Complaint: Big problems with real estate agents (unprofessional text messages and lost $3500 check) Promised dishwasher that was never delivered (major selling point) Never met the real estate agents, got no assistance with move-in/information about move-in. We found this apartment on craigslist ourselves. Promises were not kept.

Desired Settlement: Dishwasher Installed to apartment (not a "portable" dishwasher). or Refund of payment ($3500)

Business Response: To whom it may concern,



      As the office manager I have been involved and aware of this process in regards to this unit. There was a check that got lost in the mail which I can understand is frustrating but it does happen from time to time when receiving so much mail on a yearly basis.  The text messages is something I can not speak about because I have never seen them so if you have any information on that I would appreciate it.  I do know that these tenants were having some communication problems with their initial agent so we immediately connected them to another agent to facilitate their rental process and make sure the apartment was theirs.  As like most move-ins on 9/1 the property manger for this unit told us to give these tenants his number and he would take care of the move in process and this is very common on such a a busy day. If he had not told us he would handle it we would have been in contact with our clients to make sure they had the necessary move in information.  We do not manage or own this particular unit so our involvement only goes so far when we do not have the final say on issues pertaining to this unit.  In regards to the dishwasher, we had worked out a deal with the property manager over the phone and through email correspondence during the rental process.  When these clients moved in the actual owner of the unit suddenly decided he did not feel like putting the dishwasher in.  The property manager relayed this to us even though he acknowledged the fact that they were supposed to have a dishwasher, he said there is nothing he could really do if the owner does not want it. After many conversations pleading with the property manger to supple them with a dishwasher as he promised he agreed to supply a portable dishwasher (which Modern Real Estate would pay for). When we finally worked out a date for the dishwasher to go in (after many back and forth’s) the current tenants decided they did not want the portable dishwasher and it was not good enough.  We worked really hard to get the property manager to get this delivered and we would pay for it but it is not the type of dishwasher they want so that is why the delivery was canceled.  Since we do not manage or own the property we have no right to enter, install, or hire to install a contractor to do any work on this unit without the owner's ok.  We tried as hard as possible and were available as much as possible to help these tenants get what they wanted to the best of our ability and scope of reach.  At the end of the day we were told the dishwasher would be given to them, we told them the same, the property manager reneged on his promise, we finally were able to get a dishwasher for them (at our expense) which they intern did not like.  We did not at any time blow them off, tell them we would not try and help, or tell them tough luck and wipe our hands of it.  We have gone above and beyond to fight for them for what was promised to us/them, and continue to do so.  If you have any questions at all please don't hesitate to contact me.   Thank you,**** *****

Complaint: I went through this particular real estate company when I found an apartment that I wanted to rent. I went through the standard processes and decided to put money down on the place. I was assured by the agent that the apartment was mine, and that I was approved for the place. Over the next couple of days, I gave this company, $2670 in order to pay the required first month, last month, and finders fee. All of this was paid in CASH, and I was told that because it was off-season, cash was better. After signing a lease on 12/3, and receiving keys, I was told later that day that the apartment had been leased to someone else. I was assured that we would find something else at the same price etc, etc. I found another place through them and decided to once again try to rent it. This place cost $140 more than the last, and I gave these people the rest of it once again in cash. I was ultimately not accepted by the landlord and then I decided to not work with this company anymore. When I asked for my money back, I was informed that I could not have it back until the FIRST landlord sent back his check to the real estate office. I have been very patient and don't know what to do anymore. I was told that they had received one check from the landlord but they were waiting on another from him. Part of this money was also a finders fee of $530. We have not received that either. I feel like I'm being taken for a ride. My fiance and I have saved up this money in order to get an apartment of our own. We are currently living with friends and have all of our belongings in storage. We have waited about a month with no refund whatsoever, and barely any contact. We cannot begin to look for an apartment again until we receive this money. I don't know what to do anymore. I have been in contact with one agent in particular. He was very helpful in the beginning and is now telling me less, and less about what is going on. He doesn't seem to know how much money he owes us, and claims that he cannot look at the company account to see whether the landlord cashed our checks or not. I am SERIOUSLY upset, and am sending this complaint to you first before I take these people to court, and sue for the money plus hardship. I will NOT be pushed around by this company ANYMORE. Please help. Thank you

Desired Settlement: I am owed $2810 in total. I want my money back in a timely fashion.

Business Response: I would need to have alittle more information as far as an Apt address who the real estate agent was. We are not fimilar with this issue.
