Complaint: I ordered a cake on December 10th, 2012 and I was suppose to receive the cake on December 28th for my boyfriends surprise party the next day. The cake did not arrive and I had to spend money on a new cake. No notice or tracking information was given to inform me the cake would not arrive on time. They had no customer service on the weekend, so I had no idea what was going on until Monday. I spoke with a Customer Service representative at 1-800 Bakery and she told me they could not issue me a refund since the cake was not delivered due to bad weather conditions. Customer Services said they would send out a new cake and I would receive it on Wednesday, however I was going to be on vacation and had no use for a cake anymore. Not only did I not receive my cake on time, but I never received the first cake at all...which was supposedly already on the way. Customer Service said they they were being "more than fair" issuing me a store credit. I don't think it was MORE than fair since I never received a cake in the first place and since the cake was for a special occasion that had long past. The store credit that they promised didn't arrive, so I had to call back 2 times. Then they issued me a credit of $0.00, so I had to call again. I am very disappointed in their customer service. I have wasted so much time trying to figure out how to get a refund. The cake was for my boyfriends surprise party which has come and gone already. I have no use for a store credit to 1-800 bakery as I will not be using their services in the future. I never received a product and therefore deserve a full refund.

Desired Settlement: I want a refund back to my paypal account for the full amount.

Business Response: Here is the information regardìng the Order #***** for ***** *******.

As requested on the order, her requested delivery date was 12/28/ 12. The package was shipped on 12/26/12 for delivery by UPS on 12/28/12. Unfortunately, the package came upon adverse weather conditions and got delayed.On our web site we state that we are not responsible for delays due to adverse weather.When we spoke with ***** on the phone regarding the fact that the package was going to be late,she said she didn't want it because no one was going to be at the address to receive the package,so we cancelled the delivery with UPS. ***** asked for a refund and we told her we would send hera gift voucher for the full amount of the order-$52.51 to be used on a future purchase which we didon 12/31/12.

We told her we were not responsible for adverse weather condítions. She still insisted ona refund. Many customers were faced with delivery delays on their packages during the last last two weeks of stormy December and they were very understanding. We thought it very fair în giving ***** her gift voucher for the full amount of her order.
