me before damaging my credit if they thought I owed money, and they did not answer. They then demanded money from me "to take the collection action off of my report whether I owed it or not." When I told them there should be no collection action on my report at all because I don't owe anything to anyone, I was told not to "give them attitude," and I was called "arrogant" when I denied the debt. I told them to send me proof that I owed them anything and they then hung upon me. I then called TransUnion back and told them I had spoken to West Bay / RMG, or whoever they are, and that I was convinced this was a fraudulent situation based on their behavior, the limited details they were able to give me, and the lack of notification that there was even a debt issue. Transunion is now disputing the collection action. I want all 3 major credit reporting agencies to remove this collection action against me as fraudulent and would like appropriate punitive action to be taken against these frauds to insure they won't do this to anyone else. This behavior should be illegal.

Complaint: In March of 2013 I check my credit report. I was very upset when I saw that West Bay Acquisition, had place a charge of $133.00 on my credit report. I contacted them, I was told to send a letter stating my finding. The letter was sent it was immediately removed from my Experian credit report. September 2013 I review my Trans Union credit report, to discover it's on my report again but now it's for $132.00 and West Bay has sold the account to Chase Receivables. These people have ruined my credit score. When I called Chase Receivable all they could tell me was they will have to investigate my complaint. Meanwhile, my credit was dropped by almost 70 point. I have told them over and over I have never ordered a CD or DVD ever. Someone please help me I'm being falsely accused.

Complaint: This "business" sent me a collection notice for $94.12, which I allegedly owe to Columbia House DVD, which supposedly I enrolled in April 20, 2005. I've never created an account in this company, and obviously never purchased any items or received any services from it. Please look into this company.

Complaint: I recently checked my credit report to find a charge - in collections!! - from West Bay Acquisitions, although I have not ever transacted business with this company. I have received no notice of any type from this company indicating that money was owed, and I have NO idea what the $87 charge is even for. I'm incredibly upset that a company can just throw something on your credit report, and list it in collections which is damaging, without an individual's knowledge. Complaint: This company has supprisingly placed deragotory information on my credit report file on 7/29/13, 8/5/13, and 8/16/13. A collection charge of $26 has been listed in my credit report file and placed as a "new account" on 7/4/13. I have already called the 1-888-737-7608 listed for this company requesting more information on this collection account recently placed in my credit report file. The representative I spoke to could not give me any detail information on this collection account. I gave my current residence address so any information regarding this account can be sent to me; however; I have not received anything from them. It has been over a month now. I am unaware of the nature of this account and most importantly have had a difficult time trying to clear it from my credit report which had NO NEGATIVE accounts prior to this one. I feel this company has violated my rights under the Fair Credit Act by adversely placing derogatory/negative information in my credit report without properly providing details of the amount or account.

Desired Settlement: I would like this collection account to be removed from my credit report file.

Ms. *********’s called this office on 8/5/13.  The account was explained to her, in its entirety.  I believe there may have been confusion on what exactly was being sent to her.  The call representative explained to her we would be sending her a letter (this would be the dunning notice); she also explained to Ms. *********, that once she receives that letter, her rights are listed there on there, and if she wanted verification, she would have to send a written request.  West Bay never received her written dispute, and therefore the invoices were not sent.  It was explained to Ms. ********* that the original creditor, Stream Energy, had confirmed the name and address listed on the account as well as the amount owed.  Stream has also provided the invoices with a breakdown of the charges.  Those invoices have been mailed to Ms. ********* in response to this BBB dispute.  In the interim, we have marked his account as disputed.

West Bay Acquisitions has made NO ATTEMPT to communicate with me prior to placing this derogatory mark on my credit file. (Not written & not verbal) I have no knowledge of what this alleged bill they say I owe them consists of. I certainly would NEVER allow an amount such as $26 to deliberately lower my credit score. When I called, they were only able to give me limited amount of information and could not provide what this amount I allegedly owe is for. I was told I would receive something in writing (which I have not). I also requested a fax# to submit a written dispute directly to them and C/S rep could not give me that either.  I am in the process of buying a car and this company has made it VERY difficult for me to obtain financing. I will move forward to next step if necessary in order to get this straighten out as soon as possible.

FDCPA §809. Validation of debts [15 U.S.C. §1692g] states:  Notice of debt; contents: Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing the details of the debt in question.

Complaint: I have been researching everything I can do regarding "West Bay Acquisitions" as they are alledging that I owe a $33 debt to them. I never received any debt notice nor phone calls regarding this 2007 debt they claim I owe. I found out about this alledged debt from my "Credit Sesame" account that monitors my credit. In July, I received an alert to my email where this company's name appeared. Immediately I researched the company and wrote down the number and called. I spoke to a representative whom apparently had looked up the account under my former name ******* ***** and the account was under my former address of *** ****** Road, *********, FL *****. The representative stated that it was a debt of goods that I received from "Schlolastic"??? I asked him when was this account allegly opened and he stated in 2007. Mind you, I have never officially received any letters or phone calls regarding this debt and only knew of it in July 2013 when I received a credit alert from "Credit Sesame". I called the company on August 7, 2013 and asked them to send me proof of the alledged debt that I owe as I would be disputing it. I know I do not owe this debt and need to do everything to get it off my credit report. My last name has changed since 2010 and my husband is an active-duty ****** Officer therefore, I know in some states there are special service member and family "rights" in some situations. If you could direct me in any way to get this taken care of.

Complaint: I recently checked my experian credit score and discovered I had a $24.00 charge in collections. When I looked further I found the name of the company which I had NEVER heard of. I called the number and left a voice mail. When they called back I was told it was from 2008 and was from the schoolastic book club. I have never had any account from them, and more to the point I had never received an invoice from them. I have lived in the same place since 2006 so I am not so hard to find if they wanted to send me an invoice. The tactics of placing a detrimental report on my credit rather than trying to contact me to resolve it I find to be rather "strong arm". My first instinct is that this is just a scam to collect money from people who would rather just pay them to remove the report from their credit. No one has at any point offered any back up as to any transaction which initiated this situation.

Desired Settlement: I wish to have this negative report on my credit removed. And have the matter closed.

Complaint: West Bay has sent a fraudulent charge of $30.92 (from early 2007) to collections on my credit report on 7/1/13 and again on 8/1/13. Thankfully experian spotted it, and we began a fraud investigation. I had a great credit score, and this has added a blemish to my record, which I have worked hard to maintain above 700. I have contacted West Bay Acquisitions, and they said they would send me information regarding the charge on July 26th. As of today, August 5th I have received nothing. The Reference #*******, and I spoke with **** about this. They said I signed up for the "Early Moments, Scholastic book club". I have never signed up for this. During the second charge 2/8/2007 I was living in England!!!

Desired Settlement: I would like to have the information updated to reflect that I do not owe anything to West Bay Acquisitions. I would also like to have West Bay Acquisition submit a written letter to all three credit reporting agencies deleting the collection from my credit report.

There was never an attempt to reach me nor have I ever received any notification on this. This account is ruining my credit especially when I'm in the process of obtaining a mortgage for a new home I just built. Please help me resolve this matter. I have looked up some 1000 complaints against this company in a single year and it seems that this is their common practice to sandbag consumers and ruin their credit without even ever notifying them. If I had known about this even if I didn't owe I would have paid to prevent this from going to my credit history.Thanks

The charges are fradulent and it has affected my credit score greatly. I became even more unsettled when I saw all of the complaints against the company through the BBB as well as blogs online. I was never contacted by the company with notice that an account was going to be incollections and the gentelman which I spoke with told me that they didn't have to mail anything until a first contact. If they recieved this account two weeks ago, why was I not contacted.

Desired Settlement: I would like this to be taken off of my Credit Report (Experian) and the account to be closed.

Business Response: In response to case # ******* wherein the consumer believes that they do not have an account with Scholastic:  This account originated as a Scholastic/Dr. Seuss & Friends book account opened in the name of ****** ******** on January 21, 2007.
 
West Bay Acquisitions and all of our partner agencies abide by all FDCPA and FCRA laws. It is our company policy that all disputed debts be thoroughly investigated in determining whether a dispute is a result of identity theft or simply confusion on the part of the consumer that they did not remember making the transaction. All of the accounts that West Bay Acquisitions has purchased are verified by the issuer to be accurate and valid debts.
 
Based on Ms. ******’s dispute, we have decided to cease all collection activity and close this account.
